àà àThe€indictment€by€the€grand€jury€provided€as€follows:€ÌÓÓà8 àà8 àTheft€of€property€occurs€when,€"with€intent€to€deprive€the€owner€ofÏproperty,€the€person€knowingly€obtains€or€exercises€control€over€the€propertyÏwithout€the€owner's€effective€consent."€€Tenn.€Code€Ann.€ðð€39„14„103.€€If€a€personÏtakes€another's€car€without€the€owner's€effective€consent€but€does€not€have€theÏintent€to€deprive€the€owner€of€the€car,€then€the€person€has€only€committed€theÏoffense€of€joyriding.€€Tenn.€Code€Ann.€ðð€39„14„107.€€Recently,€in€òòState€v.€œBrooksóó,›Ï909€S.W.2d€854,€859„60€(Tenn.€Crim.€App.€1995),€this€court€addressed€the€differentÏintent€requirements€for€theft€and€joyriding€and€whether€an€intent€to€òòpermanentlyóóÍdeprive€the€owner€of€property€is€required€under€the€theft€statute.€€In€making€thisÏdetermination,€the€court€relied€upon€the€statutory€definition€of€"deprive":ÌÓÓà8 àà8 àà à(A)€Withhold€property€from€the€owner€permanentlyÏòòoróó€for€such€a€period€of€time€as€to€substantially€diminishÏthe€value€or€enjoyment€of€the€property€to€the€owner;ÌÌà8 àà8 àà à(B)€Withhold€property€or€cause€it€to€be€withheld€forÏthe€purpose€of€restoring€it€only€upon€payment€of€aÏreward€or€other€compensation;€or€ÌÌà8 àà8 àà à(C)€Dispose€of€property€or€use€it€or€transfer€anyÏinterest€in€it€under€circumstances€that€make€itsÏrestoration€unlikely[.]ÌÌÓÓTenn.€Code€Ann.€ðð€39„11„106(a)(8)(emphasis€added).€€Under€this€statute,€theÏintent€to€permanently€deprive€an€owner€of€his€property€is€only€one€of€severalÏalternative€definitions€of€"deprive"€which€would€satisfy€the€statutory€definition€forÏtheft€of€property.€€If€permanent€deprivation€was€not€applicable€here,€the€defendantÏmay€have€qualified€under€one€or€more€of€the€other€alternatives.€€ÌÌò òòòà@ àNature€of€the€Chargeóóó óÌà àà à"Adequate€notice€of€the€nature€of€the€charges€is€a€constitutionalÏrequisite€in€any€criminal€prosecution."€€òòBryan€v.€Stateóó,€848€S.W.2d€72,€75€(Tenn.ÏCrim.€App.€1992);€òòseeóó€òòalsoóó€òòBlankenship€v.€Stateóó,€858€S.W.2d€897,€904€(Tenn.Ï1993);€Tenn.€R.€Crim.€P.€11.€€"[T]here€is[,€however,]€no€constitutional€requirementÍthat€a€trial€court,€in€litany€fashion,€explain€each€element€of€every€offense€to€whichÏan€accused€is€pleading€guilty."€€òòBryan€v.€Stateóó,€848€S.W.2d€at€75.€€Here,€theÏindictment€followed€the€statutory€definition€of€the€offense.€€The€mere€fact€that€termsÏwithin€that€definition€may€also€be€statutorily€defined€elsewhere€does€not€impose€aÏduty€on€the€trial€judge€at€all€guilty€plea€hearings€to€define€each€term€and€phrase€asÏhe€would€for€a€jury.€€In€our€view,€the€defendant€was€sufficiently€advised€that€he€wasÏpleading€guilty€to€the€offense€of€theft€of€an€automobile€over€$10,000.00.€€ÌÌò òòòà@ àVoluntariness€of€Pleaóóó óÌà àà àIn€òòBoykin€v.€Alabamaóó,€395€U.S.€238€(1969),€the€United€StatesÏSupreme€Court€ruled€that€defendants€should€be€advised€of€certain€of€theirÏconstitutional€rights€before€entering€pleas€of€guilt.