F PaulG.Summers,AttorneyGeneralandReporter;PatriciaC._Kussmann_,AssistantAttorney & General;MichaelL.Flynn,DistrictAttorneyGeneral;andWilliamRamseyReed,AssistantDistrict   AttorneyGeneral,fortheappellee,StateofTennessee. !  e@@OO& OPINION #"  #XX3#X3X#XX3 #  X3X  Thedefendant,MichaelLynnBreeden,appealsasofrightfromtheBlountCountyCircuit v% $ Courtorderrevokinghisprobationonaneffectivesentenceoffouryearsresultingfromhis f&!% convictionsforfourteencountsofautomobileburglary,onecountoftheftofpropertyvaluedover V'"& fivehundreddollars,andsixcountsoftheftofpropertyvaluedunderfivehundreddollars.The F(#' defendantcontendsthatthetrialcourterredbyrevokinghisprobationandrequiringhimtoservethe 6)$( balanceoftheoriginalsentence. &*v%)     OnMarch31,1999,thedefendantenteredguiltypleas tothechargesinexchangeforan ,V'+ effectivesentenceoffouryears.Hewasrequiredtoservesixtydaysinconfinementwiththe ,F(, remaindertobeservedonprobation.Thedefendantwasalsorequiredonamonthlybasistoperform -6)- communityservice,topayrestitution,andtopayprobationfees.Therecordreflectsthatthe  defendantmetwithhisprobationofficerasrequiredAprilthroughJuly1999.However,theofficer  didnotseeorhearfromthedefendantafterJuly6untilthedefendantcalledhimfromjailacouple  ofweeksbeforetheNovember1999probationrevocationproceeding.Also,thedefendantfailed  todocommunityserviceortopayrestitutionandprobationfeesafterJuly. p   Thedefendantacknowledgedthathemissedtheappointmentsanddidnotmeettheother P  probationrequirements.Heexplainedthathewasworkingasabrickmasonandlivinginatrailer @  when,oneday,hegotevicted.Hesaidthathewasafraidtoreporttotheprobationofficerbecause 0  hehadnoplacetolive.HesaidthatatthetimeofhisarrestinSeptember,hehadbeenlivingin  p  Knoxville,parttimewithhisgirlfriendandparttimewithanotherfriend.Heacknowledgedthathe `  wasnotworkingatthetimeofhisarrest.Hesaidthathisgirlfriendhadofferedhimaplacetolive P  andthathislifewouldbemorestableinthefuture. @    Thedefendantacknowledgedthatheknewwhatwouldhappenifhedidnotreporttohis   probationofficer.Headmittedthathehadbeenfoundinviolationofprobationthreedifferenttimes  inanothercase.However,hesaidthathehadnotcommittedanynewoffensesandthathecould  begintopayrestitutionifhestayedonprobation.    Thedefendantsgirlfriendtestifiedandverifiedthatshewouldallowthedefendanttolive  withherinherhome.Shesaidthatallofhismoneycouldgotowardrestitutionandthatshewould p beinapositiontoprovidehimtransportationtomeethisneeds.Sheadmittedthatwhenshelearned ` aboutthedefendantsprobationandtoldhimthatheneededtocallhisprobationofficer,hedidnot P followheradvice. @   Thetrialcourtfoundthatthedefendantviolatedthetermsofhisprobation.Itnotedthatthe  p defendantsexpressreasonfornotreportingwasnotcredibleandthatthedefendanthadprevious ` probationviolations.Itconcludedthatthedefendantsprobationshouldberevoked. P   Thedefendantcontendsthatthetrialcourtshouldnothaverevokedhisprobation.Heasserts 0 thathewouldbeundermoresupervisiononprobationthanhewillbeuponparole.Also,hestates   thathecanbemoretimelyinhisrestitutionpayments. !   Essentially,thedefendantisaskingustoreplacethetrialcourtsdecisionwithours. #!
