àThe€defendant,€Allen€Lee€Campbell,€entered€a€best€interest€plea€ofÏguilt€to€especially€aggravated€burglary€without€any€recommendation€by€the€state€asÏto€the€manner€and€length€of€his€sentence.€€The€trial€court€imposed€a€Range€IÏsentence€of€eleven€years.€€The€single€issue€raised€on€appeal€is€whether€theÏsentence€imposed€was€excessive.ÌÌà àà àWe€find€the€sentence€warranted€by€the€circumstances€and€affirm€theÏjudgment.ÌÌà àà àThis€court€must€first€address€a€procedural€issue.€€The€state€claims€thatÏthe€notice€of€appeal€was€not€timely€filed.€€òòSeeóó€Tenn.€R.€App.€P.€4.€€It€appears,Ïhowever,€that€the€judgment€was€entered€on€March€16,€1995.€€The€notice,€whichÏmust€be€within€thirty€days€thereafter,€was€filed€on€April€10,€1995,€well€within€theÏrequired€time.€€We€must,€therefore,€address€the€merits€of€the€defendant's€claim.€€ÌÌà àà àThe€statement€of€the€victim€to€the€probation€officer€was€relied€upon€asÏfact:€€ÌÓÓà8 àà8 àVictim,€Larry€Landreth,€...€stated€that€[he€and]€his€wife€...Ïcame€home€and€caught€the€defendant€burglarizing€theirÍhome€and€property.€€When€Mr.€Landreth€attempted€toÏstop€the€defendant,€the€defendant€fought€with€Mr.ÏLandreth€cutting€Mr.€Landrethððs€left€wrist€and€right€handÏwith€a€knife.€€Mr.€Landreth€stated€that€stitches€wereÏrequired€for€the€cut€on€his€wrist,€and€he€still€suffers€fromÏsome€numbness€on€the€top€of€his€right€hand.€€Mr.ÏLandreth€stated€that€he€is€not€asking€for€restitution.ÌÌà8 àà8 àWhen€asked€about€sentencing,€Mr.€Landreth€stated€thatÏthe€defendant€should€not€receive€probation€due€to€theÏseriousness€of€the€offense,€the€use€of€a€weapon,€theÏdefendantððs€prior€record,€and€his€continued€criminalÏactivity.€€Mr.€Landreth€stated€he€would€like€to€see€theÏdefendant€receive€the€maximum€sentence€as€he€feelsÏsomething€needs€to€be€done€to€stop€these€crimes.ÌÌÓÓThe€defendant€claimed€that€he€ð ðwas€intoxicated€the€night€of€the€œoffen[s]e,›€[he]€didnððtÏknow€where€[he]€was€[and€he€didnððt]€know€why€[he]€did€what€[he]€did.ððÌÌà àà àDefense€counsel€argued€in€the€trial€court€that€the€defendantððs€criminalÏrecord€was€due€to€his€long€history€of€alcohol€abuse.€€Counsel€pointed€out€that€theÏdefendant,€despite€several€prior€brushes€with€the€criminal€justice€system,€had€neverÏreceived€any€form€of€treatment€for€alcoholism.€€He€requested€intensive€probation€asÏan€alternative€to€incarceration.€€Although€the€trial€court€found€the€defendant€to€beÏsincerely€remorseful€for€this€crime,€it€denied€probation€and€enhanced€the€length€ofÏthe€sentence€above€the€minimum.€€ÌÌà à...€[I]n€this€case,€your€level€of€intoxication€and€yourÏlevel€of€your€ability€to€control€yourself€has€resulted€inÏsomeone€getting€œhurt,›€and€you€had€little€hesitation€to€doÏwhat€you€did.€€And€the€risk€to€killing€someone€was€greatÏas€well.ÌÌà8 àà8 àà àI€am€impressed€that€you€want€help.€€But€I€think€thatÏin€this€circumstance€we€have€a€problem€with€at€this€pointÏproviding€you€help€in€this€case€...€in€terms€of€getting€youÏdrug€treatment€...€when€there€were€many€ways€that€youÏcould€have€gotten€it,€or€tried€to€get€it€over€the€course€ofÏthese€years.ÌÌà8 àà8 àà à...€[As]€a€habitual€motor€offender,€even€if€a€car€wasÏnot€in€operation,€you€are€a€lucky€man€to€be€charged€withÏpublic€intoxication,€because€having€the€key€to€the€carÏwas€a€felony€offense,€that€you€could€have€been€chargedÏwith.ÌÌà8 àà8 àà àI€œam›œ€not€impressed›€with€the€fact€that€if€I€were€toÏprovide€you€probation€...€we€would€have€to€guaranteeÍthat€you€did€not€drink.