Itisundisputedthatthedefendantviolatedseveraltermsofherprobation.Attheprobationrevocationhearing,thetestimonyindicatedthatthedefendanthadfailedtomaintainemploymentand/orprovideemploymentverification,hadfailedtoreporttoherprobationofficer,hadfailedtopaycourtorderedfeesandexpenses,andhadfailedtopayprobationfees.Theevidencefurtherindicatedthataftertenmonthsonprobation,thedefendanthadpaidapproximatelyfortydollars($40)towardthenearlytwentythousanddollars($20,000)incourtorderedfeesandrestitution.Thedefendantclaimedshehadobtainedemploymentbutdidnotreportittoherprobationofficer,MarkMays,becauseshewasbeingpaid underthetable.ThedefendantalsoinsistedthatshedidnotreporttoMr.Maysbecauseshedidnothavearideandshecouldnotgetintouchwithhimtoexplainorrescheduleherappointmentbecausehewasoutoftheoffice.ThedefendantfurtherclaimedthatwhenshefinallydidreporttoMr.Maysoffice,hewasmeetingwithsomeoneelseand,asshewasinahurry,shecouldnotwait.Inaddition, 4 +. thedefendanttestifiedthatshehadstartednursingschoolinanefforttoobtainajobthat 42+0 wouldenablehertopayrestitution.  Thedefendantnowcontendsthatthetrialcourterredinrevokingherprobation.Whenatrialjudgefindsthataprobationerhasviolatedtheconditionsofhisorherprobation,thetrialjudgehastheauthoritytorevokeprobation.SeeT.C.A.40 0 35310.Indeterminingwhetherornottodoso,thetrialjudgeneednotfindbeyondareasonabledoubtthataviolationofthetermsofprobationhasoccurred.Theexistenceofaviolationneedonlybesupportedbyapreponderanceoftheevidence.T.C.A.4035311(d).    Inprobationrevocationhearings,thecredibilityofthewitnessesisforthedeterminationofthetrialjudge.Bledsoev.State,387S.W.2d811,814(Tenn.1965); $ Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980).Onreview,thefindingsof  thetrialjudgehavetheweightofajuryverdict.Delp,614S.W.2dat398;Carverv.State,  \ 570S.W.2d872,875(Tenn.Crim.App.1978).Wewillnotdisturbthejudgmentofthetrialjudgeintheabsenceofanabuseofdiscretion.ForthisCourttofindanabuseofthetrialcourtsdiscretion,thedefendantmustdemonstrate thattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudgethataviolationoftheconditionsofprobationhasoccurred.Statev.Harkins,811S.W.2d79,82(Tenn.1991). )X $   Inthecaseatbar,thedefendantconcedesthatsheviolatedthetermsofherprobation.However,shecontendsthatthetrialcourterredinnotallowinghertoremainonsupervisedprobation.  ThedefendantarguesthatitwaserrorforthetrialcourttoconsidertheStatesimplicationthatthedefendantfailedtocontactMr.Maysbecauseshewasunabletopassadrugscreen.However,therewasnoindicationthatthecourtconsideredthis 8.4 asafactorinthedecisiontorevokethedefendantsprobation.Assuch,thiscontentioniswithoutmerit.  Thedefendantfurthercontendsthatherfailuretopayrestitutionandcourtordeeredfeesshouldnothavebeenconsideredbythetrialcourt.Shearguesthateventhoughshewasindigentandusuallyunemployedthroughoutherprobation,shepaidsomeformofrestitution,albeitaminimalamount,forfourmonths.Inaddressingtheissueofindigencyasabasisforprobationrevocation,theTennesseeSupremeCourthasfoundthat  [i]nrevocationproceedingsforfailuretopayafineorrestitution,  asentencingcourtmustinquireintothereasonsforthefailureto  pay.Iftheprobationerwillfullyrefusedtopayorfailedtomake  sufficientbonafideeffortslegallytoacquiretheresourcestopay,  thecourtmayrevokeprobation....#Statev.Dye,715S.W.2d36,40(Tenn.1986)(quotingBeardenv.Georgia,461U.S.660,  67273(1983)).  Inthecaseatbar,thedefendanttestifiedthatshewasemployedatTilliesMarketfromMarchof1997untilNovemberof1997.ThedefendantclaimsthatsheenrolledinnursingschoolinNovemberof1997andbeganworkingasaNursingAssistantatNHCColumbiaHealthcareinJanuaryof1998.񀀀However,attherevocationhearing,thedefendantdidnotintroduceanyevidencetocorroboratehertestimony.Inaddition,thedefendantfailedtoofferanyevidencethatshewasunabletopaythecourtorderedfees.  #  2      ׀ P-#( Underthesecircumstances,itcouldeasilybefoundthatthedefendant willfullyrefusedtopayorfailedtomakesufficientbonafideeffortslegallytoacquiretheresourcestopaycourtorderedfees.Id.󀀀Assuch,itwasnoterrorforthetrialcourttoconsiderthe 2T). defendantsfailuretopaycourtorderedfeesandrestitutionattheprobationrevocation 4 +0 hearing.  ThedefendantalsochallengesthetrialcourtsconsiderationofthedefendantsfailuretoreporttoMr.Mays.ThedefendantarguesthatalthoughthetrialcourtfoundthatifshewasunabletoreachMr.Maysbytelephonesheshouldhavewrittenhimaletter,thetrialcourtfailedtonotethatMr.Mayswasnotpresenttotestifyattherevocationhearing.ThedefendantcontendsthatiftheState,Mr.Maysemployer,hadtroublelocatinghim,then itisnotfarfetchedtobelievethat[thedefendant]wouldhavetroublelocating[him]....Thiscontentionismeritless.Thedefendantconcedesthatshedidnotreporttoherprobationofficer.Inaddition,asitiswithinthediscretionofthetrialcourttodecidethecredibilityofthewitnesses,itwasnotanabuseofdiscretionforthetrialcourttodisbelievethedefendantsexcuses.Assuch,itwasnoterrorforthetrialcourttoconsiderthedefendantsfailuretoreporttoherprobationofficerasgroundsforprobationrevocation.  Insum,thedefendantfailedtoreporttoherprobationofficer,failedtopaycourtcostsandrestitution,andfailedtomaintainand/orprovideverificationofemployment.Therefore,itwasnoterrorforthetrialcourttorevokeherprobationandreinstatetheoriginalsentence.SeeT.C.A.4035310,311(1997).Accordingly,we )X $ affirmthejudgmentofthecourtbelow.
