InApril1994,thepetitionerpledguiltytoseveralcharges , forwhichhereceivedaneffectivesentenceoftwelveyears,sixyearstobeservedonsupervisedprobationandsixyearstobeservedonunsupervisedprobation.InJuly1996,thepetitionerwasarrestedforseveralotheroffenses,includingpossessionofmarijuanaandunlawfulpossessionofaweapon.Fourdayslater,hisprobationofficerfiledaprobationviolationreport,allegingthatthepetitionerhadviolatedhisprobationbyfailingtoobeythelaws,failingtoreporthisnewarrest,illegallypossessingaweapon,possessingmarijuana,andfailingtopayallrequiredfees.FollowingaprobationrevocationhearinginDecember1996,thepetitionersprobationwasrevoked.Hedidnotappeal.  InDecember1997,thepetitionerfiledapetitionforpostconvictionrelief,allegingthathisattorneyhadbeenineffectiveforfailingtoappealtheprobationrevocationandforstatingattheprobationrevocationhearingthatthepetitionerhadviolatedthetermsofhisprobation.Byagreedorder,theparties stipulatedthatpriorcounselforthepetitionerwasnotineffectiveinhisrepresentation,but agreed...thatthepetitionerisentitledtoadelayedappealupontherevocationofhisprobation.
