àDefendant€resided€in€a€room€at€the€Model€City€Motel€in€Kingsport.€€On€theÏevening€of€December€31,€1993,€he€had€a€New€Yearððs€Eve€party€and€becameÏheavily€intoxicated.€€At€approximately€10:00€p.m.€the€defendant€was€observedÏentering€and€driving€an€automobile€which€hit€another€automobile€in€the€parking€lot.€ÏRealizing€that€he€had€struck€the€car€of€fellow€occupants€in€the€motel,€he€went€toÏtheir€room€and€advised€them€that€he€had€hit€their€vehicle.€€The€police€wereÏsummoned,€much€to€the€chagrin€of€the€defendant.€€Ìà àDefendant€also€advised€other€persons,€including€a€police€officer,€that€heÏwas€responsible€for€the€accident.€€Since€defendantððs€girlfriend€had€already€drivenÏthe€car€away€by€the€time€the€police€arrived,€the€officer€questioned€the€defendantÏabout€his€girlfriend.€€The€defendant€stated€he€did€not€know€his€girlfriendððs€name.€€Ìà àBy€all€accounts,€defendant€was,€in€the€words€of€the€late€Chief€Justice€Joe€ÌÌHenry,€ð ðdrunk€„€openly,€visibly,€notoriously,€gloriously€and€uproariously€drunk.ððœ× ƒ, ××  ×›€ÏHe€failed€all€field€sobriety€tests,€and€his€blood€alcohol€level€was€tested€to€be€.18%.€ÏSince€the€inebriated€defendant€was€barefooted€and€shirtless€on€this€ð ðicy€coldðð€NewÏYearððs€Eve€night,€the€arresting€officer€allowed€him€to€put€on€some€clothes€prior€toÏbeing€taken€to€the€police€station.€€A€subsequent€search€of€the€defendant€yielded€aÏbag€of€marijuana€and€a€small€set€of€scales€in€the€defendantððs€coat€pocket.€€TheÏdefendant€had€been€seen€wearing€this€jacket€on€prior€occasions.Ìà@ àò òB.€€Defense€Proofó óÌà àDefendant€testified€in€his€defense.€€He€admitted€to€being€ð ðheavilyÏintoxicated.ðð€€As€was€the€custom€when€he€got€drunk,€he€and€his€girlfriend€got€into€aÏfight€since€ð ðshe€donððt€like€me€[drunk].ðð€€The€defendant€described€his€girlfriend€asÏð ðsix€oneðð€weighing€ð ðthree,€twenty„five,ðð€which€was€ð ða€bunchðð€more€than€defendantÏweighed.œ× ƒ. ××  ×›€€This€was€no€ordinary€fight€but€a€ð ðbad€one,€knock€down,€drag€outðð€inÏwhich€ð ð[s]he€liked€to€beat€me€to€death,€blackened€both€of€my€eyes.ðð€€According€toÏthe€defendant,€ð ð[my€girlfriend]€run€to€her€car€and€jumped€inðð€the€1973€Omni€lockingÏthe€doors.€€Overmatched€yet€undaunted,€the€fearless,€fiery,€forceful€defendant€gaveÏchase€to€his€fleeing€girlfriend,€much€to€the€amazement€and€amusement€of€hisÏfellow€party„goers€in€attendance€at€this€ð ðmajor€wild€party.ððœ× ƒ/ ××  ×›€€It€was€at€this€point,Ïaccording€to€the€defendantððs€testimony,€that€his€girlfriend€endeavored€to€driveÏaway€in€great€haste€and€backed€into€the€other€automobile.€€Defendant€deniedÏdriving€the€automobile.Ìà àThe€defendant€further€denied€telling€anyone€that€he€had€driven€theÏautomobile.€€He€admitted€telling€the€officer€that€he€did€not€know€his€girlfriendððsÏname.€€However,€he€testified€that€she€had€three€(3)€names,€and€he€did€not€knowÏwhich€was€her€true€name.€€While€they€were€dating,€she€used€a€different€name€thanÏwhen€they€were€livingÌtogether.œ× ƒ0 ××  ×›€€As€to€the€coat,€the€defendant€explained€that€the€party„goers€had€piledÏtheir€Ìcoats€in€the€room,€and€he€simply€grabbed€one€of€them.€€This€was€not€his€coat,€andÏhe€was€unaware€that€the€coat€contained€the€marijuana€and€scales.€€Ìà àThe€only€other€defense€witness€was€defendantððs€mother€who€testified€inÏsurrebuttal.€€She€testified€that€the€jacket€worn€by€defendant€upon€release€from€theÏjail€did€not€fit€him€and€was€not€the€same€jacket€she€had€purchased€for€him€earlier.€€Ìà@ àò òC.€€Jury€VerdictÌà àó óThe€jury€convicted€the€defendant€of€driving€under€the€influence€of€anÏintoxicant,€simple€possession€of€marijuana€and€possession€of€drug€paraphernalia.