àThe€defendant€was€indicted€on€September€14,€1994,€for€the€first„degreeÏmurder€of€Christopher€Robinson.€€She€pled€guilty€to€voluntary€manslaughter,€a€ClassÏC€felony,€€on€October€9,€1995.€€After€a€sentencing€hearing,€the€trial€court€sentencedÏher€as€a€Range€I€standard€offender€to€four€years€in€the€Tennessee€Department€ofÏCorrection.€€In€this€appeal€as€of€right,€the€defendant€asserts€that€the€trial€court€erredÏby€not€sentencing€her€to€the€minimum€sentence€and€by€not€granting€her€probation€orÏalternative€sentencing.€€After€a€review€of€the€record,€we€find€no€error€and€affirm€theÏjudgment€of€the€court€below.ÌÌà àà àThe€defendant€and€the€victim,€Christopher€Robinson,€had€dated€eachÏother€for€a€period€of€one€to€two€years.€€Robinson€was€the€father€of€the€defendantððsÏsecond€child.€€At€the€sentencing€hearing,€the€defendant€testified€that€her€relationshipÏwith€the€victim€was€a€violent€one€and€that€on€different€occasions€the€victim€hadÏslapped€her,€had€thrown€her€against€things,€œhad€choked›€her,€and€œhad€pretended›€toÏsuffocate€her.€€She€further€testified€that€the€victimððs€abuse€of€alcohol€contributed€toÍtheir€problems.ÌÌà àà àOn€the€evening€of€May€9,€1994,€the€victim€and€the€defendant€attended€aÏbarbeque€at€a€relativeððs€home.€€The€defendant€testified€that€the€victim€had€beenÏdrinking€beer€and€that€he€had€threatened€her€with€a€baseball€bat€earlier€in€the€day.€ÏThe€defendant€left€the€barbeque€and€returned€to€the€house€she€shared€with€herÏmother.€€In€the€early€morning€hours€œof›€May€10,€the€victim€also€returned€to€the€home.€ÏThe€defendant€testified€that€she€had€been€upset€about€the€lateness€of€the€hour€andÏthat€she€asked€the€victim€to€leave.€€She€testified€that€the€victim€had€then€startedÏpushing€her€and€slapping€her.€€The€victim€then€rushed€toward€her€and€attempted€toÏchoke€her.€€She€then€pulled€a€pocket€knife€from€her€pants€pocket€and€stabbed€theÏvictim.€€When€she€realized€that€the€victim€was€bleeding,€the€defendant€yelled€for€herÏmother€and€asked€her€to€call€911.€€As€they€waited€for€paramedics€to€arrive,€theÏdefendant€and€her€mother€applied€pressure€to€the€victimððs€two€stab€wounds.€€TheÏvictim€died€shortly€after€arriving€at€the€hospital.ÌÌà àà àThe€defendant€now€complains€that€she€should€have€received€theÏminimum€sentence€and€that€she€should€have€received€probation€or€alternativeÍsentencing.€€When€a€defendant€complains€of€his€or€her€sentence,€we€must€conduct€aÏòòdeóó€òònovoóó€review€with€a€presumption€of€correctness.€€T.C.A.€ðð€40„35„401(d).€€TheÏburden€of€showing€that€the€sentence€is€improper€is€upon€the€appealing€party.€€T.C.A.Ïðð€40„35„401(d)€Sentencing€Commission€Comments.€€This€presumption,€however,€ð ðisÏconditioned€upon€the€affirmative€showing€in€the€record€that€the€trial€court€consideredÏthe€sentencing€principles€and€all€relevant€facts€and€circumstances.ðð€€òòState€v.€Ashbyóó,Ï823€S.W.2d€166,€169€(Tenn.€1991).ÌÌà àA€portion€of€the€Sentencing€Reform€Act€of€1989,€codified€at€T.C.A.€œÌðð›€40„35„210,€established€a€number€of€specific€procedures€to€be€followed€inÏsentencing.