ŠĢÓ”*ÓĢą ` ąAfter€Marshall€Bateman€escorted€the€Defendant€and€M.J.€out€of€theŠ Šp Šcourtroom,€they€were€separated€while€Investigator€Turner€questioned€theŠ Ą` ŠDefendant€and€Investigator€Jackson€questioned€M.J.€€The€Defendant€was€notŠ °P Šunder€arrest,€and€he€voluntarily€talked€to€Turner.€€He€said€that€he€knew€M.J.Š   @ Šthrough€an€affiliation€with€a€church€in€Chattanooga,€where€he€was€Youth€Director,Š "0 Šand€that€he€was€in€Jackson€observing€a€court€hearing.€€He€stated€that€he€hadŠ €$  Špermission€from€M.J.ššs€mother€and€from€M.J.ššs€school€to€have€the€child€at€theŠ p& Šhearing€and€that€the€child€was€getting€some€type€of€credit€for€attending€a€judicialŠ `(  Šhearing.€€The€Defendant€and€M.J.€were€staying€together€in€a€motel€in€JacksonŠ P*š " Šduring€the€trial,€and€they€had€been€in€Jackson€for€two€nights.€€The€first€motel€didŠ @,ą"$ Šnot€work€out,€so€they€moved€to€a€different€one€the€second€night.€€Š 0.Š$& ŠĢą ` ąTurner€asked€the€Defendant€for€some€of€M.J.ššs€clothing€because€they€wereŠ 2°(* Šturning€M.J.€over€to€the€Department€of€Human€Services,€then€she€escorted€theŠ 4 *, ŠDefendant€to€his€vehicle€for€him€to€get€the€clothing€and€some€identification.€€TheŠ š5,. ŠDefendant€produced€his€driverššs€license,€which€was€in€the€front€of€a€FordŠ ą7€.0 ŠExplorer,€then€went€to€the€back€of€the€Explorer€to€get€the€clothing.€€He€startedŠ Š9p02 Špulling€clothing€out€of€several€different€bags€in€the€back.€€He€opened€up€one€bag,Š `  Šand€Turner€saw€the€butt€of€a€gun€in€the€bag.€€Before€Turner€could€respond,€theŠ P š ŠDefendant€said,€š šHey,€Iššve€got€a€gun€in€this€bag.šš€€Turner€asked€him€to€step€away,Š @ ą Šwhich€he€did,€then€she€retrieved€the€gun€from€the€bag.€€The€gun€was€aŠ 0Š Šsemiautomatic€pistol,€which€was€loaded.€€The€Defendant€admitted€the€gun€wasŠ  Ą Šhis€and€stated€that€he€did€not€have€a€permit€to€carry€it.€€Turner€then€asked€him€ifŠ °  Šhe€would€come€down€to€the€police€station€while€she€checked€to€make€sure€theŠ    Šgun€was€not€stolen,€and€he€agreed.€€Instead€of€going€to€the€police€station,€theŠ š  ŠDefendant€called€his€attorney€in€Chattanooga,€who€subsequently€called€TurnerŠ ą€ Šand€told€her€that€he€had€advised€his€client€not€to€go€to€the€station.€€Turner€put€outŠ Šp Ša€bulletin€for€the€Defendant,€and€he€was€located€and€arrested€for€the€unlawfulŠ Ą` Špossession€of€a€weapon.Š °P ŠĢą ` ąWhen€Investigator€Jackson€interviewed€M.J.€at€the€courthouse,€he€deniedŠ "0 Šthat€the€Defendant€had€done€anything€to€him€which€made€him€feel€uncomfortable.€Š €$  ŠWhen€she€interviewed€him€again€twelve€or€thirteen€hours€later,€he€again€deniedŠ p& Šthat€anything€inappropriate€had€occurred.€€At€trial,€however,€M.J.€testifiedŠ `(  Šdifferently.€€He€said€that€he€met€the€Defendant€at€church,€where€the€DefendantŠ P*š " Šwas€the€Youth€Director.€€At€first,€M.J.€participated€in€activities€at€church€with€otherŠ @,ą"$ Šchildren€and€the€Defendant,€then€he€started€doing€things€with€the€DefendantŠ 0.Š$& Šalone.€€They€once€watched€a€man€hang€gliding,€they€went€flying,€and€M.J.