€ÏThe€trial€then€went€into€the€second€phase€in€which€the€state€introduced€proof€ofÏthree€prior€DUI€convictions.€€The€jury€then€found€defendant€guilty€of€DUI,€fourthÏoffense.€€Ìà@ àò òD.€€Sufficiency€of€the€Evidenceó óÌò òà àó àThis€case€clearly€turned€on€the€credibility€of€the€witnesses.€€The€juryÏaccredited€the€stateððs€proof€and€rejected€the€version€given€by€the€defendant.€€TheÏevidence€clearly€supported€the€juryððs€guilty€verdict€of€driving€under€the€influence€ofÏan€intoxicant,€simple€possession€of€marijuana€and€possession€of€drugÏparaphernalia.€€This€issue€is€without€merit.€€ÌÌà@ àò òòòTOXICOLOGY€REQUESTó óóóÌÌà àDuring€the€testimony€of€the€police€officer,€the€ð ðalcohol/toxicology€requestððÏform€was€marked€for€identification.€€The€officer€read€to€the€jury€from€this€form.€ÏUnder€type€of€offense,€the€officer€simply€stated€ð ðDUI.ðð€€In€fact,€the€form€read€ð ðDUIÏ6th.ððÌà àDuring€the€testimony€of€the€forensic€scientist€who€had€tested€defendantððsÏblood€sample,€the€state€requested€that€the€laboratory€report€be€passed€to€the€jury.€ÍInstead,€the€ð ðalcohol/toxicology€requestðð€was€inadvertently€passed€to€the€jury.€€ThisÏinadvertent€error€was€not€discovered€until€the€request€form€had€been€passed€toÏsome€of€the€jurors.€€à àCounsel€then€suggested€to€the€court€that€this€exhibit€had€beenÏmarked€for€identification€only€and€should€not€be€passed€to€the€jury.€€The€trial€judgeÏwas€of€the€opinion€it€was€a€ð ðfull€exhibit.ðð€€The€judge€further€determined€it€was€tooÏlate€to€do€anything€since€the€document€had€already€been€passed€to€the€jury.€€At€noÏtime€did€counsel€point€out€to€the€court€or€jury€that€the€document€contained€theÏwords€ð ðDUI€6th.ðð€€Furthermore,€there€was€no€mention€made€by€counsel,€the€court,Ïnor€any€witness€during€the€guilty€phase€of€the€trial€as€to€any€prior€convictions.Ìà àWe€first€note€that€this€issue€was€not€raised€in€the€motion€for€new€trial.€€OnlyÏthe€sufficiency€of€the€evidence€was€raised€in€the€motion.€€Accordingly,€this€issue€isÏwaived.€€Tenn.€R.€App.€P.€3(e);€òòState€v.€Seatonóó,€914€S.W.2d€129€(Tenn.€Crim.€App.Ï1995).Ìà àWe€further€conclude,€in€light€of€the€facts€and€circumstances,€that€thisÏinadvertent€error€was€harmless.€€Tenn.€R.€App.€P.€36(b).€€The€officerððs€reading€fromÏthe€form€simply€stated€that€the€type€offense€was€ð ðDUI.ðð€€There€was€no€mentionÏmade€during€the€guilt€phase€of€trial€of€any€prior€convictions.€€In€light€of€theÏevidence€against€the€defendant,€defendant€did€not€suffer€any€prejudice.€€This€issueÏis€without€merit.€€Ìà@ àò òòòÌà@ àCONSECUTIVE€SENTENCINGó óóóÌÌà àDefendant€was€sentenced€to€eleven€(11)€months€and€twenty„nine€(29)€daysÍon€each€of€the€three€offenses€with€two€(2)€of€the€sentences€running€concurrentlyÏand€one€(1)€running€consecutively.€€Defendant€contends€there€is€no€basis€forÏconsecutive€sentencing.€€Ìà àDefendant€had€numerous€convictions€not€only€prior€to€commission€of€theÏpresent€offense,€but€also€several€convictions€thereafter.€€He€had€alcohol€and€drugÏrelated€offenses€and€had€numerous€traffic€offenses,€including€driving€on€a€revokedÏlicense.€€He€was€on€probation€at€the€time€this€offense€was€committed.€€Pursuant€toÏTenn.€Code€Ann.€ðð€40„35„115(b)(2),€(4)€and€(6)€the€trial€court€in€imposingÏconsecutive€sentences€found€the€following:ÌÓÓà àà à(1)€the€defendant€had€an€extensive€record€of€criminalÌà àà àactivity;Ìà àÌà àà à(2)€the€defendant€was€a€dangerous€offender;€andÌà àÌà àà à(3)€the€defendant€committed€the€present€offense€whileÌà àà àon€probation.ÌÌÓÓà