€€This€section€mandates€the€courtððs€consideration€of€the€following:ÌÓÓÌÒ ô ÒÒ ¦ ÒÒ ô ÒÒ  ÒÓ ` ¸ ŒX¸)Ó(1)€The€evidence,€if€any,€received€at€the€trial€and€theÏsentencing€hearing;€(2)€[t]he€presentence€report;€(3)€[t]heÏprinciples€of€sentencing€and€arguments€as€to€sentencingÏalternatives;€(4)€[t]he€nature€and€characteris‚tics€of€theÏcriminal€conduct€involved;€(5)€[e]vidence€and€informationÏoffered€by€the€parties€on€the€enhancement€and€mitigatingÏfactors€in€ðððð€40„35„113€and€40„35„114;€and€(6)€[a]nyÏstatement€the€defendant€wishes€to€make€in€his€own€behalfÏabout€sen‚tencing.ÌÌÌÒ àIn€addition,€this€section€provides€that€the€minimum€sentence€within€theÏrange€is€the€presumptive€sentence.€€If€there€are€enhanc‚ing€and€mitigating€factors,€theÏcourt€must€start€at€the€minimum€sentence€in€the€range€and€enhance€the€sentence€asÏappropriate€for€the€enhancement€factors€and€then€reduce€the€sen‚tence€within€theÏrange€as€appropriate€for€the€mitigating€factors.€€If€there€are€no€mitigating€factors,€theÏcourt€may€set€the€sentence€above€the€minimum€in€that€range€but€still€within€the€range.€ÏThe€weight€to€be€given€each€factor€is€left€to€the€discretion€of€the€trial€judge.€€òòState€v.ÏSheltonóó,€854€S.W.2d€116,€123€(Tenn.€Crim.€App.€1992).ÌÌà àà àThe€Act€further€provides€that€ð ð[w]henever€the€court€imposes€a€sentence,Ïit€òòshall€place€on€the€recordóó€either€orally€or€in€writing,€what€enhance‚ment€or€mitigatingÏfactors€it€found,€if€any,€as€well€as€findings€of€fact€as€required€by€ðð€40„35„209.ðð€€T.C.A.€œÌðð›€40„35„210(f)€(emphasis€added).€€Because€of€the€importance€of€enhancing€andÏmitigating€factors€under€the€sentencing€guide‚lines,€even€the€absence€of€these€factorsÏmust€be€recorded€if€none€are€found.€€T.C.A.€ðð€40„35„210€comment.€€These€findings€byÏthe€trial€judge€must€be€recorded€in€order€to€allow€an€adequate€review€on€appeal.ÌÌà àà àThe€defendant€was€sentenced€to€four€years€in€prison.€€As€a€Range€IÏstandard€offender,€the€sentencing€range€for€Class€C€felonies€is€not€less€than€three€butÏno€more€than€six€years.€€T.C.A.€ðð€40„35„112(a)(3).€€The€defendant€claims€that€the€trialÏcourt€erred€by€not€sentencing€her€to€the€minimum€amount€of€time€within€the€range.€ÏThe€trial€court€found€two€enhancing€factors€applied€to€the€defendant,€thus€creating€aÏneed€to€depart€from€the€minimum€penalty.ÌÌà àà àThe€trial€court€specifically€found€that€the€defendant€had€a€history€ofÏprevious€convictions€beyond€that€necessary€to€establish€the€appropriate€range€andÏthat€the€defendant€used€a€deadly€weapon€during€the€commission€of€the€offense.€ÏT.C.A.€œÌðð›€40„35„114(1)€and€(9).€€The€application€of€these€enhancement€factors€is€obviouslyÏcorrect.€€The€defendant€has€been€previously€convicted€of€assault,€and€she€used€aÏknife€in€the€commission€of€the€offense€for€which€she€has€now€been€convicted.ÌÌà àà àAs€to€the€mitigating€factors,€the€trial€court€stated:ÌÒ  ÒÒ P ÒÒ ¸ ÒÒ P ÒÓÓÌÒ  ÒÒ P ÒÒ  ÒÒ ¢ ÒÒ ô ÒÒ ¢ ÒÒ ô ÒÒ  Òà àAnd€in€considering€the€mitigating€factors,€if€she€hadÏbeen€convicted€by€a€jury€of€second€degree€murder,€then€IÏmight€find€number€2€and€number€3,€but€on€voluntaryÏmanslaughter€where€sheððs€actually€pleading€to€a€lesserÏoffense,€Iððm€€not€sure€€that€her€€conduct€€could€€be€€excused.Ï.€.€.€Ìà à[A]nd€then€number€11,€that€although€guilty€of€theÏcrime,€committed€the€offense€under€such€unusualÏcircumstances,€again,€the€fact€she€pled€to€a€lower,€lesserÏoffense€I€donððt€really€believe€applies.