Ðconvenience€store.€€When€it€arrived,€they€instructed€the€driver€to€take€themÏapproximately€one„half€mile,€to€a€location€that€the€State€characterized€as€woodedÏand€secluded,€along€a€street€with€several€vacant€homes.€€As€the€perpetratorsÏexited€the€car,€Defendant€heard€Robert€Blocker€demand€money€from€the€driver,Ïwho€reached€over€between€the€seats.€€Defendant€told€police€that€he€believed€theÏdriver€was€reaching€for€a€gun,€so€he€pulled€a€sawed„off€shotgun€from€his€pantsÏand€pointed€it€at€the€driver.€€He€then€shot€the€driver€at€a€range€between€six€andÏtwelve€inches€from€his€head.€€All€three€perpetrators€fled€the€scene,€and€an€areaÏhomeowner€discovered€the€victim€when€the€taxicab€crashed€into€her€patio.€€€ÌÌà@††$®àI.€MOTION€TO€SUPPRESSˆÌà ` àDefendant€contends€that€the€trial€court€erred€by€failing€to€suppress€theÏstatement€he€made€to€police€on€the€night€he€was€arrested.€€He€argues€(1)€thatÏofficers€did€not€advise€him€of€his€òòMirandaóó€rights€until€after€he€made€his€statement,Ð Ðmother€prior€to€any€questioning€about€the€murder.€€Carroll€denied€having€anyÏdiscussions€regarding€the€outcome€of€the€case,€and€he€denied€making€anyÏpromises€in€exchange€for€a€statement.€€Carroll€also€denied€threatening€DefendantÏto€induce€him€to€provide€a€statement.€€The€detective€testified€that€Defendant€andÏhis€mother€signed€the€waiver€of€rights€form,€and€that€œDetective›€Tommy€WoodsÏand€Ken€McCrary,€a€juvenile€officer,€also€witnessed€Defendantððs€signature.€€ÌÌà ` àOn€cross„examination€at€the€juvenile€court€hearing,€Detective€CarrollÏacknowledged€that€four€or€five€other€officers€accompanied€him€to€DefendantððsÏhome€at€the€time€of€the€arrest,€that€Defendant€was€taken€separately€from€hisÏmother€to€the€police€service€center,€and€that€Defendant€did€not€have€anÏopportunity€to€confer€in€private€with€his€mother€prior€to€his€interview.€ÏFurthermore,€the€detective€stated€that€he€had€a€conversation€with€DefendantÏbefore€he€turned€on€the€tape€recorder€to€record€the€statement,€but€not€before€heÏread€Defendant€his€òòMirandaóó€rights.€€€€€€€€€Ð 4¨** ÐÌà ` àDefendantððs€mother€testified€that€on€the€day€of€his€arrest,€her€son€openedÏthe€door,€saw€the€officers,€and€said€he€would€get€his€mother.€€According€to€Ms.Ð  :À00 ÐBlocker,€officers€followed€Defendant€back€into€the€house€and€told€Defendant€thatÏthey€were€taking€him€in€for€questioning€about€a€murder.€€They€told€Ms.€Blocker,Ïwhile€in€her€sonððs€presence,€that€she€needed€to€come€to€the€police€service€centerÏbecause€she€ð ðknew€aboutðð€the€crime€and€ð ðcould€also€be€arrested.ðð€€ÌÌà ` àWhen€asked€ð ðat€what€point€[Defendant]€was€read€his€Miranda€rights€in€theÏinterview€room,ðð€Ms.€Blocker€replied,€ð ðAfter€Tim€Carroll€told€him€if€he€bullshittedÏhim,€heððd€make€sure€heððd€get€the€g__d___€chair€and€my€son€said,€okay,€Iððll€tellÏyou€what€you€want€to€know.ðð€€Ms.€Blocker€also€testified,€ð ðIn€my€presence€the€manÏjust€kept€saying€that€he€know€[sic]€what€happened€and€that€I€knew€whatÏhappened€and€if€he€keptð"ðif€he€keptð"ðif€my€son€bullshitted€him,€heððd€make€sureÏhe€got€the€chair€and€he€kept€cursing€my€son.