ÐCourtððs€revocation€of€his€probationary€sentence.€€As€a€result€of€the€probationÏrevocation,€he€is€currently€serving€his€sentence€of€eight€years€and€one€month€forÏthree€counts€of€possession€of€cocaine€with€the€intent€to€sell€or€deliver.€In€thisÏappeal,€the€defendant€contends€that€the€state€presented€no€substantial€evidenceÏthat€he€had€violated€the€terms€of€his€probation€and€that€the€revocation€was€obtainedÏin€violation€of€his€due€process€rights.€€Based€upon€a€thorough€reading€of€the€record,Ïthe€briefs€of€the€parties,€and€the€law€governing€the€issues€presented€for€review,€weÏaffirm€the€judgment€of€the€trial€court.ÌÌà ¸ àWe€have€found€it€difficult€to€determine€the€sequence€of€events€that€ledÏto€the€revocation€of€the€defendantððs€probation.€€The€record€contains€some€seriousÏgaps€and€much€conflicting€information.€€We€have,€however,€pieced€together€theÏfollowing€chronology.€€ÌÌà ¸ àOn€April€5,€1990,€the€defendant€pleaded€guilty€to€three€indictments€forÏpossession€of€cocaine€with€the€intent€to€sell€or€deliver.€€€The€trial€court€sentencedÏhim€to€serve€concurrent€sentences€of€six€years€as€a€Range€I€offender€on€two€of€theÏcharges€and€eight€years€and€one€month€as€a€Range€II€offender€on€the€third.€ÏApparently,€the€trial€court€ordered€the€defendant,€who€had€already€served€211€days,Ïto€serve€the€remainder€of€his€sentence€in€Community€Corrections.׃×Ý ƒ #ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€AfterÐ -P(+ Ðsuccessfully€completing€some€type€of€community€corrections€program€and€a€periodÏof€house€arrest,€the€defendant€was€placed€on€probation€in€July€of€1991.€€A€probationÏofficer€testified€that€the€defendant€was€arrested€for€shoplifting€in€1993.€€TheÏdefendant€vigorously€denied€this€allegation,€and€the€state€made€no€attempt€toÐ €4Ð/3 Ðsubstantiate€the€arrest.€€On€January€6,€1995,€a€probation€violation€report€was€filedÏalleging€that€the€defendant€had€tested€positive€for€cocaine€in€a€routine€drug€test,€thatÏhe€had€failed€to€report€since€December€7,€1994,€and€that€he€had€failed€to€attend€theÏAfter„Care€program€at€CADAS.€€€Although€a€capias€issued€shortly€thereafter,€theÏwarrant€was€not€served€at€that€time.€€Documentary€evidence€introduced€withoutÏobjection€through€a€probation€officer€shows€that€the€defendant€was€arrested€onÏOctober€30,€1995€for€theft€of€property€worth€less€than€$500€and€for€possession€ofÏan€illegal,€dangerous€weapon.€€He€pleaded€guilty€the€next€day€and€was€sentencedÏto€serve€30€days€on€each€conviction€and€to€pay€a€$50.00€fine€and€court€costs.€€TheÏsentences€were€suspended€contingent€upon€payment€of€the€fine€and€costs€and€hisÏgood€behavior.€€ÌÌà ¸ àOn€July€9,€1997,€the€defendant€was€arrested€for€ð ðoutstanding€warrantsÏin€sessions€courtðð€in€the€same€two€misdemeanor€cases€and€then€served€with€theÏoutstanding€probation€revocation€capias.€€Sandra€Caldwell,€a€probation€officer,Ïtestified€that€the€defendant€pleaded€guilty€to€the€two€1995€misdemeanors€on€JulyÏ10,€1997.׃×Ý ƒ #ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ׀Р°"  ÐÌà ¸ àThe€defendant€appeared€to€be€confused€about€the€events€that€tookÏplace€in€1995€and€on€July€10,€1997.€€At€first€he€said€that€he€did€not€remember€theÏarrests€in€1995.€€Then,€after€a€recess,€he€recalled€the€arrests.€€Finally,€in€responseÏto€the€prosecutorððs€insistent€questioning,€he€admitted€that€he€had€pleaded€guilty€onÏJuly€10€but€thought€that€he€was€only€supposed€to€pay€a€fine.׃ ¸ àAt€the€conclusion€of€the€hearing,€the€trial€judge€found€that€theÏdefendant€had€violated€his€probation€based€upon€the€defendantððs€perhapsÏinaccurate€ñ¤ ñœacknowledgement›ñ¤ ññ¤ ñacknowledgmentñ¤ p&À!$ ÐÐ P( #& Ðà ¸ àThe€revocation€of€probation€is€committed€to€the€sound€discretion€of€theÏtrial€judge.€€òòSeeóó€òòState€v.€Harkinsóó,€811€S.W.2d€79,€80€(Tenn.€Crim.€App.€1991).