ThedefendantwasthenarrestedonJune10,1995,foranallegedassaultagainstPauletteWare.Becauseofthisarrestandthedefendantsfailuretocomplywithotherprobationrequirements,aprobationrevocationhearingwasheldonNovember1,1995.Afterthehearing,thetrialcourtrevokedthedefendantsprobationandorderedhimtoservehissentence.Thedefendantnowappealsandarguesthatthetrialcourterredinrevokinghisprobation.Afterareviewoftherecord,weaffirmthejudgmentofthecourtbelow.  Whenatrialjudgefindsthataprobationerhasviolatedtheconditionsofhisorherprobation,thetrialjudgehastheauthoritytorevokeprobation.SeeT.C.A.4035310.Indeterminingwhetherornottodoso,thetrialjudgeneednotfindbeyondareasonabledoubtthataviolationofthetermsofprobationhasoccurred.Theexistenceofaviolationneedonlybesupportedbyapreponderanceoftheevidence.T.C.A.4035311(d).̀  Inprobationrevocationhearingsthecredibilityofthewitnessesisforthedeterminationofthetrialjudge.Bledsoev.State,215Tenn.553,387S.W.2d811,814(1965);Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980).Onreview,thefindingsofthetrialjudgehavetheweightofajuryverdict.Delp,614S.W.2d398;Carverv.State,570S.W.2d872,875(Tenn.Crim.App.1978).Wewillnotdisturbthejudgmentofthetrialjudgeintheabsenceofanabuseofdiscretion.ForthisCourttofindanabuseofthetrialcourtsdiscretion,thedefendantmustdemonstrate thattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudgethataviolationoftheconditionsofprobationhasoccurred.Statev.Harkins,811S.W.2d79,82(Tenn.1991).  Inthiscase,thedefendantclaimsthathisprobationwaserroneouslyrevokedbecausetheprosecutionpresentednosubstantialevidenceofprobationviolations.Onthecontrary,theprosecutionpresentedmorethansufficientevidence.  Attherevocationhearing,SandraCaldwell,thedefendantsprobationofficer,testifiedthatwhensheinitiallymetwiththedefendantinMarchof1995,shespecificallywarnedhimtostayoutoftroublebecauseonearrestforaviolentcrimewouldresultinrevocationofhisprobation.Shefurthertestifiedthatthedefendantfailedtoreporttoher,asisrequired,afterApril1995.Then,inJune1995,thedefendantwasarrestedonassaultchargesandfailedtoreportthearresttoCaldwell.Caldwellalsotestifiedthatthedefendanthadnotperformedanyofhispublicservicework,hadnotpaidanyofhisprobationfees,andhadnotpaidanyofhisrestitution.However,CaldwelldidtestifythatwhilethedefendanthadbeenorderedtoperformfiftydayswithPublicWorks,hehadbeengiveneighteenmonthsinwhichtocompletethefiftydays.Atthetimeofthehearing,thedefendantstillhadasignificantamountoftimelefttoperformthemandatoryworkdays.CaldwellalsotestifiedthattheJune1995arrestreportshowedanaddressdifferentfromtheonethedefendanthadreportedtoher.  Thedefendantalsotestifiedatthehearing.HetestifiedthathehadbeeninjuredonhisjobatM&Mswhenoneofthelinesbrokelooseonthemachinehewasoperatingandheinhaledalargeamountoffumes.Hetestifiedthatbecauseoftheinjuryhewasunabletocontinuetoworkandthereforewasunabletopayanyofhisfees.Healsostatedthathehadnotpaidanyamountbecausehisprobationofficernevertoldhimhowmuchtopay.Thedefendantfurthertestifiedthatalthoughhewasinjuredtothepointthathecouldnotwork,hedidnotseekmedicalattention.Hetestifiedthatintheweekpriortothehearing,hehadstartedtoworkparttimeasthedispatcherforhisfamilyscabbusiness.HetestifiedthathethoughthecouldpaytheentirerestitutionamountbyFebruary1996.AstowhyhehadnotperformedanyofhisdayswithPublicWorkspriortohisinjury,thedefendanttestifiedthathehadbeenworkingsevendaysaweekandthathehadspokentosomeoneatPublicWorksabouthisinabilitytoscheduleatimetoperformhisrequiredservice.  Astotheassaultcharge,thedefendanttestifiedthathehadnoexplanationforhisfailuretoreportthearrest.HetestifiedthatthechargesweredroppedinAugust1995.Hefurthertestifiedthatthevictim,PauletteWare,hadbeeninstructedtopaythecourtcosts,butthathevolunteeredtopaythecostsinstead.   Thedefendantsbrothertestifiedthatthedefendanthadbeenworkingparttimeforthecabbusinessandthathecouldtakeasmallportionoutofthedefendantscheckeverymonthtopaytherestitutionandprobationfees.  PauletteWarethentestifiedastothecircumstancessurroundingthedefendantsarrestinJune1995.Shetestifiedthatsheandanothergirlhadbeen intoitandthedefendanthadtriedtoseparatethem.However,thewarrantforthedefendantsarrestrecitedanentirelydifferentstory.Inthewarrant,anofficerstatedthatWarehadsaidthedefendantstruckherwithhisfistontheleftsideofherfacecausingalargeknottoappearunderhereye.Shehadfurthertoldtheofficerthatthedefendantdraggedherintothehouseandcontinuedtobeatherwithhisfistsonceinsidethehouse.Atthehearing,Waretestifiedthattheofficermusthavefabricatedtheentirestory.  Afterhearingthisevidence,thetrialjudgestatedthathedidnotbelieveWarestestimonyandthathethoughtthedefendantwasadangertoothers.Findingthatthedefendanthad violatedgoodbehavior,thecourtrevokedhisprobation.  Wefindthatinthiscasetherewassubstantialevidencetosupportthetrialcourtsconclusionthatthedefendantviolatedthetermsofhisprobation.Hehadbeenarrestedonassaultcharges,hadfailedtoreportthearresttohisprobationofficer,andhadfailedtomeetwithhisprobationofficerasrequired. ,   כThefactthattheassaultchargewasultimatelydismisseddoesnotalterourconclusion.SeeStatev.Wall,909S.W.2d8(Tenn.Crim.App.1994)(affirmingrevocationwhereevidenceconsistedofadismissedassaultchargeagainstthedefendantandthedefendantsadmissionthathehadleftthestatetovisithischildren).