€€And€I€cannot€do€that€without€youÏand€your€family€...,€[and]€they€couldn't€control€yourÏdrinking€while€you€were€pending€these€œcharges....Ì›œÌ›œà@ à›œ*€*€*›Ìœ›à8 àà8 àà àI€think€that€we€have€got€to€the€point€where€it€is€tooÏdangerous€to€place€you€into€the€community.ÌÌà8 àà8 àà àI€think,€however,€that€you€are€absolutely€sincere.€€IÏwill€attempt€to€get€the€penitentiary€system€to€see€to€it€thatÏyou€get€into€GED€classes,€and€you€can€go€into€AA....ÌÌà8 àà8 àà à...[Y]ou€have€never€taken€any€responsibility€to€[getÏtreatment]€for€yourself....ÌÌà@ à*€*€*ÌÌà8 àà8 àà àWhat€if€you€fall€off€the€wagon€and€I€have€givenÏyou€intensive€probation,€and€someone€gets€killed?€€IÏhave€to€look€at€it€that€way,€too.ÌÌÌÓÓà àà àThe€trial€court€relied€upon€three€statutory€enhancement€factors€inÏdetermining€the€length€of€sentence:ÌÓÓà8 àà8 à(1)€the€defendant€had€a€previous€history€of€criminalÏconvictions€or€criminal€behavior€in€addition€to€thoseÏnecessary€to€establish€the€appropriate€range,€Tenn.ÏCode€Ann.€ðð€40„35„114(1);ÌÌà8 àà8 à(2)€the€defendant€has€a€previous€history€of€unwillingnessÏto€comply€with€the€conditions€of€a€sentence€involvingÏrelease€in€the€community,€Tenn.€Code€Ann.€ðð€40„35„114(8);€and€ÌÌà8 àà8 à(3)€the€defendant€had€no€hesitation€about€committing€aÍcrime€when€the€risk€to€human€life€was€high,€Tenn.€CodeÏAnn.€ðð€40„35„114(10).ÌÌÓÓThe€defendant€concedes€that€the€first€two€factors€apply.€€He€does,€however,€argueÏthat€his€crime€presented€no€œincreased€risk›€to€human€life€and€claims€that€the€trialÏcourt€did€not€properly€consider€his€alcohol€abuse€in€mitigation.€€The€defendant€alsoÏargues€that€the€trial€court€is€not€entitled€to€a€presumption€of€correctness€because€itÏfailed€to€properly€consider€the€principles€of€the€sentencing€act€in€weighing€theÏrelevant€factors.€€Ìà àÌà àà àHere,€the€trial€court€stated€its€reasons€and€findings€on€the€record.€€TheÏweight€to€be€attributed€to€each€factor€is€determined€based€on€the€relevant€facts€andÏcircumstances€of€each€case.€€òòState€v.€Mossóó,€727€S.W.2d€229,€238€(Tenn.€1986).€ÏThe€presumption€applies.€€Moreover,€the€defendant€concedes€that€€òòState€v.€Jonesóó,Ï883€S.W.2d€597€(Tenn.€1994),€would€allow€the€application€of€Tenn.€Code€Ann.€ððÏ40„35„114€(10)€to€an€especially€aggravated€burglary€involving€serious€bodily€injury.€€ÌÌà àà àIn€òòJonesóó,€however,€our€supreme€court€ruled€that€"[t]he€determinativeÏlanguage€of€this€factor€is€'the€risk€to€human€life€was€high.'"€€883€S.W.2d€at€602.€ÏWhile€our€high€court€found€that€the€factor€did€not€apply€because€there€wasÏinsufficient€evidence€that€Jones's€crime€"caused€or€increased€risk€either€to€humanÍlife€in€general€or€to€the€victim€in€particular,"€here,€however,€the€defendant€wasÏintoxicated€and€was€armed€with€œa›€knife.€€œòòSeeóó€òòid.óó€at€603.€€When›€confronted€by€theÏoccupants€during€the€course€of€the€burglary,€the€defendant€fought,€cutting€the€leftÏhand€and€right€wrist€of€the€victim.€€Under€these€circumstances,€there€wasÏconsiderable€risk.€€ÌÌà àà àThe€trial€court€properly€determined€that€the€defendant's€voluntary€useÏof€alcohol€was€not€a€proper€consideration€for€mitigation.€€The€defendant's€criminalÏhistory€was€rather€extensive;€that€factor€was,€in€our€view,€entitled€to€substantialÏweight.€€€So€was€his€unwillingness€to€comply€with€conditions€of€a€prior€sentenceÏinvolving€release€in€the€community.€€Even€œif€the›€third€factor€was€entitled€to€noÏweight€at€œall,€the›€eleven„year€sentence,€under€all€of€the€circumstances,€wasÏappropriate.ÌÌà
