àThe€appellant,€Frank€Crittenden,€appeals€the€Davidson€County€CriminalÏCourt's€dismissal€of€his€petition€for€post„conviction€relief.€€In€his€petition,€theÏappellant€alleges€that,€but€for€the€ineffective€assistance€of€his€trial€counsel,€heÏwould€have€timely€filed€a€notice€of€appeal€from€the€trial€court's€sentencingÏdecision.€€Consequently,€the€appellant€asks€this€court€to€find€that,€due€to€thisÏconstitutional€violation,€he€is€entitled€to€a€delayed€appeal€of€his€originalÏsentences.ÌÌà àAfter€reviewing€the€record,€we€conclude€that€the€appellant's€issue€isÏwithout€merit.€€Accordingly,€we€affirm€the€trial€court's€order€denying€post„conviction€relief.ÌÌÌà@ àò òI.€€Backgroundó óÌÌà àOn€December€15,€1994,€the€appellant€pled€guilty€to€eight€counts€of€aÏthirty„six€count€indictment€charging€him€with€multiple€offenses€of€aggravatedÏrape€and€aggravated€sexual€battery€of€his€daughter.€€Pursuant€to€an€open€pleaÏagreement,€a€sentencing€hearing€was€held€on€February€10,€1995.€ÏConsequently,€the€court€sentenced€the€appellant€to€twenty„five€yearsÍincarceration€for€each€count,€four€counts€to€run€concurrently,€four€counts€to€runÏconsecutively,€for€a€total€effective€sentence€of€one€hundred€years.€€At€theÏconclusion€of€the€sentencing€hearing,€the€trial€court€permitted€retained€trialÏcounsel€to€withdraw€as€counsel€of€record€for€the€appellant.̛̜Ìà àNotwithstanding€this€termination,€trial€counsel€visited€the€appellant€onÏFebruary€23,€1995.€€During€this€visit,€trial€counsel€advised€the€appellant€of€hisÏright€to€appeal€the€sentences€imposed€by€the€trial€court€and€of€his€right€to€waiveÏthis€right€to€appeal.€€The€appellant€signed€the€waiver€of€appeal,€which€trialÏcounsel€filed€on€February€27,€1995.€€On€March€25,€1995,€the€appellant€filed€aÏmotion€to€file€a€belated€notice€of€appeal.€€The€court€appointed€the€appellantÏcounsel,€who€correctly€captioned€this€motion€as€a€petition€for€post„convictionÏrelief.€€The€appellant€filed€this€petition€on€May€31,€1995,€and€a€post„convictionÏhearing€was€held€on€June€7,€1995.ÌÌà àAt€the€hearing,€the€appellant€confirmed€that€trial€counsel€had€visited€himÏon€February€23.€€However,€the€appellant€asserted€that€trial€counsel€instructedÏhim€to€sign€both€the€waiver€of€his€right€to€appeal€and€the€notice€of€appeal.€€TrialÏcounsel€then€instructed€the€appellant€to€"call€him€the€next€morning"€when€heÏdecided€what€course€of€action€to€take.€€The€appellant€explained€that€trialÏcounsel€"told€[him]€that€if€[he]€filed€an€appeal,€that€the€Parole€Board€.€.€.€wouldÍhold€that€against€[him].€€[Trial€counsel]€told€[him]€that€if€[he]€filed€for€an€appeal,Ïthe€appellate€court€could€and€probably€would€raise€[his]€sentence€because€[he]Ïhad€appealed€it."€€He€further€stated€that€trial€counsel€had€told€him€that€he€onlyÏhad€until€February€24,€to€file€an€appeal.× ƒ& ××  ×ÌÌà àThe€appellant€testified€that€his€"phone€calls€were€refused€[by€trialÏcounsel],€so€[he]€could€never€get€in€touch€with€him."€€Finally,€the€appellant€statesÏthat,€in€desperation,€he€wrote€trial€counsel€a€letter,€on€March€8,€1995,€instructingÏtrial€counsel€to€either€file€an€appeal€or€have€an€attorney€appointed€for€him.× ƒ' ××  ×€ÏTrial€counsel€returned€this€letter,€unopened,€with€a€letter€stating€that€he€was€noÏlonger€representing€the€appellant€and€that€there€would€be€no€further€contactÏbetween€the€two.ÌÌà àThe€appellant's€trial€counsel€testified€that,€on€February€23,€he€met€withÏthe€appellant€to€discuss€the€appellant's€right€to€appeal€his€sentences.€€AlthoughÏthe€court€had€relieved€him€from€any€further€representation€of€the€appellant,€trialÏcounsel€stated€that€he€felt€that€he€had€a€duty€to€inform€the€appellant€of€this€right.€ÏDuring€this€meeting,€trial€counsel€discussed€the€appellant's€"right€to€appeal€.€.€.Íthat€he€could€waive€that€right€.€.€.€€[and]€about€accepting€responsibility€for€theÏabuse€of€his€daughter."€€The€appellant€indicated€that€he€fully€understood€hisÏright€to€appeal€the€range,€length,€and€manner€of€service€of€his€sentences€andÏhis€right€to€waive€that€right.€€Trial€counsel€added€that€he€brought€four€copies€ofÏboth€the€notice€of€appeal€and€the€waiver€of€appeal.€€The€appellant€signed€fourÏcopies€of€the€waiver€of€appeal,€one€of€which€counsel€filed€with€the€court.€ÏApparently,€trial€counsel€subsequently€discarded€the€unsigned€notice€of€appeal.€ÏTrial€counsel€also€stated€that€he€had€not€received€any€telephone€calls€from€theÏappellant€after€the€signing€of€the€waiver.€€Finally,€when€questioned€about€theÏletter€from€the€appellant€dated€March€8,€trial€counsel€testified€that€he€receivedÏthe€letter€on€March€13,€and€returned€the€letter€unopened€to€the€appellant.€ÌÌà àThe€trial€court€concluded€that€the€appellant€had€knowingly€andÏintelligently€waived€his€right€to€appeal.€€Accordingly,€the€court€denied€theÏappellant's€petition€for€post„conviction€relief,€because€trial€counsel€hadÏ"represented€Mr.€Crittenden€as€effectively€as€could€have€been€done€by€anyÏother€lawyer€faced€with€the€circumstances€and€facts€that€he€had€in€trying€toÏdefend€Mr.€Crittenden€in€this€case."ÌÌÌà@
