Inthisappeal,thedefendantcontendsthattheevidenceisinsufficienttosupporthisconvictions.Morespecifically,hecontendsthathestruckthevictimonlytoprotecthispropertyorremoveherfromhispremises;thatthebloodsampledrawntotesthisbloodalcoholcontentwasunreliablesincethedefendanthadconsumedalcoholafterhewasobserveddrivingandbeforebeingtakenintocustody;andthatoneofthethreeconvictionsreliedupontosupporthishabitualmotoroffenderstatusshouldbereversed.Ourreviewoftherecordrevealsthattheassaultonthevictimwasnottheresultofanefforttoremovethevictimfromthedefendantspremises,thattheproofofintoxication,exclusiveofthebloodtest,wasoverwhelminginsupportofthedefendantsintoxicatedconditionatthetimeheoperatedthemotorvehicle,thattheorderfindingthedefendanttobeahabitualmotoroffenderwasineffectatthetimeofhisoperationofthemotorvehicles,andthatneitherthepredicateoffensesnorthefindingofhabitualmotoroffenderstatushadbeensetasideatthetimeoftheseconvictions.
