OnJanuary26,1988,theAppellantwasconvictedoffelonymurderandlatersentencedtolifeimprisonment.HeunsuccessfullyappealedthatconvictiontothisϜCourt.Statev.JamesMorningCraft&LewisMoorlet,C.C.A.No.31(Tenn.Crim.App.,Jackson,Mar.8,1989).OnAugust7,1989,theTennesseeSupremeCourtdeniedhispermissiontoappeal. OnApril24,1992,theAppellantfiledaprosepetitionrequestingpostconvictionrelief.AfterahearingonthemeritsthetrialcourtdeniedthepetitionandthisCourtaffirmed.JamesCraftv.State,C.A.A.No.02C019405CR00091(Tenn.Crim.App.,Jackson,Dec.7,1994).Atsomepoint,theAppellantfiledasecondpetitionforpostconvictionreliefwhichwasdismissedinJanuaryof1994.TheAppellantfiledthisthirdpetitiononJuly11,1996,allegingthatthetrialcourterredbyallowinghimtobetriedonaninvalidindictmentandthatthetrialcourtsubmittederroneousinformationtotheDepartmentofCorrection.Thetrialcourtdismissedthepetitionastimebarredbythestatuteoflimitations. TheAppellantspostconvictionpetitionisgovernedbythenowrepealedPostConvictionProcedureAct.Tenn.CodeAnn.4030101etseq(repealed1995).ThatActimposedathreeyearstatuteoflimitationsonpostconvictionpetitions.Tenn.CodeAnn.4030102(repealed1995).Italsoprovidedthatthelimitationsperiodrunsfromthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistaken.Id. Withregardtothiscase,thefinalactionofastateappellatecourttookplaceonAugust7,1989,whentheTennesseeSupremeCourtdeniedtheAppellantspermissiontoappealpetition.Thestatuteoflimitationsexpiredthreeyearsafterthatdate,inAugustof1992.Consequently,theAppellantspetitionforpostconvictionrelief,whichwasfiledin1996,isbarredbythestatuteoflimitation. AnycontentionbytheAppellantthatthenewPostConvictionProcedureAct,effectiveMay10,1995,providedhimwithaoneyearwindowofopportunitywithinwhichtofilehispostconvictionpetitionismeritless.SimilarattemptstocircumventthestatuteoflimitationsinthismannerhavebeenpreviouslyrejectedbypanelsofthisCourt.SeeRoyBarnettv.State,C.C.A.No.03C019512CV00394(Tenn.Crim.App.,Knoxville,Feb.20,1997);StephenKoprowskiv.State,C.A.A.No.03C019511CC00365(Tenn.Crim.App.,Knoxville,Jan.28,1997);JohnnyL.Butlerv.State,C.C.A.No.02C019509CR00289(Tenn.Crim.App.,Jackson,Dec.2,1996).ButseeArnoldCarterv.State,C.C.A.No.03C019509CC00270(Tenn.Crim.App.,Knoxville,July11,1996).
