FACTS        SteveStoverreturnedhomefromworkintheearlymorninghoursof  December17,1996,andfoundthedoortohishomeunlocked.Apoliceinvestigationrevealedthatasidedoorhadbeenpriedopen.Aquicksearchofthehouserevealedthatseveralpiecesofmusicalequipmentweremissingaswellasalockboxandsomejewelry.Thevalueofthestolenpropertywasstipulatedtobeoveronethousanddollars. TheinvestigationquicklyfocusedonJamesGammon,apersonwhopreviouslyhadrentedaroomintheStoverresidence.GammonpaidweeklyrenttoStoveruntilhewasaskedtoleavebecausethey"weren'tgettingalong."StovertestifiedthatGammonmovedoutthreeweeksbeforetheburglaryandthatGammonnolongerhadpermissiontoenterhishouse. InvestigatorTonyCollinsoftheShelbyvillePoliceDepartmentsubsequentlylocatedthedefendantandGammonatthedefendant'strailer.AlsoatthetrailerwasDennisDewitt,aformerboyfriendofthedefendant.   #  1      ׀Collinsadvisedthe 2x). defendant,GammonandDewittthattherehadbeenaburglaryandaskedthemto 4D+0 Їcometothestationforaninterview.Thethreecomplied,andthedefendantgaveanincriminatingwrittenstatementtothepoliceafterreceivingMirandawarnings. ,  Inherstatement,thedefendantadmittedtakingjewelryfromadresserintheresidence. Thedefendanttestifiedinherowndefense.ShestatedthatshedidnotseeGammongainentrytothevictim'shouse.ShetestifiedthatshethoughtGammonwasretrievingpropertyhehadleftatthehousewhenheresidedthere.ShefurthertestifiedthatshethoughtthejewelrybelongedtoGammon'sexfianc. Thedefendantstatedshelearnedthatthepropertytakenfromthevictim'sresidencehadbeenstolenwhenhercousinheardabouttheburglaryonapolicescanner.ShethentoldDewitttodisposeofthestolenitemsintheirpossession.Oncrossexamination,thedefendanttestifiedthatsheliedinherstatementtopoliceandonlywrotewhatshewastoldtowrite. Thejuryconvictedthedefendantofaggravatedburglaryandtheftofpropertyoveronethousanddollars. Apersonisguiltyoftheoffenseofaggravatedburglaryifheorsheentersahabitationwithouttheeffectiveconsentoftheownerwiththeintenttocommitatheft.T.C.A.3914402,403.Apersonisguiltyoftheftifthatperson#XXXX#,withtheintentto  deprivetheownerofproperty,knowinglyobtainsorexercisescontroloverthepropertywithouttheownerseffectiveconsent.T.C.A.3914103. Thisisaclassiccaseforjurydetermination.ThedefendantgaveastatementtothepoliceinwhichsheadmittedenteringtheStoverhouseandtakingjewelry.ShesaidthatwhileGammonandDewittwereloadingthemusicalequipment,shewentintoabedroomandtooksomeringsandtwowatches.Shefurtheradmitted,"Dennis[Dewitt]andJoey[Gammon]weregoingtosellthestuff[thatnight]." Theevidencesatisfiedtheelementsoftheoffenses.Afterthejuryheardthedefendantrecantherstatementandproclaiminnocence,thejurychosenottobelieveher.Thiswasexclusivelywithintheprovinceofthejury.  @7-2 Ї  JUDGMENTOFACQUITTAL `      Atthecloseofproofandfollowinghersentencinghearing,thedefendant 8  movedforajudgmentofacquittal.Thedefendantcontendsthatthetrialcourtabuseditsdiscretionindenyingthesemotions.Astheevidenceinthedefendant'scasehasbeenfoundsufficient,thisissueiswithoutmerit.
