Thedefendanttestifiedthatfollowinghisreleaseonbondforthepresent #  offenses,hewasconvictedforspeedingandhavinganimproperexhaustsystem.He %" saidhewasalsoconvictedoftheassaultandbatteryofhispregnantgirlfriend,for f'^ $ whichhehadattendedfourabusealternativeclasses.Hetestifiedthathehadbeen 2)*"& expelledfromhighschoolandhadnotobtainedhisGED.Hestatedthatduringthe *#( timeinwhichhisprobationreportwasbeingpreparedforthehearing,heused ,%* marijuana.Hetestifiedthathedidnotthinkhecouldpassadrugscreenatthetimeof .', thehearingandthathehasaproblemturningdownmarijuana.Hesaidthathehad b0Z). receivedalcoholcounselingandwaswillingtoundergodrugcounseling. .2&+0  Thedefendanttestifiedthathewasinvolvedinanearlierassaultthat 5.4 occurredbecausehisfatherforcedhimintoafight.Hetestifiedthathehasachildby 706 hiswife,fromwhomheisseparated,andwasexpectinganotherchildbyhisgirlfriend.  Hestatedthathehadnotpaidchildsupportbecausehecouldnotlocatehiswifeorthe  child.Hetestifiedthatheperformedconcreteworkforthreeweeksthrougha   temporaryagency.Hesaidhewasfiredbecausehisprobationappointmentsmade l d himlateforwork.Hetestifiedthathehadnotworkedinoneandonehalfmonths 80 becausehehadbeentakingcareofhisgrandfather.Hestatedthathehadbeen   offeredajobtheweekendbeforethehearing.Upontheforegoingproof,thetrialcourt   orderedthedefendanttoservehissentenceinthecustodyoftheDepartmentof   Correction. h`  Thedefendantcontendsthatthetrialcourterredbynotallowinghimto  servehissentenceincommunitycorrections.Hearguesthatheisagoodcandidatefor  rehabilitationandthatthetrialcourtessentiallypunishedhimforhavingadrugproblem.