Š  0Ą&( Šsometimes€spent€the€night€at€the€Defendantššs€house.€€The€Defendant€bought€himŠ 2°(* Ša€knife€once€and€had€given€him€money.€€M.J.€testified€that€he€trusted€theŠ 4 *, ŠDefendant€š špretty€well,šš€but€his€trust€changed€because€of€things€the€DefendantŠ š5,. Šdid.€€Š ą7€.0 ŠŠ Š9p02 Šą ` ąWhen€they€arrived€in€Jackson,€the€Defendant€checked€into€a€motel€roomŠ `  Šwhich€had€only€one€bed.€€M.J.€was€going€to€sleep€in€the€chair,€but€the€DefendantŠ P š Škept€asking€him€to€come€over€to€the€bed.€€He€finally€got€into€the€bed€with€theŠ @ ą ŠDefendant,€then€the€Defendant€began€rubbing€his€penis€through€his€underwear.€Š 0Š ŠM.J.€ejaculated€a€little€bit€into€his€underwear,€which€the€Defendant€rinsed€out€inŠ  Ą Šthe€sink€the€next€morning.€€The€following€night,€M.J.€got€into€bed€with€theŠ °  ŠDefendant€because€he€knew€the€Defendant€would€not€let€him€sleep€in€the€chair.€Š    ŠThe€Defendant€then€began€masturbating€M.J.€and€himself€at€the€same€time.€€HeŠ š  Šmasturbated€M.J.€by€holding€M.J.ššs€penis€in€his€hand€and€moving€his€hand€up€andŠ ą€ Šdown.€€Š Šp ŠĢą ` ąDuring€the€criminal€trial€of€Smith,€the€Defendant€had€M.J.€sitting€very€closeŠ °P Što€him,€and€he€had€his€arm€around€M.J.€€M.J.€said€that€the€Defendant€keptŠ   @ Šleaning€over€and€š šmessing€withšš€his€ear€and€his€hair.€€Then,€they€were€taken€outŠ "0 Šof€the€courtroom€and€questioned€by€police€officers.€€M.J.€did€not€tell€the€policeŠ €$  Šofficer€what€happened€because€he€was€ashamed€and€because€he€thought€heŠ p& Šwas€going€to€have€to€ride€back€home€with€the€Defendant.Š `(  ŠĢą ` ąAt€trial,€M.J.€was€questioned€about€his€background.€€He€testified€that€whenŠ @,ą"$ Šhe€was€a€little€boy,€he€believed€he€had€dead€Presidents€speaking€to€him,€thoughŠ 0.Š$& Šit€was€just€his€imagination.€€As€a€result€of€some€of€his€problems,€he€was€sent€toŠ  0Ą&( Ša€psychiatric€hospital.€€He€was€in€a€program€called€Northwest€GeorgiaŠ 2°(* ŠEducational€Program€for€a€period€of€time,€and€was€taking€Imipramine.€€On€severalŠ 4 *, Šoccasions,€he€was€expelled€from€his€middle€school.€€His€biological€father€exposedŠ š5,. Šā āhim€to€pornography€and€physically€abused€him.€€He€had€sniffed€paint€andŠ ą7€.0 Šgasoline,€but€said€that€he€was€not€currently€taking€any€drugs€and€his€brain€wasŠ `  Šnot€impaired€in€any€way.€€Š P š Šā āĢą ` ąThe€Defendant€testified€in€his€own€behalf€and€denied€that€anythingŠ 0Š Šinappropriate€occurred€between€himself€and€M.J.€€He€gave€the€following€versionŠ  Ą Šof€the€events€leading€to€his€arrest.€€He€said€that€he€met€M.J.€through€a€churchŠ °  Šaffiliation€and€that€M.J.ššs€mother€had€requested€his€help€dealing€with€her€unrulyŠ    Šson.€€He€had€permission€from€M.J.ššs€mother€to€take€him€to€the€hearing€inŠ š  ŠJackson,€and€they€checked€into€the€EconoLodge€because€it€was€the€first€placeŠ ą€ Šhe€found€off€the€interstate€and€they€were€both€very€tired.€€It€was€a€little€afterŠ Šp Šmidnight€when€they€checked€into€the€motel.€€The€room€had€only€one€bed,€so€theŠ Ą` ŠDefendant€slept€in€the€bed€and€M.J.€slept€in€the€chair.