Anderson,857S.W.2d571,572(Tenn.Crim.App.1992).   ` Thetrialcourtsdenialofjudicialdiversionissubjecttoappellatereversalonlyifthatcourtabuseditsdiscretion.Statev.Hammersley,650S.W.2d352, P 356(Tenn.1983).Whenadefendantchallengesthedenialofjudicialdiversion,weareconstrainednottorevisittheissueiftherecordcontainsanysubstantialevidencesupportingthetrialcourtsdecision.Id. $   ` ThisCourthasstatedthatindeterminingwhethertograntjudicialdiversion,thetrialcourtmustconsider4==40 ` (a)theaccusedsamenabilitytocorrection,(b)thecircumstancesoftheoffense,(c)theaccusedscriminalrecord,(d)theaccusedssocialhistory,(e)thestatusoftheaccusedsphysicalandmentalhealth,(f)thedeterrencevaluetotheaccusedaswellasothers,and(g)whetherdiversionwillservethepublicsandtheaccusedsinterestsintheendsofjustice.4> ` T$` T$ >44==4Statev.Bonestel,871S.W.2d163,168(Tenn.Crim.App.1993).Moreover,the 3)+ recordmustreflectthatthecourthasweighedallofthefactorsinreachingitsdetermination.Id.Thecourtmustexplainontherecordwhythedefendantdoes 6-/ notqualifyunderitsanalysis,andifthecourthasbaseditsdeterminationononlysomeofthefactors,itmustexplainwhythesefactorsoutweightheothers.Id. P   ` TherecordindicatesthatthetrialcourtconsideredandbalancedtheabovefactorswhenitdeniedAppellantsrequestforjudicialdiversion.ThetrialcourtexaminedthepresentencereportandnotedthatAppellantslackofacriminalrecordwasanimportantfactorinitsdecision.ThetrialcourtalsorecognizedthatAppellanthad skills,talents,[and]abilities.Inaddition,thecourtnotedthatAppellanthada goodbackgroundinherchurch,community,workactivities,andwithherchildren.Infact,thecourtconsideredAppellantsfamilycircumstancesinmakingitsdecisiontograntprobationratherthanimposeincarceration. ` Althoughthetrialcourtrecognizedthesefavorablefactors,thecourtconcludedthattheywereoutweighedbyconcernsabouttheinterestofthepublicandtheneedfordeterrence.ThecourtnotedthatAppellanthadstolen$22,000fromanemployerwhohadputherinapositionoftrust.Thus,otherpotentialemployershadaclearinterestinknowingthatAppellanthadbeenconvictedofthisoffense.Inaddition,thecourtwasconcernedthatdiversionwouldsendamessagetothepublicthatbeingconvictedofembezzlementmerelyresultsinhavingtorepaytheamountthatwasstolen.Thus,thedeterrenteffectonthepublicwasofgreatconcern. ` Weconcludethatthetrialcourtsdeterminationtodenyjudicialdiversionissupportedbysubstantialevidence.OfparticularimportanceisproofthatAppellantbeganembezzlingmoneyalmostassoonasshewashiredbyBurchfieldOverbay,thatsheembezzledmoneythroughoutthefifteenmonth 9p02 periodofheremployment,thatsheutilizeddifferentmeansofembezzlingthemoney,andthatshefalsifieddocumentsinordertokeepherwrongdoingfrombeingdetected.Underthesecircumstances,wecannotsaythatthetrialcourtabuseditsdiscretionwhenitdeniedAppellantsrequestforjudicialdiversion. ` Accordingly,thejudgmentofthetrialcourtisAFFIRMED.464#Xr XX XP#4674#" XXr; #47? `  `  `  `  ` ?  ? ` ? `     h   ____________________________________ `     h   JERRYL.SMITH,JUDGECONCUR:___________________________________DAVIDG.HAYES,JUDGE___________________________________JAMESCURWOODWITT,JR.,JUDGE
