Weaffirmthejudgmentofthetrialcourt.  OnJanuary12,1996,thepetitionerenteredaguiltypleatotheftofmorethan$1,000butlessthan$10,000,aClassDfelony.Asapartofthepleaagreement,thestatevoluntarilydismissedotherburglaryandtheftcharges.ThepetitionerreceivedaRangeII,fiveyearsentence,tobeservedintheDepartmentofCorrection.Atthetime,thepetitionerwasonparoleforapriorsentenceforaggravatedrobberyandfaceddetainersinWilliamsonCounty,Tennessee,Florida,andAlabama.  Inthispetitionforpostconvictionrelief,thepetitionercontendsthathiscounselwasineffectiveforadvisinghimthat,becausetheparoleviolationhearinghadnotyetbeenheld,hissentencecouldbeconcurrentifthejudgmentformwassilentinthatregard.Thepetitionerclaimsthathewouldnothaveenteredintothepleaagreementhadheunderstoodthatthesentenceswouldnotbeconcurrent.  Attheconclusionoftheevidentiaryhearing,thetrialcourtaccreditedthetestimonyofthepetitioner'strialcounsel,aveteranpublicdefender,whostatedthathisfilerecordswouldhavereflectedanyrequestonthepartofthepetitionerforaconcurrentsentence.Thetrialjudgeruledthattherewasa"cleardiscussionintheguiltypleatranscriptofthesentenceandhow[]byoperationoflawitwouldbe 8.4 consecutivetoanyunfinishedsentencesofthepetitioner."Thetrialcourtconcludedthatthepleawasknowinglyandvoluntarilymadeandmorespecificallyruledthat"thepetitionerwasnotcredibleonanyissueregarding[hisattorney's]representation."  Inthisappeal,thepetitionerarguesthatthesentencingcourtfailedtoaddresstheconsecutivesentencingissueduringthesubmissionproceedingandhadadutytodoso.Thestatearguestothecontrary.  Whenapetitionerseekspostconvictionreliefonthebasisofineffectiveassistanceofcounsel,hemustfirstestablishthattheservicesrenderedortheadvicegivenwasbelow"therangeofcompetencedemandedofattorneysincriminalcases."Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Second,he  mustshowthatthedeficiencies"actuallyhadanadverseeffectonthedefense."Stricklandv.Washington,466U.S.668,693(1984).Shouldthepetitionerfailto "( establisheitherfactor,noreliefiswarranted.Astoguiltypleas,thepetitionermustestablishareasonableprobabilitythat,butfortheerrorsofhiscounsel,hewouldnothaveenteredthepleaandwouldhaveinsistedongoingtotrial.Hillv.Lockhart, '" 474U.S.52,59(1985).InHendersonv.State,419S.W.2d176,178(Tenn.1967), )X $ oursupremecourtruledthtthatapleaagreementwhichincludedconcurrentsentencingforanoffensecommittedwhilethedefendantwasonparoleforapriorcrime,renderedthepleavoid.Whentheaccusedentersapleawhereinallpartiesagreetoalessersentencethanispermissiblebylaw,"theaccusedshouldbeallowedtowithdrawhisplea."Id.;seeStatev.Burkhart,566S.W.2d871(Tenn. 2T). 1978);TerryL.Charltonv.State,No.01C019701CC00002(Tenn.Crim.App.,at 4 +0 Nashville,Aug.20,1998).Ineachofthesecases,thepetitionerandtheotherpartiesclearlyagreedtoconcurrentsentencing. 8.4 ЇXXX X  # XXXX#Underourstatutorylaw,thepetitionerbearstheburdenofprovinghis `  allegationsbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f).Onappeal,thefindingsoffactmadebythetrialcourtareconclusiveandwillnotbedisturbedunlesstheevidencecontainedintherecordpreponderatesagainstthem.Brooksv.State,756S.W.2d288,289(Tenn.Crim.App.1988).Theburdenison 0 thepetitionertoshowthattheevidencepreponderatesagainstthosefindings.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978). (    Theoverridingdeterminationonthevalidityofaguiltyplearestsuponwhetheritwasknowinglyandvoluntarilyentered.Statev.Neal,810S.W.2d131, , 13940(Tenn.1991),overruledinpartbyBlankenshipv.State,858S.W.2d897 X (Tenn.1993).Iftheproofestablishesthatthepetitionerwasawareofhisconstitutionalrights,heisentitledtonorelief.Johnsonv.State,834S.W.2d922,  926(Tenn.1992)."[A]pleaisnot'voluntary'ifitistheproductof'[i]gnorance,[or]incomprehension....'"Blankenship,858S.W.2dat904(quotingBoykinv.Alabama, "( 395U.S.238,24243(1969)).