ðð€€She€stated€that€the€òòMirandaóó€rightsÐ ¸X Ðwaiver€form€ð ðwas€read€as€the€man€was€signing€it,€as€the€man€was€writing€out€theÏthing,ðð€and€she€affirmed€that€Defendant€acknowledged€on€tape€that€he€hadÏsigned€the€waiver.€€When€asked€on€tape€whether€they€had€been€threatened,Ïneither€Defendant€nor€his€mother€stated€that€threats€had€been€made.ÌÌà ` àDefendant€also€testified€at€the€juvenile€suppression€hearing.€€He€stated,ÌÓÓà8 ` àWhen€we€came€out€of€the€house€[on€the€night€of€arrest],€DetectiveÏTim€Carroll€pulled€me€away€from€a€female€officer€and€took€meÏacross€the€street€and€he€said€what€do€you€know€about€the€cab€driverÏmurder.€€I€said€I€donððt€know€nothing.€€He€said€before€this€night€isÏover€your€g__d___€ass€is€going€to€know€something€and€he€took€meÏback€over€there€to€her,€to€the€female€officer.€€€€€Óg'ÓÐ ` ü!` ü! ÐHe€affirmed€that€officers€told€his€mother€ð ðshe€could€be€arrested€for€knowingÏsomething€about€the€murder.ðð€€Defendant€stated€that€he€signed€the€rights€waiverÏð ð[a]fter€Tim€Carroll€kept€like€making€his€little€threats€about€the€electric€chair.ðð€€HeÐ 9¼// Ðstated€that€no€one€read€the€form€to€him,€that€the€threats€scared€him,€and€that€heÏwould€not€have€made€a€statement€to€police€had€he€not€been€threatened€with€theÏelectric€chair.€€ÌÌà ` àDefendant€testified,€ð ðFirst,€[Carroll]€asked€me,€asked€me€my€story.€€AfterÏhe€wrote€all€of€that€down,€he€told€með"ðhad€me€to€sign€it€and€he€didnððt€read€it€offÏto€me€or€nothing,€asked€me€to€sign€it.ðð€€He€claimed€that€his€òòMirandaóó€rights€wereÐ 0  Ðread€to€him€for€the€first€time€on€the€tape€recording,€after€he€had€given€his€versionÏof€events€and€signed€the€waiver.€€He€admitted€that€he€had€an€opportunity€to€readÏthe€waiver€before€he€signed€it,€but€stated€that€he€did€not€because€he€was€ð ðtooÏbusyðð€and€ð ðthinking€about€the€threats€[Carroll]€made€and€thinking€about€[his]Ïmama€and€[his]€sisters.ðð€€Finally,€Defendant€acknowledged€that€he€stated€on€theÏtape€recording€that€he€understood€his€rights,€waived€his€right€to€a€lawyer,€andÏwaived€his€right€to€remain€silent.€€ÌÌà ` àThe€juvenile€court€judge€ruled€in€favor€of€the€State,€denying€DefendantððsÏmotion€to€suppress.€€She€stated€that€she€did€not€find€evidence€of€coercion€andÏforce€so€as€to€render€the€waiver€of€rights€involuntary.€€Furthermore,€she€stated,€ÌÓÓà8 ` àI€think€there€is€a€logical€time€frame€laid€out€in€this€that€supports€theÏtestimony€of€the€officer€and€œ[is]€also›€supportive€of€the€testimony€ofÏthese€parents€over€here.€.€.€.€I€donððt€find€anything€inconsistent€withÏthe€Stateððs€testimony€and€I€find€nothing€offered€by€the€defendants€onÏthis€through€their€witnesses€to€believe€that€these€were€anythingÏother€than€voluntarily€obtained€by€the€officers€in€the€course€of€thisÏinvestigation€that€night.Ó'/ÓÐ ` ü!` ü! ÐÌœÌÐ  :À00 Лà@dd#®àòòCriminal€Court€HearingˆÐ `  Ðóóà ` àAfter€Defendant€was€transferred€to€the€Hamilton€County€Criminal€Court€toÐ h  Ðbe€tried€as€an€adult,€that€court€held€another€suppression€hearing,€in€which€theÏjuvenile€hearing€transcript€was€entered€into€evidence.