OurCourthasreachedinconsistentconclusionsconcerningthisissue.ArnoldCarterv.State,C.C.A.No.03C019509CC00270,MonroeCounty(Tenn.ϜCrim.App.filedJuly11,1996,atKnoxville)heldthatthenewlegislationprovidedaoneyearwindowinwhichanypetitionercouldseekpostconvictionreliefevenifthatpetitionhadpreviouslybeenbarredbythestatuteoflimitations. JohnnyL.Butlerv.State,C.C.A.No.02C019509CR00289,ShelbyCounty(Tenn.Crim.App.filedDecember2,1996,atJackson)heldthatthenewlegislationdoesnotprovidepetitionerspreviouslybarredbythethreeyearstatuteoflimitationsanewoneyearperiodwithinwhichtofileapetition.Thepanelheldthatthenewlegislation,atmost,providedthosebarredwithanopportunitytoreopenapriorpetitionwithinoneyearofthenewlegislationseffectivedate.T.C.A.4030217(Supp.1996). WeconcludethatButlerproperlyinterpretedthestatutes.ThelegislativeintentofthenewPostConvictionProcedureActwastolimitthenumberofpostconvictionpetitionsapetitionercouldfileandtolimitthetimewithinwhichtofilethem.Thestatuteoflimitationswasreducedfromthree(3)yearstoone(1)year.Obviously,thelegislaturedidnotintendtoopenthefloodgateandallowpetitionersbarredbythestatuteoflimitationsyearsbeforetohaveanewopportunitytofileorrefilesuchapetition.̜ Furthermore,thelanguageofthenewlegislationprovidingthat ...anypersonhavinggroundforreliefrecognizedunderthisactshallhaveatleastone(1)yearfromtheeffectivedateofthisacttofileapetition...doesnotrekindlepreviouslytimebarredpetitions.Agroundforrelieftimebarredpriortotheeffectivedateofthenewlegislationisclearlynot agroundforreliefrecognizedunderthisact.
