TheappellantfiledanactionforpostconvictionreliefwiththeclerkofthetrialcourtonSeptember30,1994.Thetrialcourtdidnotappointcounseltorepresentthepetitioner.Inaddition,theStateofTennesseedidnotfilearesponsivepleadingtothepetition.Thetrialcourtsuaspontesummarilydismissedtheappellant'saction.Theorderenteredbythetrialcourtstates:    Thiscasecameonthis24thdayofOctober,1994,beforetheHonorableDickJerman,Jr.,JudgeoftheHumboldtLawCourtoftheTwentyEighthJudicialDistrictofGibsonCounty,Tennessee,atHumboldt,andcametheDistrictAttorneyGeneralwhoprosecutesfortheState,uponthePetitionforPostConvictionRelieffiled,anditappearstotheCourtthatthePetitionshouldbedismissedwithoutevidentiaryhearing.Itis,therefore,ORDEREDthatthePetitionforPostConvictionReliefisherebydismissed,withoutanevidentiaryhearing. Thisthe26thdayofDecember,1994,andenternuncprotuncforthe24thdayofOctober,1994.   X CopiesofthisorderwerenotforwardedtothepartiesuntilJanuary16,1995. TheStateofTennesseefiledaMotiontoDismissandAnsweronFebruary23,1995.Theappellanthadfiledhisnoticeofappealwiththeclerkofthetrialcourtonthe26thdayofJanuary,1995.Thus,itisquestionablewhethertheDistrictAttorneyGeneralprecipitatedorparticipatedinthesummarydismissaloftheactionasindicatedintheorderenteredbythetrialcourt. Itappearsthatthisisthefirstpostconvictionactionfiledbytheappellant.Furthermore,thepetitionappearstohavebeenfiledwithinthetimeconstraintssetforthinthePostConvictionProcedureAct.Oneofthegroundsallegedinthepetitionisacolorableconstitutionalclaimofineffectiveassistanceofcounsel.Therefore,thetrialcourtwasobligatedbylawtoappointcounseltorepresentthepetitioner,permitcounseltoamendthepetition,ifnecessary,andaffordthepetitioneranevidentiaryhearingonallofthegroundsthatarecognizableinapostconvictionaction.