€€Detective€Carroll€andÏDefendant€testified€consistently€with€the€prior€hearing.€€Defendantððs€mother,€Ms.ÏBlocker,€reiterated€her€previous€testimony€but€added€that€Detective€Carroll€toldÏher€at€least€three€times€that€ð ðthey€were€going€to€try€to€have€[Defendant]Ïelectrocuted.ðð€€At€the€same€time,€she€testified€that€Carroll€told€Defendant,€ð ð[I]f€youÏtell€me€what€I€want€to€know,€Iððll€go€to€the€Judge€and€Iððll€talk€to€the€Judge€and€tellÏhim€that€you€cooperated€and€Iððll€do€.€.€.€what€I€can€for€you.ðð€€œIn›€addition,€sheÏtestified€that€her€son€could€read€only€at€a€third„grade€levelð"ðnot€well€enough€toÏunderstand€the€òòMirandaóó€waiver€formð"ðand€that€he€had€already€told€officers€hisÐ ¸X Ðstory€twice€before€ever€being€read€those€rights€(during€the€tape€recorded€portionÏof€the€statement).€€€€€€ÌÌà ` àThe€trial€court€denied€the€motion€to€suppress,€making€several€findings:€(1)Ïthe€defendants€were€properly€arrested;€(2)€the€requests€made€of€the€parents€andÏguardians€to€be€present€were€proper;€(3)€statements€made€to€Ms.€BlockerÏregarding€her€possible€knowledge€of€the€facts€were€not€coercive€in€nature;€(4)€theÏprocedure€in€the€interview€room€and€police€service€center€hallways€wasÏextremely€reasonable,€œtimely,›€and€not€coercive;€(5)€no€questioning€took€placeÏprior€to€proper€admonitions€under€òòMirandaóó;€(6)€the€time€sequence€between€theÐ 4¨** Ðrights€offerings€and€the€actual€taping€of€the€statements€was€extremelyÏâ âreasonable;€(7)€the€interviewing€between€individuals€was€reasonable€and€veryÐ 8¸.. 2°(* ÐAlthough€he€did€not€consider€Defendantððs€prior€crimes€to€be€ð ðmajor€offenses,ðð€heÏfound€that€the€crimes€were€concentrated€in€a€very€short€period€of€timeð"ðbetweenÏthe€ages€of€fourteen€œand›€eighteen.€€He€therefore€increased€Defendantððs€sentenceÏfrom€the€twenty„year€mid„point€to€twenty„two€years.€€Ð Ð9p02 Їà ` àNext,€the€trial€judge€rejected€enhancement€factors€two€and€eightð"ðthatÏð ð[t]he€defendant€was€a€leader€in€the€commission€of€an€offense€involving€two€(2)Ïor€more€criminal€actorsðð€and€that€ð ð[t]he€defendant€has€a€previous€history€ofÏunwillingness€to€comply€with€the€conditions€of€a€sentence€involving€release€in€theÏcommunity,ðð€respectively.€€òòSeeóó€òòid.óó€ðð€40„35„114(2),€(8).€€The€judge€noted€that€heÐ  À Ðdid€not€find€ð ðany€significant€basisðð€œto€support€a€determination€that€Defendant›€wasÏthe€leader€in€commission€of€the€robbery,€despite€the€fact€that€Defendant€shot€theÏvictim.€€Furthermore,€he€declined€to€find€œany›€significant€history€of€unwillingnessÏto€comply€with€conditions€of€release€because€Defendant€committed€the€offenseÏas€a€juvenile,€and€all€previous€criminal€convictions€were€from€œthe€juvenile›€court.€Ï€€€€€€€€€€€€€Ô#†Šr¢ ŠŠŠ3)Ž#ÔÔ‡Š3Š ŠŠr¢ÔÐ À` МñêñÌñêñ›à ` àThe€trial€judge€then€considered€and€rejected€the€three€mitigating€factorsÏpresented€by€Defendant.