àDefendant€Lisa€Copeland€appeals€as€of€right€from€the€judgment€of€theÏtrial€court€ordering€her€to€serve€the€sentenced€imposed€in€this€caseÏœconsecutively€to›€a€previous€sentence€imposed€upon€her€in€Sevier€County,€andÏdenying€her€request€for€probation.€€The€decision€of€the€trial€court€is€affirmed.ÌÌà àThe€defendant€is€a€divorced€mother€of€three.€€She€began€using€cocaineÏin€€1992.€€Her€job€as€a€motel€housekeeper€did€not€provide€enough€income€toÏsupport€her€family€and€her€daily€cocaine€habit.€€She€lived€with€her€parents€butÏspent€time€with€a€male€co„defendant.ÌÌà àOn€December€15,€1994,€defendant€committed€the€offenses€of€aggravatedÏburglary€and€theft€over€$500€that€are€at€issue€in€this€case.€€On€December€16,Ï1994€the€defendant€was€arrested€in€Sevier€County€after€committing€a€secondÍaggravated€burglary€there.€€She€immediately€admitted€her€involvement€in€bothÏoffenses.ÌÌà àOn€March€27,€1995,€defendant€pled€guilty€in€Sevier€County€to€aggravatedÏburglary.€€She€was€given€credit€for€four€months€of€time€served€and€was€placedÏon€three€years€supervised€probation.ÌÌà àOn€July€25,€1995,€defendant€entered€pleas€of€guilty€in€this€case€toÏaggravated€burglary,€a€Class€C€felony,€and€theft€over€$500.00,€a€Class€E€felony.€ÏUnder€the€terms€of€the€plea€agreement,€defendant€apparently€agreed€to€a€three„year€sentence€for€the€aggravated€burglary€and€a€one„year€sentence€for€the€theft.€ÏThe€sentences€were€run€concurrent€to€one€another.€€All€other€issues€concerningÏplace€and€manner€of€service€of€her€sentence€were€to€be€addressed€at€a€laterÏsentencing€hearing.€€She€remained€free€on€bond.ÌÌÌà àOn€July€31,€1995,€defendant€reported€to€the€Blount€County€probationÏofficer€for€a€presentence€interview.€€She€tested€positive€for€marijuana€during€thatÏvisit.€€The€officer€also€noted€that€she€had€already€committed€a€prior€technicalÏviolation€of€her€Sevier€County€probation€by€admitting€use€of€marijuana€in€JuneÏ1995.ÌÌà àOn€November€5,€1995,€defendant€was€charged€with€misdemeanor€theft€inÍKnox€County.€€On€November€6€she€pled€guilty€and€was€placed€on€probation€forÏeleven€months€twenty„nine€days.€€On€December€5,€1995,€defendant€wasÏcharged€with€another€misdemeanor€theft€in€Knox€County.€€On€December€8€sheÏreceived€another€suspended€sentence€of€eleven€months,€twenty„nine€days.€ÏFollowing€these€convictions€a€probation€violation€warrant€was€issued€in€SevierÏCounty.ÌÌà àThe€sentencing€hearing€in€this€case€was€conducted€on€January€2,€1996.€ÏDefendant€testified€that€all€the€offenses€were€committed€to€support€her€cocaineÏaddiction.€€She€admitted€that€she€had€continued€to€use€cocaine€since€the€entryÏof€her€plea€in€July€1995.ÌÌà àAfter€hearing€all€the€proof,€the€trial€judge€denied€defendantððs€request€forÏprobation.€€She€was€ordered€to€serve€one€year€in€the€Blount€County€JailÏfollowed€by€two€years€in€the€Community€Corrections€Program.€€Her€sentencesÏwere€run€consecutively€to€the€previously„imposed€Sevier€County€sentence€forÏaggravated€burglary.ÌÌà àWhen€a€defendant€complains€of€her€sentence,€we€conduct€a€òòdeóó€òònovoóóÏreview€with€a€presumption€of€correctness€of€the€findings€of€the€trial€court.€€Tenn.ÏCode€Ann.€ðð40„35„401(d).