Blankenshipv.State,858S.W.2d897,904(Tenn.1993)(citingCaudillv.Jago, 5+, 747F.2d1046,1052(6thCir.1984)).#L↥#Ԁ p  7-.   9/0  ` Inthecaseatbar,Defendanttestifiedheknewthathewaspleadingguiltytoarecommendedsentenceoftwelveyearstobeservedateightyfivepercent,buthedidnotknow"andhiscounselshouldhaveinformedhim"thatthe @  changeinlawrequiringaconvictedoffendertoserveeightyfivepercentofthesentencedidnotapplytohisoffensebecauseitwascommittedpriortotheeffectivedateofthechange.DefendantcontendsthatcounselerroneouslyattestedbeforethecourtthattheeightyfivepercentrequirementdidinfactapplytoDefendantscase.ThetranscriptoftheguiltypleahearingreflectsthatwhenaskedwhetherthechangeinthelawappliedtoDefendantscase,hiscounselrepliedintheaffirmative. ` However,atthepostconvictionevidentiaryhearing,Defendantscounsel,AttorneyHallieMcFadden,testifiedthatbothsheandtheprosecutingattorneyknewthatthechangeinthelawrequiringeightyfivepercentservicedidnotapplytoDefendantscase.ShestatedthateightyfivepercentserviceofsentencewasapartofthepleaofferbytheStateandthatafterconsultationwithDefendant,theychosetoacceptthatofferasbeinginDefendantsbestinterest.McFaddentestifiedshediscussedwithDefendantthattheeightyfivepercentservicewasnotrequiredbylaw,butbytheStatespleaoffer.SheexplainedthatshehadnotpaidcloseattentionatthepleahearingwhensheinformedthejudgethatDefendantwasrequiredtoserveeightyfivepercentofthesentence perthestatuteratherthan perthepleaagreement.Aknowingandvaoluntaryguiltypleagenerallywaivesanyirregularityastoreleaseeleigibility.Hicksv.Sttate,945 4*, S.W.2d706,709(Tenn.1997).  7.0  ` McFaddenalsotestifiedthatthepartiesoriginallybelievedDefendanthad notpenetratedtheyoungvictimduringtheoffense;butpriortothepleaagreement,investigationsrevealedthatthevictimhadcontractedasexuallytransmitteddiseasecarriedbyDefendant"indicatingstronglythatDefendantdidpenetratethevictim.Furthermore,therecorddemonstratesthat,inexchangeforDefendantsguiltypleatoaggravatedsexualbatteryandaggravatedburglary,theStatedismissedsevencountsofespeciallyaggravatedburglary,onecountoftheft,onecountofaggravatedburglary,andonecountofevadingarrest. ` Inlightoftheevidencepresentedatthepostconvictionevidentiaryhearing,weconcludeboth(1)thatDefendantdidnotsuffertheineffectiveassistanceofcounsel,and(2)thathisguiltypleawasvoluntarilyandintelligentlydelivered.Wethereforeaffirmthedenialofpostconvictionrelief.̀ `     h    "0    ` ̜ `     h   ____________________________________ `     h   DAVIDH.WELLES,JUDGECONCUR:___________________________________̜GARYR.WADE,PRESIDINGJUDGE___________________________________̜JOEG.RILEY,JUDGE