€€First,€the€judge€found€mitigating€factor€œtwoð"ðthat›€ð ð[t]heÏdefendant€acted€under€strong€œprovocationððð"ðinapplicable›€because€this€case€didÏnot€ð ðinvolve€a€theft€case€where€an€individual€is€stealing€food€for€his€family,ðð€andÏbecause€he€found€no€other€proof€of€provocation€in€the€record.€€òòSeeóó€òòid.óó€ðð€40„35„Ð p& Ð113(2).€€Next,€he€rejected€mitigating€factor€eight,€that€ð ð[t]he€defendant€wasÏsuffering€from€a€mental€or€physical€condition€that€significantly€reduced€theÏdefendantððs€culpability€for€the€offense.ðð€€In€support,€the€trial€judge€noted€that€heÏfound€nothing€in€the€expert€testimony€presented€to€indicate€a€disability€within€theÏmeaning€of€this€mitigating€factor.€€Finally,€œalthough€he€noted€that€Defendant€wasÏseventeen€years€old€at€the€time€of€the€offense,ñëñð ðñëñ€he€also€found€that€the€DefendantÏwas€ñìñð ðñìñstreetwise,ððñæñ€ñæññåñand€therefore€ñåñð Ð(d).€€We›€therefore€enhance€Defendantððs€sentence€in€accordance€with€the€findingsÏof€the€trial€court,€and€we€sentence€Defendant€to€œnine›€years€as€a€standard€rangeÏI€offender€for€attempted€especially€aggravated€robbery.ÌÌà@<<"®àœV.›€CONSECUTIVE€SENTENCINGˆÌà àAfter€concluding€that€Defendant€was€a€dangerous€offender€due€to€theÏnumber€and€increasing€severity€of€his€prior€convictions,€the€type€of€offenses€in€theÏconvictions€at€bar,€the€lack€of€indication€that€rehabilitation€would€be€successful,Ïand€the€need€for€the€public€to€be€protected€from€these€type€of€offenses;€the€trialÏjudge€approved€consecutive€sentencing,€with€Defendantððs€twenty„two€yearÏsentence€to€be€served€consecutive€to€his€sentence€of€life€without€the€possibilityÏof€parole.€€òòSeeóó€òòid.óó€ðð€40„35„115(a)(4).€€€€Ð àDefendant€contends€in€this€appeal€that€consecutive€sentencing€is€improperÏbecause€the€proof€does€not€support€the€trial€courtððs€finding€that€he€is€a€dangerousÏoffender.€€We€conclude€that€the€trial€court€fulfilled€its€role€in€the€sentencingÏprocess€such€that€its€findings€œconcerning€consecutive€sentencing€should›€beÏreviewed€ñçñòòñçñdeñçñóóñçñ€ñèñòòñèñnovoñèñóóñèñ€with€a€presumption€of€correctness.€€After€conducting€thisÐ ð[t]he€proof€must€also€establish€that€the€termsÏimposed€are€reasonably€related€to€the€severity€of€the€offenses€committed€and€areÏnecessary€in€order€to€protect€the€public€from€further€criminal€acts€by€the€offender.ðð€ÏòòId.óó€at€938.€€Finally,€the€trial€court€must€consider€the€general€sentencing€principlesÐ °P Ðcontained€in€Tennessee€Code€Annotated€ðððð€40„35„102(1),€40„35„103(1),€and€40„¼35„103(2).€€òòId.óó€€Ð À!` ÐÌà ` àThe€transcript€of€Defendantððs€sentencing€hearing€reflects€that€the€trial€courtÏconsidered€these€general€sentencing€principles€as€well€as€the€other€factorsÏenumerated€above.€€Furthermore,€we€have€reviewed€the€record€and€concludeÏthat€it€supports€the€trial€courtððs€decision.€€With€regard€to€the€factor€of€protectingÏsociety€from€further€criminal€acts€by€the€offender,€it€has€been€posited€that€thereÏcan€be€no€œnecessity€to›€œòòfurtheróó€protect›€society€from€an€offender€sentenced€to€lifeÐ