€€The€next€morning€theyŠ °P Šawoke€and€went€to€the€trial.€€M.J.€was€š šfairly€unrulyšš€in€the€courtroom,€so€theŠ   @ ŠDefendant€had€to€make€efforts€to€have€M.J.€sit€still€and€be€attentive.Š "0 ŠĢą ` ąAfter€the€trial€the€first€day,€the€Defendant€went€to€another€motel€to€get€aŠ p& Šroom€with€two€beds.€€He€and€M.J.€went€out€to€dinner,€then€returned€to€the€motelŠ `(  Šroom€to€sleep.€€The€next€morning€they€got€up€and€went€back€to€the€trial.€€That€dayŠ P*š " Šwas€uneventful€until€Marshall€Bateman€came€and€escorted€the€Defendant€out€ofŠ @,ą"$ Šthe€room.€€The€Defendant€was€questioned€about€his€relationship€with€the€child,Š 0.Š$& Šso€he€explained€who€they€were€and€why€they€were€there.€€He€went€withŠ  0Ą&( ŠInvestigator€Turner€to€his€Ford€Explorer€to€get€his€identification€and€clothing€forŠ 2°(* Šthe€child.€€He€had€a€gun€that€he€used€for€target€practice€in€one€of€the€bags,€aboutŠ 4 *, Šwhich€he€had€forgotten.€€Once€he€noticed€it,€the€Defendant€backed€away€from€itŠ š5,. Šupon€the€victimššs€sanity,€or€where€there€is€a€record€of€prior€mental€disorders€orŠ ą7€.0 Šsexual€fantasies,€or€where€the€story€is€incredible,€and€even€in€these€situations,Š Š9p02 Šonly€if€there€is€little€or€no€corroboration€to€support€the€charge.šš€€ņņState€v.€Ballardóó,Š `  Š714€S.W.2d€284,€287€(Tenn.€Crim.€App.€1986);€ņņsee€alsoóó€ņņState€v.€Campbellóó,€904Š P š ŠS.W.2d€608,€612„13€(Tenn.€Crim.€App.€1995).Š @ ą ŠĢą ` ąThe€Defendant€asserts€that€compelling€reasons€existed€for€the€testingŠ  Ą Šbecause€there€was€evidence€of€prior€hallucinations€and€separations€from€realityŠ °  Šand€because€M.J.ššs€testimony€on€the€instances€of€sexual€battery€wasŠ    Šuncorroborated.€€The€Defendant€wanted€the€evaluation€to€use€in€casting€doubtŠ š  Šupon€M.J.ššs€credibility.€€He€presented€three€psychological€reports€to€the€trial€courtŠ ą€ Šin€order€to€convince€the€judge€to€order€another€one.€€One€report,€prepared€inŠ Šp ŠAugust,€1994€by€Dr.€William€Hillner,€a€clinical€psychologist€with€AffiliatedŠ Ą` ŠPsychological€Services,€Inc.€in€Chattanooga,€reported€that€M.J.€suffered€fromŠ °P Šauditory€hallucinations€in€that€voices€of€past€presidents€told€him€what€to€do€whenŠ   @ Šhe€was€in€trouble.€€It€€also€reported€that€M.J.€suffered€from€behavioral€problems,Š "0 Šthat€he€exhibited€signs€of€anxiety€and€depression,€and€that€he€had€sufferedŠ €$  Šemotional€and€physical€abuse€from€his€natural€father.€€Another€report,€preparedŠ p& Šby€the€Northwest€Georgia€Education€Program€in€September,€1993,€also€reportedŠ `(  Šauditory€hallucinations€involving€past€presidents,€depression,€and€problems€withŠ P*š " Šauthority€figures.€€The€final€evaluation,€prepared€in€February,€1992,€by€theŠ @,ą"$ ŠCalhoun€City€Schools€in€Calhoun€Georgia,€reported€that€M.J.€is€of€averageŠ 0.Š$& Šintelligence€with€academic€and€behavioral€difficulties.€€Š  0Ą&( ŠĢą ` ąWe€believe€that€these€reports€do€not€show€š šcompelling€reasonsšš€to€orderŠ 4 *, Šyet€another€evaluation.€€Granted,€M.J.ššs€testimony€as€to€the€instances€ofŠ š5,. Šaggravated€sexual€battery€is€not€corroborated,€but€M.J.