€€InÐ à Ðorder€for€an€abuse€of€discretion€to€occur,€the€reviewing€court€must€find€that€theÏrecord€contains€no€substantial€evidence€sufficient€to€support€the€conclusion€of€theÏtrial€judge€that€the€violation€of€the€terms€of€probation€has€occurred.€€òòHarkinsóó,€811Ð ðthe€original€judgment€so€rendered€by€theÏtrial€judge€shall€be€in€full€force€and€effect€from€the€date€of€the€revocation€of€suchÏsuspension.ðð€€Tenn.€Code€Ann.€ðð€40„35„310€(1997).€€The€trial€judge€retains€theÏdiscretionary€authority€to€order€the€defendant€to€serve€the€original€sentence.€€òòSeeóóÐ P  ÐòòState€v.€Dukeóó,€902€S.W.2d€424,€427€(Tenn.€Crim.€App.€1995).Ð 0€ ÐÌà ¸ àIn€this€instance,€the€defendant€contends€that€the€record€lacksÏsubstantial€evidence€to€support€the€trial€courtððs€revocation.€€Our€review€of€theÏrecord,€however,€indicates€that€it€contains€competent€evidence€to€support€the€trialÏcourtððs€finding€that€the€defendantððs€ð ðnewðð€arrest€and€conviction€violated€theÏconditions€of€probation.€€The€state€placed€into€the€record€without€any€objection€fromÏthe€defendant€printouts€from€the€sessions€court€docket€showing€that€the€defendantÏhad€been€convicted€of€two€misdemeanor€offenses€on€October€31,€1995.€€TheÏdefendant€admitted€that€he€pleaded€guilty€to€those€offenses€although€he€wasÏobviously€uncertain€of€the€date€the€judgments€were€entered.€€In€his€brief,€theÏdefendant€concedes€that€the€sessions€court€docket€accurately€reports€his€arrest€andÏconviction€for€theft€and€illegal€possession€of€a€dangerous€weapon€in€October,€1995.€ÏThe€thrust€of€the€defendantððs€argument€is€that€the€trial€court€mistakenly€believed€thatÏalthough€the€defendant€was€arrested€in€1995€for€those€offenses,€he€had€not€pleadedÏguilty€until€July€10,€1997.€€Given€the€confusing€nature€of€€the€testimony€at€theÏhearing,€the€trial€court€may€have€thought€that€the€convictions€were€entered€in€JulyÐ 09€48 Ðof€1997.€€The€date€the€judgments€were€entered,€however,€is€ñ¤ ñœñ¤ ñirrelevant.€€Proof€ofÏconvictions€for€the€1995€offenses€is€a€basis€for€the€revocation€of€probation.ñ¤ ñ›ñ¤ ñÌÌà ¸ àEven€though€we€have€not€been€asked€to€do€so€by€the€defendant,€weÏhave€reviewed€ñ¤ ñœñ¤ ñtheñ¤ ñ›ñ¤ ñ€issue€of€lack€of€notice€of€the€ground€for€probation€revocation.€ÏThe€defendant€was€entitled€to€be€informed€of€the€conditions€or€requirements€of€hisÏprobation.€€The€record€contains€no€indication€of€what€the€full€regimen€of€conditionsÏwere;€however,€ð ðcompliance€with€œouñ¥ ñrñ¥ ññ¦ ñtñ¦ ñ›€state€laws€œiñ§ ñsñ§ ññ¨ ñnñ¨ ñ›€an€automatic€conditionðð€ofÏprobation.€€òòState€v.€Subblefieldóó,€953€S.W.2d€223,€225€(Tenn.€Crim.€App.€1997).€€TheÐ ° Ðstate€need€not€have€proven€that€the€defendant€was€prohibited€from€offending€theÏcriminal€laws€as€a€condition€of€probation,€nor€need€it€have€shown€that€the€defendantÏwas€aware€of€any€such€condition.€€The€defendant€was€likewise€entitled€to€be€notifiedÏof€the€charge€upon€which€revocation€is€based.€€òòMorrisseyóó;€òòStamps€v.€Stateóó,€614Ð 0€ ÐS.W.2d€71,€73€(Tenn.€Crim.€App.€1980).€€However,€this€due€process€right€to€noticeÏð ðððcalls€for€such€procedural€protections€as€the€particular€situation€demands.ðððð€òòStampsóó,Ð ð@ Ð614€S.W.2d€at€73.€€The€very€nature€of€a€ð ðnoticeðð€right€suggests€that€it€may€beÏwaived.€€In€the€present€case,€the€defendant€did€not€object€to€the€admission€ofÏevidence€about€the€two€new€misdemeanor€convictions,€did€not€argue€in€the€trialÏcourt€that€the€new€convictions€were€beyond€the€scope€of€the€probation€violationÏreport€and/or€revocation€warrant,€and€did€not€claim€in€this€appeal€that€he€had€beenÏdeprived€of€notice€that€new€convictions€would€serve€as€bases€for€revocation.€€In€this€Ïsituation,€we€have€no€choice€but€to€conclude€that€the€notice€ñ¤ ñœñ¤ ñissueñ¤ ñ›ñ¤ ñ€was€ñ¤ ñœñ¤ ñwaived.€ÏTenn.€R.€App.€P.€36(a).ñ¤ ñ›ñ¤ ñ€€€ÌÌà ¸ àThe€defendant€also€ñ¤ ñœñ¤ ñarguesñ¤ ñ›ñ¤