€€Ìà àOf€course,€I€have€to,€on€mitigating€factors,€onlyÏconsider€voluntary€manslaughter.€€I€canððt€consider€the€factÏthat€she€was€charged€with€second€degree[sic]€murder.€€I€doÏfind,€though,€that€it€was€a€domestic€situation€in€the€senseÏthat€they€were€parents€of€the€same€child€and€that€they€hadÏsquabbled€and€fought€at€times.€€Of€course,€I€donððt€thinkÏthereððs€any€question€that€she€used€excessive€force€in€thisÏcase.€€I€believe€that€the€enhancing€factors€outweigh€theÏmitigating€factors,€and€the€proper€sentence€is€four€years€inÏthe€Department€of€Correction[€].ÌÌ€ÌÓÓÒ D ÒÒ  ÒÒ D ÒÒ ¦ Òà àà àThe€defendant€argues€that€the€trial€court€erred€when€it€considered€theÏdefendantððs€indicted€offense€rather€than€the€offense€for€which€she€was€convicted.× ƒ/ ××  ×€ÏWhile€the€trial€judge€does€mention€that€the€defendant€was€indicted€for€a€more€seriousÏoffense,€he€then€states€that€he€will€not€consider€that€fact.€€He€addressed€the€possibleÍmitigating€factors€offered€by€the€defendant€but€rejected€those€which€he€felt€had€beenÏconsidered€in€reaching€the€plea€agreement€for€voluntary€manslaughter.€€TheseÏfactors€from€T.C.A.€ðð€40„35„113€included:€€that€the€defendant€acted€under€strongÏprovocation(2);€that€substantial€grounds€existed€to€excuse€or€justify€the€defendantððsÏcriminal€conduct(3);€and€that€the€defendant,€although€guilty€of€the€crime,€acted€underÏsuch€unusual€circumstances€that€it€is€unlikely€a€sustained€intent€to€violate€the€lawÏmotivated€her€conduct(11).€€ÌÌà àà àThis€Court€has€used€the€term€ð ðdouble€mitigationðð€to€refer€to€situationsÏwhen€the€defendant€has€been€convicted€of€a€lesser€offense€œrather€than›€with€what€heÏor€she€was€indicted€and€when€œthis›€œfactor›€œis›€used€to€mitigate€the€length€of€aÏdefendantððs€sentence.€€While€such€ð ðdouble€mitigationðð€is€not€prohibited€by€T.C.A.€ððÏ40„35„113,€the€decision€of€whether€to€ð ðdouble€mitigateðð€is€an€act€of€discretion,Ïreviewable€under€the€same€standards€as€all€other€sentencing€issues.€€òòState€v.€RickyÏD.€Clantonóó,€No.€01C01„9302„CC„00072,€Bedford€County€(Tenn.€Crim.€App.€filed€Dec.Ï30,€1993,€at€Nashville);€òòState€v.€Cindy€Lynn€Smithóó,€No.€03C01„9206„CR„00219,ÏHamblen€County€(Tenn.€Crim.€App.€filed€March€25,€1993,€at€Knoxville).€€As€inÏòòClantonóó,€where€the€defendant€was€indicted€for€second„degree€murder€but€pled€guiltyÍto€voluntary€manslaughter,€we€find€that€the€trial€court€did€not€err€by€failing€to€ð ðdoubleÏmitigate.ðð€€We€further€find€that€no€other€mitigating€factors€apply€to€this€defendant.€ÏThus,€the€trial€court€did€not€err€when€it€sentenced€this€defendant€to€four€years,€oneÏyear€above€the€minimum€sentence.ÌÌà àà àThe€defendant€next€complains€that€she€should€have€been€grantedÏprobation€or€an€alternative€sentence.€€Tennessee€Code€Annotated€€ðð€40„35„103€setsÏout€sentencing€considerations€which€are€guidelines€for€determining€whether€or€not€aÏdefendant€should€be€incarcerated.€€These€include€the€need€ð ðto€protect€society€byÏrestraining€a€defendant€who€has€a€long€history€of€criminal€conduct,ðð€the€need€ð ðtoÏavoid€depreciating€the€seriousness€of€the€offense,ðð€the€determination€thatÏð ðconfinement€is€particularly€suited€to€provide€an€effective€deterrence€to€others€likelyÏto€commit€similar€offenses,ðð€or€the€determination€that€ð ðmeasures€less€restrictive€thanÏconfinement€have€frequently€or€recently€been€applied€unsuccessfully€to€theÏdefendant.