Firstly,wenotethatpetitionerdoesnotmakeappropriatereferencestotherecordinsupportofhisargumentasrequiredbyTenn.R.App.P.27(a)(7).Theissuesare,therefore,waived.Rule10(b),TennesseeCourtofCriminalAppeals.Wewill,nevertheless,addresstheissues. Astopetitionersallegationsofineffectiveassistanceofcounsel,thetrialcourtfoundthattrialcounselconductedadequatediscovery,conductedanappropriateinvestigation,properlydiscussedthecasewithpetitionerandadequatelycrossexaminedthevictimregardingheridentificationofthedefendant.Thetrialcourtconcludedthatpetitionerindeedreceivedeffectiveassistanceofcounselathistrial.Therecordsupportsthisfinding. Petitioneralsoattackscounselsfailuretorequestaspecialjuryinstructiononeyewitnessidentification.Statev.Dyle,899S.W.2d607,61314(Tenn.1995),promulgatedanewjuryinstructiononeyewitnessidentification;however,petitionerscasewastriedandaffirmedonappealpriortothefilingoftheDyleopinion.Counselwasnotineffectiveforfailingtorequestaspecialjuryinstructiononeyewitnessidentification.