€€This€presumption€is€conditioned€upon€an€affirmativeÏshowing€in€the€record€that€the€trial€court€considered€the€sentencing€principlesÏand€all€relevant€facts€and€circumstances.€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169Í(Tenn.€1991).€€However,€the€burden€of€showing€that€the€sentence€was€improperÏis€upon€the€appealing€party.€€Tenn.€Code€Ann.€ðð40„35„401(d)€SentencingÏCommission€Comments.ÌÑ  Ñà àIn€determining€an€appropriate€sentence,€the€court€must€consider€theÏfollowing:€(1)€any€evidence€from€the€trial€and€sentencing€hearing;€(2)€theÏpresentence€report;€(3)€the€principles€of€sentencing;€(4)€the€nature€andÏcharacteristics€of€the€offense;€(5)€information€concerning€the€enhancing€andÏmitigating€factors€as€found€in€Tenn.€Code€Ann.€ðððð40„35„113€and€114;€and€(6)Ïthe€defendantððs€statement€in€her€own€behalf€concerning€sentencing.€€Tenn.ÏCode€Ann.€ðð40„35„210(b).ÌÌà@ àThe€defendant€first€argues€that€it€was€error€for€the€trial€court€to€denyÏprobation.€€As€a€person€with€no€significant€criminal€history,€convicted€of€a€ClassÏC€felony€and€a€Class€A€misdemeanor,€the€defendant€was€ð ðpresumed€to€be€aÏfavorable€candidate€for€alternative€sentencingðð.€€Tenn.€Code€Ann.€ðð40„35„102(6).€€However,€this€presumption€may€be€overcome€by€ð ðevidence€to€theÏcontraryðð.€€òòId.óó€€ÌÌà àð ðEvidence€to€the€contraryðð€may€include€a€finding€that€one€or€more€of€theÏfollowing€sentencing€considerations€apply:Ìà8 àà à(A)à àConfinement€is€necessary€to€protect€society€byÍrestraining€a€defendant€who€has€a€long€history€of€criminal€conduct;Ìà8 àà à(B)à àConfinement€is€necessary€to€avoid€depreciating€theÏseriousness€of€the€offense€or€confinement€is€particularly€suited€toÏprovide€an€effective€deterrence€to€others€likely€to€commit€similarÏoffenses;€orÌà8 àMeasures€less€restrictive€than€confinement€haveÏfrequently€or€recently€been€applied€unsuccessfully€to€theÏdefendant.ÌTenn.€Code€Ann.€ðð40„35„103(1).€€Insofar€as€they€are€relevant€to€the€„103Ïconsiderations,€courts€may€also€apply€the€mitigating€or€enhancing€factors€setÏforth€in€Tenn.€Code€Ann.€ðððð40„35„113€and€114.€€òòSeeóó€Tenn.€Code€Ann.€ðð40„35„210(b)(5);€Ñ ° ÑòòState€v.€Lloyd€Mills€Matthews,€Jr.óó,€No.€03C01„9505„CR„00153€(Tenn.ÏCrim.€App.,€Knoxville,€May€1,€1996).€€Finally,€Tenn.€Code€Ann.€ðð40„35„103(5)Ïprovides€that€in€determining€whether€an€alternative€sentence€is€appropriate,Ïcourts€should€consider€the€defendantððs€potential€or€lack€of€potential€forÏrehabilitation.€€ÌÌà àIn€this€case,€the€trial€court€gave€the€following€reasons€for€denyingÏalternative€sentencing:€€(1)€the€defendant€has€a€history€of€other€convictions€andÏcriminal€activities;€and€(2)€the€defendant€has€frequently€and€recently€beenÏunsuccessful€in€completing€probation,€making€the€potential€for€rehabilitationÏpoor.€€These€reasons€are€supported€by€the€record.ÌÌà àDefendant€has€acknowledged€a€lengthy€history€of€illegal€drug€use.€€SheÏtestified€at€her€sentencing€hearing€that€during€the€one„year€period€before€theÏcommission€of€this€offense€she€spent€at€least€sixty€dollars€($60.00)€per€day€onÏcocaine€for€her€personal€use.€€In€her€presentence€report€interview€she€statedÏthat€for€a€year€and€a€half€she€ð ðshot€upðð€$300.00€to€$400.00€per€day€of€cocaine.