ššs€story€is€not€incredible,Š ą7€.0 Šthere€was€no€evidence€of€prior€sexual€fantasies€or€mental€disorders,€other€thanŠ Š9p02 Šthe€auditory€hallucinations,€and€there€was€no€evidence€casting€substantial€doubtŠ `  Šas€to€M.J.ššs€sanity.€€Based€on€this€information,€we€cannot€say€that€the€trial€judgeŠ P š Šabused€his€discretion€in€denying€the€motion€for€psychological€testing.€€However,Š @ ą Ševen€if€the€denial€was€an€abuse€of€discretion,€the€Defendant€has€made€noŠ 0Š Šshowing€of€how€he€was€prejudiced€by€that€denial.€€He€had€the€opportunity,€andŠ  Ą Štook€advantage€of€it,€to€question€M.J.ššs€credibility€by€asking€him€about€theŠ °  Šhallucinations,€behavioral€problems,€physical€abuse,€and€prior€drug€abuse,€all€ofŠ    Šwhich€M.J.€admitted.€€This€was€precisely€the€type€of€information€the€DefendantŠ š  Šindicated€he€wanted€from€the€psychological€report,€and€it€was€properly€admittedŠ ą€ Šthrough€M.J.ššs€testimony.€€Therefore,€the€Defendant€has€made€no€showing€ofŠ Šp Šprejudice,€and€this€issue€is€without€merit.Š Ą` ŠĢĢą ` ąThe€Defendant€also€asserts€that€the€trial€judge€erred€by€refusing€to€compelŠ "0 Šthe€attendance€of€several€out„of„state€witnesses.€€The€Defendant€wanted€toŠ €$  Šsubpoena€witnesses€from€Georgia,€whom€he€argues€would€have€been€in€aŠ p& Šposition€to€corroborate€the€victimššs€behavioral€disorders.€€The€Defendant€has€not,Š `(  Šhowever,€shown€how€these€witnesses€would€be€material€witnesses,€which€isŠ P*š " Šrequired€before€a€witness€from€another€state€can€be€compelled€to€come€to€thisŠ @,ą"$ Šstate€to€testify.€€Tenn.€Code€Ann.€šš€40„17„201€to€„212;€ņņState€v.€Workmanóó,€667Š 0.Š$& ŠS.W.2d€44,€49€(Tenn.€1984).€€He€admits€that€the€witnesses€would€be€unable€toŠ  0Ą&( Štestify€about€the€occurrences€in€Jackson,€Tennessee,€but€argues€that€they€areŠ 2°(* Šmaterial€witnesses€because€they€are€familiar€with€M.J.ššs€behavior.€€Though€theyŠ 4 *, Šmay€be€familiar€with€M.J.ššs€behavior,€the€Defendant€did€not€offer€any€evidence€ofŠ š5,. ŠAnn.€šš€40„15„112(a)(2).€€Š ą7€.0 ŠŠ Š9p02 Šą ` ąSeveral€witnesses€testified€at€the€sentencing€hearing€as€to€the€DefendantššsŠ `  Šgood€reputation€in€the€communities€of€Chattanooga€and€Signal€Mountain,Š P š ŠTennessee.€€The€Reverend€of€the€First€Assembly€of€God€testified€that€theŠ @ ą ŠDefendant€was€a€good,€honest,€and€reliable€member€of€the€church€who€hasŠ 0Š Šhelped€many€people€in€the€church.€€The€Defendant€did€not€make€a€statement€atŠ  Ą Šthe€sentencing€hearing.€€Š °  ŠĢą ` ąThe€presentence€report€reflects€no€prior€felony€convictions,€but€does€reflectŠ š  Štwo€convictions€of€driving€under€the€influence:€€one€on€January€20,€1992€andŠ ą€ Šanother€on€December€6,€1995.€€The€Defendant€was€arrested€for€publicŠ Šp Šdrunkenness€and€driving€on€a€revoked€license€on€September€29,€1996.€€HeŠ Ą` Šreported€that€he€was€declared€delinquent€for€malicious€mischief€as€a€juvenileŠ °P Šwhen€he€was€fourteen€or€fifteen€years€old.