In1983,theDefendantwasconvictedoftwocountsofarmedrobberyandtwocountsofbeinganhabitualcriminal.Hewassentencedtotwoconsecutivelifesentences.Hisconvictionsandsentenceswereultimatelyaffirmedbyoursupremecourt. .    OnOctober24,1985,theDefendantfiledapostconvictionpetitionallegingmentalincompetenceatthetimeofthecommissionofthecrimesandineffectiveassistanceofcounselinpursuingtheissueregardinghismentalincompetence.Thetrialcourtdeniedpostconvictionreliefandthiscourtaffirmed. /    TheDefendantlaterfiledwhatappearstohavebeenhissecondpostconvictionpetitiononJune2,1989.Inthatpetition,theDefendantprimarilychallengedthevalidityoftheunderlyingconvictionswhichsupportedhishabitualcriminalsentences.Thetrialcourtdeniedpostconvictionreliefandthiscourtaffirmed. 0    TheDefendantfiledthepetitioninthecasesubjudiceonOctober9,1995.TheprimaryallegationsraisedintheinstantpetitionarethatthepriorpostconvictionpetitionswereerroneouslydismissedandthattheDefendantreceivedineffectiveassistanceofcounselduringthepriorpostconvictionproceedings.Wepointout,asnotedbythetrialjudge,thatTennesseecourtshavelongadheredtotherulethataclaimofineffectiveassistanceofcounselinapreviouspostconvictionproceedingisnotcognizableasabasisforreliefinasubsequentpostconvictionaction.Housev.State,911S.W.2d705,712(Tenn.1995),cert.denied,__U.S.__,116S.Ct.1685,134L.Ed.2d787(1996). IntheDefendantssecondpostconvictionpetition,heattemptedtoattackcollaterallyconvictionsenteredinanotherstate.Thiscourtupheldthetrialcourtsdenialofrelief.IntheDefendantsthirdpostconvictionpetition,heallegesthatatthehearingonhissecondpostconvictionpetition,thetrialcourtshouldhavetakenjudicialnoticeofhismentalincapacitybecausehiscounselathissecondpostconvictionproceedingwasineffectiveinbringingthistothetrialcourtsattention. TheDefendantsmentalcompetencyatthetimeofhissecondpostconvictionproceedingwasnotraisedinthetrialcourtatthattimeoronappealfromthedenialofpostconvictionrelief.Thisissueispresumedtobewaived.Tenn.CodeAnn.4030206(g). Waiveristobedeterminedbyanobjectivestandardunderwhichapetitionerisboundbytheactionorinactionofhisattorney.House,911S.W.2dat712.Thereisnorighttoeffectiveassistanceofcounselinpostconvictionproceedings,andtherefore,anallegationofineffectiveassistanceofpriorpostconvictioncounseldoesnotprecludeapplicationofthedefenseofwaiver.Id.at714. Asoursupremecourtstatedlongago, [t]heremustbeafinalitytoalllitigation,criminalaswellascivil.Arthurv.State,483S.W.2d95,97(Tenn.Ϝ1972).WedonotbelievethattheallegationscontainedinthispetitionaresufficienttorebutthepresumptionofwaiverortoentitletheDefendanttoanevidentiaryhearingconcerningwhetherthetrialjudgeshouldhavetakenjudicialnoticeoftheDefendantsallegedmentalconditionatthetimeofthehearingonhissecondpostconvictionpetition.