€ÏShe€also€acknowledged€using€marijuana€ð ða€couple€of€times€a€weekðð€since€sheÏwas€seventeen.€€However,€she€refused€to€disclose€the€source€of€her€supply.ÌÌà àAdditionally,€while€this€case€was€pending€defendant€showed€no€greaterÏwillingness€to€follow€the€law.€€While€on€bond€for€the€instant€offenses,€and€onÏprobation€from€the€Sevier€County€aggravated€burglary,€the€defendantÏcommitted€two€additional€acts€of€theft,€for€which€she€has€now€pled€guilty.€€SheÏcontinued€to€use€drugs.€€Thus€measures€less€restrictive€than€incarceration€hadÏrecently€been€unsuccessful.€€Defendant€did€not€take€full€responsibility€for€herÏconduct,€blaming€her€boyfriends€for€causing€her€problems.€€And€although€sheÏindicated€to€the€court€that€she€desired€drug€treatment,€she€stated€in€herÏpresentence€interview€that€she€did€not€need€treatment.€€She€had€not€maintainedÏemployment€to€provide€for€her€children.ÌÌÌÑ Ü Ñà àDefendant€did€not€show€her€suitability€for€probation.€€The€trial€court€actedÏwithin€its€discretion€in€denying€probation.€€This€issue€is€without€merit.ÌÌà@ àII.Ìà àDefendant€next€contests€the€trial€courtððs€judgment€that€the€sentences€inÏthis€case€should€be€run€consecutively€to€the€sentence€in€the€Sevier€CountyÏcase.€€We€note€that€Rule€32(c)(2),€Tenn.€R.€Crim.€P.€gives€discretion€to€the€trialÏcourt€to€impose€consecutive€sentences€when€a€defendant€has€ð ðadditionalÏsentences€not€yet€fully€served.ðð€€This€court€has€previously€held€that€the€exerciseÏof€discretion€under€Rule€32(c)(2)€essentially€involves€the€consideration€of€theÏconsecutive€sentencing€criteria€provided€in€T.C.A.€ðð40„35„115(b).€€òòSeeóó€òòState€v.ÏThomas€Edward€Cappsóó,€No.€01C01„9506„CC„00164€(Tenn.€Crim.€App.,ÏNashville,€February€29,€1996).ÌÌà àThe€trial€court€found€that€the€defendant€qualified€for€consecutiveÏsentences€based€on€the€same€factors€he€considered€in€denying€probation:€theÏcommission€and€conviction€of€additional€offenses€while€on€probation€from€theÏSevier€County€case€and€bond€from€the€Blount€County€cases,€and€theÏdefendantððs€general€criminal€behavior€and€drug€use€since€she€entered€theÏguilty€pleas€in€Sevier€County€and€in€Blount€County.€€The€record€supports€thisÏdetermination.€€Whether€sentences€are€to€be€served€concurrently€orÏconsecutively€is€a€matter€addressed€to€the€sound€discretion€of€the€trial€court.€ÏòòState€v.€Jamesóó,€688€S.W.2d€463€(Tenn.€Crim.€App.€1984).€€Defendant€in€thisÏcase€admits€an€extensive€history€of€illegal€drug€use.€€Extensive€criminal€historyÍalone€will€support€consecutive€sentencing.€€òòSeeóó,€òòe.g.óó,€òòState€v.€Chrismanóó,€885ÏS.W.2d€834,€839€(Tenn.€Crim.€App.€1994).€€This€defendant€has€now€committedÏseveral€crimes€in€order€to€obtain€money€to€support€her€extensive€drug€habit.ÌÌÌÌÑ ° Ñà àFinally,€we€believe€that€this€history€warrants€the€conclusion€that€theÏconsecutive€sentences€are€necessary€to€protect€the€public€from€furtherÏmisconduct€by€the€defendant,€and€reasonably€reflect€the€severity€of€theÏoffenses.€€òòSeeóó€òòState€v.€Wilkersonóó,€905€S.W.2d€933,€938€(Tenn.€1995).€€BasedÏon€these€findings,€we€hold€that€the€trial€court€had€an€adequate€basis€forÏconcluding€that€consecutive€sentences€were€necessary.ÌÌà