€€He€has€charges€pending€against€himŠ   @ Šin€Georgia€for€alleged€offenses€that€occurred€with€the€same€victim€while€inŠ "0 ŠGeorgia,€but€no€specific€information€is€known€about€those€charges.€€TheŠ €$  ŠDefendant€graduated€from€college€in€1988€and€is€a€licensed€pilot.€€He€was€a€self„Š p& Šemployed€pilot€in€Chattanooga€from€1992€until€his€incarceration.€€He€reported€noŠ `(  Šalcohol€or€drug€problems,€but€did€report€numerous,€long„term,€physical€problems,Š P*š " Šspecifically€with€his€liver.€€He€is€32€years€old€(as€of€June€17,€1998),€single,€hasŠ @,ą"$ Šnever€married,€and€has€no€dependants.€€His€parents€live€in€Signal€Mountain,Š 0.Š$& ŠTennessee.€€He€has€two€sisters.€€One€is€a€psychologist€who€lives€in€Knoxville,Š  0Ą&( ŠTennessee,€and€the€other€is€a€hospital€clerk€who€lives€in€Dalton,€Georgia.€€€€€€Š 2°(* ŠĢą ` ąAt€the€sentencing€hearing,€the€State€argued€that€two€enhancement€factorsŠ š5,. Šapplied:€(1)€that€the€victim€was€particularly€vulnerable€because€of€age€or€physicalŠ ą7€.0 Šor€mental€disability;€and€(2)€that€the€Defendant€abused€a€position€of€public€trustŠ Š9p02 Šor€used€a€special€skill€in€a€manner€that€specifically€facilitated€the€commission€orŠ `  Šthe€fulfillment€of€the€offense.€€ņņSeeóó€Tenn.€Code€Ann.€šš€40„35„114(4),€(15).€€TheŠ P š ŠDefendant€denied€the€existence€of€any€enhancement€factors€and€argued€that€theŠ @ ą Štrial€court€should€consider€as€mitigating€factors€that€the€Defendantššs€conductŠ 0Š Šneither€caused€nor€threatened€serious€bodily€injury,€that€the€Defendant€did€notŠ  Ą Šhave€a€prior€felony€record,€that€the€Defendant€received€the€highestŠ °  Šcommendation€he€could€in€the€Junior€ROTC€program,€and€that€the€DefendantŠ    Šhad€a€good€reputation.€€Without€stating€any€facts€or€reasons€supporting€itsŠ š  Šdecision€or€mentioning€any€mitigating€factors,€the€trial€court€found€that€the€victimŠ ą€ Šwas€particularly€vulnerable€and€sentenced€the€Defendant€to€nine€yearsŠ Šp Šincarceration.Š Ą` ŠĢą ` ąBecause€the€trial€court€failed€to€state€any€findings€of€fact€or€reasoning€forŠ   @ Šits€sentence€determination€in€the€record,€we€will€review€the€sentence€ņņdeóó€ņņnovoóóŠ "0 Šwithout€any€presumption€of€correctness.€€ņņSeeóó€ņņPooleóó,€945€S.W.2d€at€96.€€TheŠ €$  ŠDefendant€contends€that€the€trial€court€erroneously€enhanced€his€sentence€basedŠ p& Šon€a€finding€that€the€victim€was€particularly€vulnerable.€€We€agree.€€TennesseeŠ `(  ŠCode€Annotated€šš€40„35„114(4)€provides€that€it€is€an€enhancement€factor€if€theŠ P*š " Šš švictim€of€the€offense€was€particularly€vulnerable€because€of€age€or€physical€orŠ @,ą"$ Šmental€disability.šš€€Though€this€factor€may€be€used€to€enhance€a€sentence€forŠ 0.Š$& Šaggravated€sexual€battery€when€the€victimššs€age€is€an€element€of€the€offense,€theŠ  0Ą&( ŠState€must€prove€that€š ša€victimššs€natural€physical€and€mental€limitations€rendersŠ 2°(* Š[sic]€the€victim€particularly€vulnerable€for€his€or€her€age€because€of€an€inability€toŠ 4 *, Šresist,€a€difficulty€in€calling€for€help,€or€a€difficulty€in€testifying€against€theŠ š5,. Šperpetrator.šš€€ņņState€v.€Kissingeróó,€922€S.W.2d€482,€487€(Tenn.