àThe€defendant,€Hoyt€Edward€Carroll,€was€indicted€on€one€(1)€count€of€theÏmanufacture€of€more€than€one„half€(ðð)€ounce€but€less€than€ten€(10)€pounds€ofÏmarijuana,€one€(1)€count€of€possession€of€drug€paraphernalia,€and€one€(1)Ïcount€of€€evading€arrest.€€A€Hawkins€County€jury€convicted€him€of€theÏmanufacture€of€marijuana€and€possession€of€drug€paraphernalia.€€The€trial€courtÏsentenced€him€to€two€(2)€years€in€the€Tennessee€Department€of€Correction€forÏthe€manufacture€of€marijuana,€and€eleven€(11)€months€and€€29€days€in€theÏcounty€jail€for€the€possession€of€drug€paraphernalia.€€The€sentences€wereÏordered€to€run€concurrently.€€On€appeal,€he€contends€that€the€evidence€wasÏinsufficient€to€sustain€his€convictions,€his€sentences€are€excessive,€and€the€trialÏcourt€erred€in€denying€alternative€sentencing.€€We€€AFFIRM€€his€convictions,€but€ÏMODIFY€€his€misdemeanor€sentence.ÌÌà@ àò òòòFACTSó óóóÌÌà àThe€stateððs€proof€at€trial€showed€that€the€Hawkins€County€SheriffððsÏDepartment€had€information€that€some€marijuana€was€growing€in€a€field€nearÏWar€Creek€Road€in€Hawkins€County.€€On€July€26,€1995,€four€officers€with€theÏsheriffððs€department€began€a€surveillance€operation€in€that€area.€€The€officersÏsearched€the€area€and€found€approximately€sixty€(60)€marijuana€plants€growingÏin€the€field.€€Almost€every€plant€had€a€green€string€attached€so€that€the€plant€wasÍtied€down.€€At€the€base€of€each€plant€was€at€least€one€green€bottle€containing€aÏliquid€substance€which€smelled€like€ammonia.Ìà àThe€officers€then€set€up€their€video€equipment.€€œEventually›€two€men,€laterÏdetermined€to€be€the€defendant€and€co„defendant,€Rick€Coy€Smith,€approachedÏthe€plants.Ìà àOfficer€Gerald€Gibson€testified€that€he€saw€the€men€observing€a€plant€andÏð ðpicking€around€on€it€.€.€€and€one€of€them,€at€one€point,€even€took€the€bottle€.€.€.€Ïthat€was€sitting€there€and€dashed€something€around,€like€he€was€pouringÏsomething€around€in€the€roots.ðð€€One€of€the€men€pulled€leaves€off€of€the€plantÏand€put€them€in€a€white€bag.Ìà àAfter€several€minutes€passed,€the€officers€came€out€from€hiding€andÏidentified€themselves.€€Defendant€submitted€to€the€officersðð€requests,€but€hisÏcompanion€tried€to€run€away€from€the€officers.€€One€of€the€officers€was€able€toÏstop€Smith€before€he€left€in€his€truck.Ìà àSubsequently,€the€men€were€arrested€and€searched.€€Defendant€hadÏseveral€green€strings€in€his€front€pocket,€and€a€marijuana€leaf€was€foundÏbetween€his€shoe€and€sock.€€The€white€bag€containing€marijuana€leaves€wasÏfound€after€Smith€dropped€it€in€his€attempt€to€evade€arrest.€€The€officers€alsoÏsearched€Smithððs€truck€and€found€three€bottles€containing€ammonia.Ìà àDetective€Joel€Hunt€testified€that€when€he€arrived€at€the€scene,€heÏrequested€that€the€officers€pull€the€plants.€€The€leaves€were€stripped€from€theÏplants€and€those€leaves,€along€with€those€in€the€white€bag,€were€tested€andÏfound€to€be€marijuana.€€He€further€testified€that€ammonia€is€a€fertilizer.Ìà àDefendant€testified€on€his€own€behalf.€€He€stated€that€he€had€been€in€theÏarea€picking€blackberries€when€he€noticed€some€plants€with€green€strings€onÏthem.€€He€took€some€strings€off€of€one€of€the€plants€and€put€the€strings€in€hisÏtruck.€€He€testified€that€he€told€Smith€that€he€had€found€some€marijuana€andÏshowed€him€the€strings.€€Smith€wanted€to€get€some€marijuana€for€his€own€use,Ïso€defendant€agreed€to€show€him€where€the€plants€were.Ìà àDefendant€and€Smith€proceeded€to€the€area€where€he€found€the€plants.€ÏSmith€began€collecting€the€marijuana.€€Defendant€claimed€that€he€was€merelyÏlooking€at€the€plants€when€the€officers€identified€themselves.Ìà àThe€jury€convicted€œdefendant›€of€the€manufacture€of€marijuana€andÏpossession€of€drug€paraphernalia.× ƒ) ×× àMoreover,€a€guilty€verdict€removes€the€presumption€of€innocence€whichÏthe€defendant€enjoyed€at€trial€and€raises€a€presumption€of€guilt€on€appeal.€ÏòòState€v.€Graceóó,€493€S.W.2d€474,€476€(Tenn.€1973).€€The€defendant€has€theÏburden€of€overcoming€this€presumption€of€guilt.€€òòIdóó.Ìà àIn€the€present€case,€defendant€and€Smith€were€found€in€a€remote€areaÏexamining€a€marijuana€plant.€They€immediately€began€tending€to€the€plant€byÏpouring€fertilizer€on€it€and€tying€the€plant.€€Defendant€was€carrying€green€stringsÏlike€those€that€were€used€to€tie€the€plants€down.Ìà ðprobation€and€community€corrections€andÏalternative€sentencing€should€be€denied.€.€.ðð€€Yet,€the€judgment€itself€shows€aÏtwo€(2)€year€sentence€to€the€Tennessee€Department€of€Correction€with€theÏfollowing€notation:€€ð ðSplit€confinement€365€days€in€jail.ðð€€There€is€no€indication€ofÏthe€length€of€probation€after€serving€the€365€days.Ìà àWhen€there€is€a€conflict€between€the€court€minutes€or€judgment€and€theÏtranscript,€the€transcript€controls.€€òòState€v.€Mooreóó,€814€S.W.2d€381,€383€(Tenn.ÏCrim.€App.€1991);€òòState€v.€Davisóó,€706€S.W.2d€96,€97€(Tenn.€Crim.€App.€1985).€ÏTherefore,€we€assume€the€imposed€sentence€to€be€two€(2)€years€in€theÏDepartment€of€Correction.€€We€also€believe€this€to€be€the€sentence€intended€byÏthe€trial€court.€€The€judgment€shall€be€modified€to€delete€the€reference€to€ð
