Petitionerallegedthathisattorneywasineffectiveby:1)forcingthedefendanttotestifyonhisownbehalf;2)notobjectingwhenoneofthepoliceofficerstestifiedthattheAppellanthadbeenpreviouslyconvictedofafelonyandhadservedtimeinthestatepenitentiary;3)failingtomoveforjudgmentofacquittalattheendoftheStatescaseinchief;4)failingtoascertainthroughdiscoverywhentheAppellantfirstbecameasuspect;5)failingtoquestiontheexpertontheeffectsofritalinanddemerolonthemindwhentakenincombination;6)failedtoobjectoradequatelycrossexaminetheStateswitnesswhenthetestimonysuggestedtheAppellanthadforgedthevictimsnameonacartitle,and,byinference,thattheAppellantmurderedthevictiminordertofacilitatethetheftofthevehicle. Weaffirmthedecisionofthetrialcourt. Inapostconvictionreliefproceeding,theburdenisuponthepetitionertoprovetheallegationsinhispetitionbyapreponderanceoftheevidence.Statev.Kerley,820S.W.2d753,755(Tenn.Crim.App.1991);Brattonv.Kerley,477S.W.2d754(Tenn.Crim.App.1971).Onreviewofthepostconvictionproceedings,thetrialcourtsfindingsoffactareconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Cooperv.State,849S.W.2d744,746(Tenn.1993).
