Weaffirmthejudgmentofthetrialcourt.  OnOctober1,1981,thepetitionerreceivedalifesentenceforrobberyaccomplishedbyuseofadeadlyweapon.Tenn.CodeAnn.393901(Supp.1980).Thiscourtaffirmedtheconvictionandsentenceondirectappeal.Statev.RobertF.AmbroseandJohnnyL.Colwell,No.821III(Tenn.Crim.App.,atNashville,August11,1982).Therewasnoapplicationforappealtooursupremecourt.    Thispetitionforpostconvictionrelief,allegingineffectiveassistanceofcounselattrialandondirectappeal,wasfiledFebruary22,1994.Clearly,thethreeyearstatuteoflimitationshadpassedbythattime.SeeTenn.CodeAnn.4030102.Allclaimsarisingpriorto1986hadtobefiledbyJuly3,1989.Statev.St.John,751S.W.2d453(Tenn.Crim.App.1988);seealsoEmmettRonnieHammondsv.State,No.967(Tenn.Crim.App.,atKnoxville,April5,1991).Thepetitioner,however,arguesthattheimpositionofathreeyearstatuteoflimitationsonpostconvictionproceedingsviolatesArt.I,17oftheTennesseeConstitution:8 8 OpencourtsRedressofinjuriesSuitsagainsttheState .Thatallcourtsshallbeopen;andeveryman,foraninjurydonehiminhislands,goods,personorreputation,shallhaveremedybyduecourseoflaw,andrightandjusticeadministeredwithoutsale,denialordelay.SuitsmaybebroughtagainsttheStateinsuchmannerandinsuchcourtsastheLegislaturemaybylawdirect.  InAbstonv.State,749S.W.2d487(Tenn.Crim.App.1988),thiscourtheldthattherewasnorighttoanuncontrolledperiodoftimewithinwhichtofilesuitunderthePostConvictionProcedureAct.SeeTenn.CodeAnn.4030101through124.InStuttsv.FordMotorCo.,574F.Supp.100,10204(M.D.Tenn.1983),itwasheldastatuteoflimitationastoproductsliabilityclaimsdidnotviolateArt.I,17ofourstateconstitution.  Morerecently,thiscourtruledthatapostconvictionpetitioner,barredfromsuitbyTenn.CodeAnn.4030102,hadnotbeendeprivedofhisstateconstitutionalrightto"opencourts."ThomasA.Hartleyv.State,No.03C019301CR00006(Tenn.Crim.App.,atKnoxville,September15,1993),perm.toappealdenied,(Tenn.1994).
