Onappeal,appellantchallengesthesufficiencyoftheconvictingevidence.Afteracompletereviewoftherecord,wefindtheevidenceadequatetosustaintheconviction.Therefore,thejudgmentofthetrialcourtisaffirmed. OnNovember15,1995,JerryKelloughwasemployedbyavendingcompanywhichdistributedTomssnackfoodsintheMcNairyCountyarea.Attheendofhisworkday,hereturnedtothewarehouseonHighway22inMichie,wherethemerchandisewasstored.Uponarrival,henoticedthatareardoorofthewarehousehadbeenremoved.Thedoorappearedtohavebeenkickeddown;boththewoodframeandthedoorwereonthefloor.AsKelloughenteredthebuilding,henoticedtheinteriorindisarray.Softdrinkcans,candy,andotheritemswerestrewnonthefloor.Thecontentsofanofficedeskhadalsobeenthrownonthefloor.Inaddition,aPepsimachinehadbeenpriedopenanditscoinboxremoved.WhenKelloughhaddepartedthewarehousethatmorning,everythingwasinorder. Uponfurtherinspection,hediscoveredaman,whomheidentifiedasappellant,hidingbehindaboxofpotatochips.Kelloughimmediatelyreturnedtohistruck,retrievedaweaponandremovedappellantfromthebuilding.Lawenforcementofficialswerecontactedanddispatchedtothescene.Whenanofficerexaminedtheinteriorofthebuilding,hediscovereda.22caliberpistolneartheboxwhereappellantwasfound.Thepistolbelongedtotheownerofthebuildingandwasusuallykeptinadeskdrawer.Asaresultoftheseevents,appellantwasindictedandlaterconvictedofonecountofburglary. Appellantdoesnotdenythatheillegallyenteredthewarehouse.However,hecontendsthattheevidenceisinsufficienttoprovethathepossessedtheintenttocommitatheft.SeeTenn.CodeAnn.3914402(a)(1)(Supp.1996).Histestimonyattrialreflectedthatheenteredthebuildingonlytogetoutofthecoldandstaywarm.Hesaidhedidnotintendtostealanythingorcommitacrimeonceinsidethebuilding. Wemustconsidertheevidenceinthelightmostfavorabletotheprosecutionindeterminingwhether anyrationaltrieroffactcouldhavefoundtheessentialelementsoftheoffensebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,61L.Ed.2d560(1979).WedonotreweighorreevaluatetheevidenceandarerequiredtoaffordtheStatethestrongestlegitimateviewoftheproofcontainedintherecord,aswellasallreasonableandlegitimateinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978). [S]pecificsubstantiveproofoftheintenttostealisnotindispensabletoaconvictionforburglarychargedtohavebeencommittedwiththatintent.𛀀Petreev.State,530S.W.2d90,94(Tenn.Crim.App.1975).Infact,ajuryiswarrantedininferringthatabreakingandenteringofabuildingcontainingvaluablepropertyismadewiththeintenttocommitalarcenytherein.Hallv.State,490S.W.2d495,496(Tenn.1973);Statev.Avery,818S.W.2d365,36768(Tenn.Crim.App.1991);Statev.Burkley,804S.W.2d458,460(Tenn.Crim.App.1990). Thebuildinghereobviouslycontainedvaluablegoods,asitwasusedtostoremerchandisesoldbythevendingcompany.ThelogoofTomssnackfoodswasprominentlypaintedonthebuilding,veryclosetothedoorthatappellantremoved.Onceinsidethebuilding,appellantrummagedthroughthedesk,removingthedrawersandthrowingitemsonthefloor.HealsopriedopenaPepsimachine,threwsoftdrinksonthefloor,anddiscardedthecoinbox.Althoughappellantclaimednointenttostealanygoods,thejurywasentitledtorejecthistestimonyinfavoroftheStatestheory.AguiltyverdictrenderedbythejuryandapprovedbythetrialcourtaccreditsthetestimonyofthewitnessesfortheState,andapresumptionofguiltreplacesthepresumptionofinnocence.Statev.Grace,493S.W.2d474,476(Tenn.1973). Moreover,itwaswithinthejuryspurviewtodiscreditappellantsexplanationoftheevents.Questionsconcerningthecredibilityofthewitnesses,theweightandvaluetobegiventotheevidence,aswellasfactualissuesraisedbytheevidenceareresolvedbythetrieroffact.Cabbage,571S.W.2dat835.AppellantstestimonyrevealedthathehadbeendrivingonHighway22andranofftheroadintoaditch.IntoxicatedandfearingacitationforDUI,heabandonedhisvehicleandfledthescene.Asheranfromtheaccident,hesawthewarehouse.Appellantclaimedtohaveenteredthebuildingonlytostaywarm.Hefurtherexplainedthatherummagedthroughthedesklookingforsomethingtostartafire.However,hecreatedtotaldisarrayinsidethewarehouse,destroyingsomeofficeitems,scatteringotheritemsonthefloorandremovingthecoinboxfromthedrinkmachine.Healsoremovedthegunfromthedesk,firedtworoundsinsidethebuilding,andkeptitwithhimashehid.Thejurywascertainlyjustifiedinconcludingthattheappellantwasnotmerelyseekingshelter.
