TheDistrictAttorneydeclinedtograntpretrialdiversiontoDefendantforthreereasons:(1)SincetheoffensecommittedbytheDefendantcausedthedeathtoanotherandwasaClassCfelony,thegrantingofpretrialdiversionwould deprecatethedeterrenteffectastothisDefendantandothersregardingthisseriousoffense;(2)theDefendanthadbeen chargedandconvictedofthreeotheroffensesoccurringatthesametimeasthevehicularhomicide,includingillegalpossessionofaradardetector,alterationofamedicalcertificate,and norecordofdutystatus,whichindicatedtheDefendantwaswillfullyandconsciouslyviolatingthelawatthetimeoftheoffense;and(3)theDefendanthadfive(5)speedingviolationsoccurringfromFebruary16,1993throughMay29,1995,four(4)ofwhichwereissuedtoDefendantwhilehewasoperatingacommercialvehicle,whichdemonstratedthattheDefendanthadpreviouslyoperatedamotorvehicleonpublicroadsinamannerwhichwasunsafetohimselfandothermotoristsanddidnothavetheabilityordesiretoconformhisbehaviortotheconfinesofthelaw. TheDefendantreliesuponStatev.Hammersley,650S.W.2d352(Tenn.1983),andStatev.Herron,767S.W.2d151(Tenn.1989),insupportofhisargumentthattheprosecutordidnotconsiderallrelevantfactorsinmakingthedecisiontodenypretrialdiversion.TheDefendantalsoarguesthattheprosecutorfailedtostatewhythefactorsherelieduponoutweighedtheremainingfactorssubmittedforhisconsideration.Baseduponourreviewoftheentirerecord,includingthewrittennoticeofdenialofpretrialdiversion,theprosecutorstestimonyatthehearingonthePetitionforWritofCertiorari,andtheprosecutorsstatementstothejudge,werespectfullydisagreewiththeDefendantsassertions. Wedoagreethatthefirstfactorrelieduponbytheprosecutor,thatpretrialdiversionshouldnotbegrantedinacaseofvehicularhomicidebaseduponconductcreatingasubstantialriskofdeathorseriousbodilyinjury,wasinappropriate.Inessence,theDistrictAttorneystatedthathefeltthisoffenseinvolvingthedeathofapersonshouldnotbeconsideredforpretrialdiversionbecauseitwoulddeprecatethedeterrenteffecttotheDefendantandotherswhomightbechargedwiththesameoffense.TheoffensethatDefendantischargedwithcommittingisanoffenseeligibleforconsiderationofpretrialdiversion.Tenn.CodeAnn.4015105(a)(1)(A).Therefore,thisreasonwasnotpropertodenypretrialdiversion.SeeStatev.Hammersley,650S.W.2d352,356(Tenn.1983).However,asobservedbyourcourtinStatev.Carr,861S.W.2d850,857(Tenn.Crim.App.1993), thefactthatoneofthereasonsgivenforthedenialwasinappropriate,doesnotforecloseadeterminationthatsubstantialevidencestillremainstosupporttheprosecutorsdecision. TherecordinthiscaseprovidessubstantialevidencetosupporttheremainingreasonsfortheprosecutortodenyDefendanttheavailabilityofpretrialdiversion.Wefindthatthetrialcourtproperlyconsideredtheentirerecordandarrivedatthecorrectconclusionthattheprosecutorhadnotabusedhisdiscretion.