€1996);€ņņsee€alsoóóŠ ą7€.0 ŠņņPooleóó,€945€S.W.2d€at€96„97;€ņņState€v.€Adamsóó,€864€S.W.2d€31,€35€(Tenn.€1993).€Š Š9p02 ŠWhile€there€was€evidence€that€the€victim€had€a€history€of€emotional€andŠ `  Šbehavioral€problems,€had€been€physically€abused€by€his€natural€father,€hadŠ P š Šauditory€hallucinations,€and€had€spent€time€in€a€psychiatric€hospital,€the€State€didŠ @ ą Šnot€show€how€these€things€made€the€victim€š šparticularly€vulnerablešš€to€theŠ 0Š ŠDefendant.€€Specifically,€there€was€no€showing€that€these€problems€resulted€inŠ  Ą Šan€inability€to€resist€the€Defendant,€difficulty€in€calling€for€help,€or€difficultyŠ °  Štestifying€against€the€Defendant.€€Thus,€we€find€that€the€trial€court€improperlyŠ    Šfound€the€victim€to€be€particularly€vulnerable.Š š  ŠĢą ` ąWhile€we€find€that€the€trial€court€improperly€found€the€existence€of€oneŠ Šp Šenhancement€factor,€we€are€authorized€in€conducting€our€ņņdeóó€ņņnovoóó€review€toŠ Ą` Šconsider€any€enhancement€or€mitigating€factors€supported€by€the€record.€€ņņAdamsóó,Š °P Š864€S.W.2d€at€34.€€Upon€review€of€the€record,€we€find€the€existence€of€statutoryŠ   @ Šfactor€(15):€š šThe€defendant€abused€a€position€of€public€or€private€trust,€or€usedŠ "0 Ša€special€skill€in€a€manner€that€significantly€facilitated€the€commission€or€theŠ €$  Šfulfillment€of€the€offense.šš€€Tenn.€Code€Ann.€šš€40„35„114(15).€€In€determiningŠ p& Šwhether€a€defendant€occupied€a€position€of€trust,€š šthe€court€should€look€to€seeŠ `(  Šwhether€the€offender€formally€or€informally€stood€in€a€relationship€to€the€victimŠ P*š " Šthat€promoted€confidence,€reliability,€or€faith.šš€€ņņKissingeróó,€922€S.W.2d€at€488.€€WeŠ @,ą"$ Šfind€that€the€Defendant€informally€stood€in€a€relationship€to€the€victim€thatŠ 0.Š$& Špromoted€confidence,€reliability,€and€faith.€€The€victim€met€the€Defendant€throughŠ  0Ą&( Šchurch,€where€the€Defendant€was€the€youth€director.€€The€victimššs€motherŠ 2°(* Šrequested€the€Defendantššs€help€with€her€son,€who€had€emotional€and€behavioralŠ 4 *, Šproblems.€€The€victim€did€things€with€the€Defendant€through€the€church€with€otherŠ š5,. Šchildren,€and€alone€with€just€the€Defendant.€€The€Defendant€acted€as€a€surrogateŠ ą7€.0 Šfather„figure,€taking€the€child€places,€buying€him€things,€and€being€nice€to€him.€Š Š9p02 ŠBy€committing€the€offense€of€aggravated€sexual€battery€on€the€victim,€theŠ `  ŠDefendant€violated€that€relationship€of€trust.€€Thus,€we€find€the€DefendantššsŠ P š Šsentence€could€be€enhanced€due€to€a€violation€of€private€trust.€€€€€Š @ ą ŠĢą ` ąWe€also€find€that€the€Defendant€has€a€previous€history€of€criminalŠ  Ą Šconvictions€or€criminal€behavior€in€addition€to€those€necessary€to€establish€theŠ °  Šappropriate€range.€€ņņSeeóó€Tenn.€Code€Ann.€šš€40„35„114(1).€€The€Defendantššs€twoŠ    ŠDUI€convictions€support€the€application€of€this€factor.Š š  ŠĢą ` ąRecognizing€that€the€Defendant€has€no€prior€felony€convictions€and€that€heŠ Šp Šhas€a€good€reputation€in€his€community€and€church,€we€find€that€those€factors€areŠ Ą` Šoutweighed€by€the€enhancing€factors€present.