ðð€€T.C.A.€œÌðð›€40„35„103(1).ÌÌà àà àIn€addition,€the€legislature€established€certain€sentencing€principlesÍwhich€include€the€following:ÌÓÓÒ D ÒÒ  ÒÒ ô ÒÒ  ÒÌ(5)€€In€recognition€that€state€prison€capacities€and€the€fundsÏto€build€and€maintain€them€are€limited,€convicted€felonsÏcommitting€the€most€severe€offenses,€possessing€criminalÏhistories€evincing€a€clear€disregard€for€the€laws€and€moralsÏof€society,€and€evincing€failure€of€past€efforts€atÏrehabilitation€shall€be€given€first€priority€regardingÏsentencing€involving€incarceration;€andÌÌ(6)€€A€defendant€who€does€not€fall€within€the€parameters€ofÏsubdivision€(5)€and€is€an€especially€mitigated€or€standardÏoffender€convicted€of€a€Class€C,€D€or€E€felony€is€presumedÏto€be€a€favorable€candidate€for€alternative€sentencingÏoptions€in€the€absence€of€evidence€to€the€contrary.ÌÌÌÒ  ÒÒ  ÒÒ  ÒÒ ¢ ÒÓÓT.C.A.€ðð€40„35„102.ÌÌà àà àAfter€reviewing€the€statutes€set€out€above,€it€is€obvious€that€the€intent€ofÏthe€legislature€is€to€encourage€alternatives€to€incarceration€in€cases€whereÏdefendants€are€sentenced€as€standard€or€mitigated€offenders€convicted€of€C,€D,€or€EÏfelonies.€€However,€it€is€also€clear€that€there€is€an€intent€to€incarcerate€thoseÏdefendants€whose€criminal€histories€indicate€a€clear€disregard€for€the€laws€andÏmorals€of€society€and€a€failure€of€past€efforts€to€rehabilitate.€€€€€€€€Ì€€€Ìà àà àThe€defendant€was€convicted€of€a€Class€C€felony,€therefore,€she€isÏpresumed€to€be€an€eligible€candidate€for€alternative€sentencing€in€the€absence€ofÏevidence€to€the€contrary.€€The€trial€judge€found€that€incarceration€was€necessary€forÏthis€defendant€in€order€to€avoid€depreciating€the€seriousness€of€the€offense.€€He€alsoÏcited€the€defendantððs€previous€conviction€for€assault€as€further€evidence€of€the€needÏfor€incarceration.€€The€defendant€was€convicted€of€assault€after€stabbing€her€brotherÏfour€times.€€For€the€assault€conviction,€she€was€given€a€suspended€sentence€ofÏeleven€months,€twenty„nine€days.€€Thus,€it€appears€to€this€Court€that€measures€lessÏrestrictive€than€confinement€have€been€used€unsuccessfully€with€this€defendant.€€ÌÌà ×€€While€we€sympathize€with€this€fact,€weÏdo€not€think€it€is€reason€enough€to€grant€probation€or€an€alternative€sentence.€€TheÏdefendant€has€a€poor€social€history€in€that€she€did€not€receive€her€high€schoolÏdiploma,€she€has€worked€off€and€on€for€only€a€few€months,€and€she€supports€herselfÍonly€with€money€received€from€AFDC.€€Additionally,€after€the€death€of€the€victim,€sheÏengaged€in€a€relationship€with€the€father€of€her€first€child€and€became€pregnant€for€aÏthird€time€despite€the€fact€that€the€father€has€never€supported€the€first€child.ÌÌà àà àFurthermore,€the€defendant€results€to€violence€as€a€way€to€settleÏarguments.€€She€stabbed€her€brother€four€times€and€evidently€learned€nothing€fromÏthe€incident€as€she€later€stabbed€and€killed€the€victim€in€this€case.€€We€think€the€trialÏjudge€did€not€abuse€his€discretion€in€denying€probation€or€alternative€sentencing€forÏthis€defendant.€€She€has€failed€to€carry€her€burden€of€showing€that€the€sentence€isÏimproper.ÌÌà
