Attrial,theappellantchallengedtheadmissibilityofthetestresultsunderStatev.Sensing,843S.W.2d412(Tenn.1992).InSensing,theCourtaddressedthenecessaryfoundationthatthestatemustestablishtoadmitbreathalyzertestresults.Id.at416.Oneoftherequirementsisthatthetestingofficermustbeabletotestifythatthemotoristwasobservedfortherequisitetwentyminutespriortothetest;andthatduringthisperiod,hedidnothaveforeignmatterinhismouth,didnotconsumeanyalcoholicbeverage,smoke,orregurgitate.Id.Theappellantclaimsthatthetrialcourtimproperlyadmittedthetestresultsintoevidencebecausehehadforeignmatterinhismouthpriortoandwhenthetestwasadministered.Theappellantassertsthathisdenturesareforeignmatter.Thetrialcourtheldthathewaivedtheissueofadmissibilitybecausehefailedtofileapretrialmotiontosuppresstheevidence.Thecourtdidnotabuseitsdiscretioninnotgrantingreliefofsuchwaiver. JudgeTiptonsmajorityopinionmakesadistinctionbetweenanissuerelatingtosufficientfoundationandthetypicalsuppressionmotioninvolvingevidence illegallyobtained.Iamnotpersuadedastothedistinction.Ibelieveweshoulddealinsubstance,notform.ThepurposesofRules12(b)(3)and12(f)aretoavoidunnecessarytrialinterruptionand,moreimportantly,toassurethatthestatemayappealanadverserulingwithoutdoublejeopardyconsequences.SeeStatev.Braden,874S.W.2d624,625(Tenn.Crim.App.1993);Statev.Randolph,692S.W.2d37,40(Tenn.Crim.App.1985).Allowingadefendanttopursueasuppressionissuelikethisoneatthemidpointofatrialwoulddestroythestatescasebygivingtheprosecutionnoappellateavenueiftherulingisadverse. Ibelievethatthetrialcourtproperlydeniedtheappellantschallengetotheadmissibilityofthetestresults.Amotiontosuppressevidencemustberaisedpriortotrial.Tenn.R.Crim.P.12(b)(3).Failuretodosoconstitutesawaiveroftheobjection.Tenn.R.Crim.P.12(f).Appellantscounselcouldhavemadeamotiontosuppressthetestresultsbasedonthestatesinabilitytolaytheproperfoundationpriortotrial.Therefore,Iconcurintheresultsaffirmingtheconvictionbutdissentonthesuppressionwaiverissue.̛                   _____________________________       PAULG.SUMMERS,Judge