€€Accordingly,€we€affirm€the€nineŠ °P Šyear€sentence€imposed€by€the€trial€court.Š   @ ŠĢą ` ąThe€State€correctly€points€out€in€its€brief€that€the€judgment€incorrectlyŠ €$  Šidentifies€the€Defendant€as€a€100%€violent€offender.€€The€statute€mandating€thatŠ p& Špersons€convicted€of€aggravated€sexual€battery€serve€100%€of€their€sentence€isŠ `(  Šonly€applicable€to€offenses€committed€on€or€after€July€1,€1995.€€Tenn.€Code€Ann.Š P*š " Ššš€40„35„501(i).€€Since€this€offense€occurred€on€or€about€February€21,€1995,€theŠ @,ą"$ Šcase€must€be€remanded€for€correction€of€the€judgment€to€reflect€that€theŠ 0.Š$& ŠDefendant€is€a€range€I€standard€offender.Š  0Ą&( ŠĢą@  ®ąVII.€€LIMITATION€OF€CROSS„EXAMINATION€OF€ROGER€CURRYˆŠ 4 *, Šą ` ąOn€direct€examination,€Roger€Curry€testified€that€he€is€an€FBI€agent€whoŠ š5,. Šwas€present€in€the€federal€courtroom€on€February€22,€1995€and€that€MarshallŠ ą7€.0 ŠBateman€brought€the€activity€between€the€Defendant€and€M.J.€to€his€attention.€Š Š9p02 ŠDuring€cross„examination,€Agent€Curry€denied€that€Ed€Chandler,€the€defenseŠ `  Šattorney€for€Bob€Smith,€the€Defendantššs€former€employer€who€was€on€trial€thatŠ P š Šday,€originally€brought€the€matter€to€his€attention.€€But€Curry€admitted€that€he€filedŠ @ ą Ša€report€detailing€this€incident€and€that€the€report€stated,€š šDuring€the€trial,€BobŠ 0Š ŠSmith€in€Federal€Court,€Defense€Attorney,€Ed€Chandler,€had€pulled€me€asideŠ  Ą Šduring€a€trial€break€and€pointed€to€John€Cooke.šš€€He€also€acknowledged€that€hisŠ °  Šreport€revealed€that€Ed€Chandler€stated€the€Defendant€was€fired€for€pedophiliaŠ    Šand€now€had€a€lawsuit€pending€against€Mr.€Smith.€€The€Defendant€then€tried€toŠ š  Šintroduce€Agent€Curryššs€written€report€into€evidence€as€a€prior€inconsistentŠ ą€ Šstatement,€but€the€trial€court€did€not€allow€it.€€Now,€the€Defendant€asserts€that€itŠ Šp Šwas€error€not€to€allow€the€introduction€of€the€report.€€Š Ą` ŠĢą ` ąTennessee€Rule€of€Evidence€613(b)€provides,€š šExtrinsic€evidence€of€a€priorŠ   @ Šinconsistent€statement€by€a€witness€is€not€admissible€unless€the€witness€isŠ "0 Šafforded€an€opportunity€to€explain€or€deny€the€same€and€the€opposite€party€isŠ €$  Šafforded€an€opportunity€to€interrogate€the€witness€thereon,€or€the€interests€ofŠ p& Šjustice€otherwise€require.šš€€Our€supreme€court€has€further€held€that€š šextrinsicŠ `(  Ševidence€remains€inadmissible€until€the€witness€either€denies€or€equivocates€asŠ P*š " Što€having€made€the€prior€inconsistent€statement.šš€€ņņState€v.€Martinóó,€964€S.W.2dŠ @,ą"$ Š564,€567€(Tenn.€1998).€€If€a€witness€admits€making€the€prior€inconsistentŠ 0.Š$& Šstatement,€the€extrinsic€evidence€would€be€both€cumulative€and€consistent€withŠ  0Ą&( Ša€statement€made€by€the€witness€at€trial.€€ņņId.óó€€In€this€case,€Agent€Curry€admittedŠ 2°(* Šmaking€the€statement€in€his€report€that€Ed€Chandler,€Mr.€Smithššs€defenseŠ 4 *, Šattorney,€brought€the€matter€to€his€attention.€€Because€he€admitted€making€theŠ š5,.