€€Included€among€those€requiredÏwarnings€are€the€right€against€self„incrimination,€the€right€to€confront€witnesses,Ïand€the€right€to€a€trial€by€jury.€€òòIdóó.€at€243.€€The€overriding€òòBoykinóó€requirement,Ïhowever,€is€that€the€guilty€plea€must€be€knowingly€and€voluntarily€made.€€òòIdóó.€atÏ242„44.€€In€òòState€v.€Mackeyóó,€553€S.W.2d€337€(Tenn.1977),€our€supreme€courtÏestablished€a€procedure€for€trial€courts€to€follow€in€accepting€guilty€pleas.ÌÌà àà àThe€petitioner€asserts€that€he€did€not€understand€what€was€required€toÏcommit€the€offense€and€that€he€did€not€therefore€voluntarily€and€knowingly€enter€hisÍplea.€€We€cannot€agree.ÌÌà àà àThe€record€contains€an€affidavit€by€the€defendant€wherein€it€is€allegedÏthat€his€prior€counsel€never€advised€him€that€a€permanent€intent€to€deprive€isÏrequired€to€substantiate€the€offense.€€Another€affidavit€provides€that€his€priorÏcounsel€acknowledged€that€he€had€not€told€the€defendant€of€the€permanencyÏrequirement.€€The€record,€however,€establishes€that€the€defendant€acknowledgedÏat€the€guilty€plea€hearing€that€he€had,€in€fact,€been€fully€advised€by€his€counsel€ofÏthe€charges€made.€€While€the€defendant€made€statements€that€he€did€not€intend€toÏdamage€the€vehicle,€the€primary€concern€of€the€defendant€at€the€submissionÏhearing€was€in€being€treated€similarly€to€a€codefendant€for€whom€the€state€hadÏagreed€to€recommend€judicial€diversion.€€The€state€had,€however,€opposed€judicialÏdiversion€for€the€defendant.€€The€defendant€may€not€œnow›€seek€to€withdraw€his€pleaÏbecause€he€is€unhappy€with€the€sentence€ultimately€imposed.€€òòSeeóó€òòHenning€v.ÏStateóó,€184€Tenn.€508,€511„13,€201€S.W.2d€669,€670„71€(1947).€€There€is€noÏrequirement€for€equal€sentences€among€codefendants.€€Individual€factors€must€beÏtaken€into€consideration.€€None€of€these€assertions€would€necessarily€establish€thatÏthe€plea€was€not€knowingly€and€voluntarily€entered.ÌÌòòò òà@ àFactual€Basis€for€Plea€and€Reduction€to€Joyridingóóó óÌà àà àThe€defendant€also€claims€that€the€record€does€not€establish€a€factualÏbasis€for€the€plea.€€The€state,€however,€provided€the€œfollowing›€summary€at€theÏsubmission€hearing:ÌÓÓà8 àà8 àThese€individuals€stole€a,€I€believe€it€was€a€MercedesÏthat€belonged€to€a€Fred€Clemons€here€in€PutnamÏCounty.€€They€took€it,€they€took€it€out,€left€it,€rode€itÏaround€and€eventually€abandoned€it€down€at€Center€HillÏLake€or€down€below€the€dam,€and€just€ruined€the€carÏbasically,€Your€Honor,€so€that's€what€the€crime€is.ÌÌÓÓThe€defendant€now€attempts€to€argue€that€he€did€not€have€the€requisite€intent€toÏcommit€the€theft€and€therefore€was€guilty€of€joyriding€at€worst.€€While€we€agree€thatÏthe€defendant€may€have€advanced€this€theory€had€the€case€gone€to€trial,€this€doesÏnot€render€as€inadequate€the€factual€basis€for€his€plea.€€These€stipulated€facts€areÏsufficient€to€establish€the€elements€of€the€offense.€€That€the€defendant€"just€ruinedÏthe€car"€would,€for€example,€qualify€as€a€substantial€diminution€of€"the€value€orÏenjoyment€of€the€œproperty."›€€Tenn.€Code€Ann.€ðð€39„11„106(a)(8)(A).€€ÌÌà
