àThis€is€an€appeal€as€of€right€pursuant€to€Rule€3€of€the€Tennessee€RulesÏof€Appellate€Procedure.€€The€Defendant€entered€pleas€of€guilty€to€two€counts€ofÏselling€marijuana€and€one€count€of€selling€cocaine.€€The€trial€judge€sentenced€theÏDefendant€as€a€Range€I€standard€offender€to€the€minimum€œsentence›€of€oneÏœyear€for€each›€œof›€the€œmarijuana›€offenses€and€to€the€minimum€sentence€of€eightÏyears€for€the€œcocaine›€offense.€€The€sentences€were€œordered€to›€be€servedÏconcurrently.€€One€year€was€ordered€served€in€confinement€œwith›€the€balance€œtoÏbe€served›€on€supervised€probation.€€On€appeal,€the€Defendant€argues€that€theÏtrial€court€erred€by€not€granting€full€probation€or,€in€the€alternative,€a€communityÏcorrections€sentence€without€any€period€of€confinement.€€We€affirm€the€judgmentÏof€the€trial€court.ÌÌà àOn€January€3,€1995,€the€Carroll€County€Grand€Jury€returned€a€three€countÏindictment€against€the€Defendant.€€Count€1€charged€the€Defendant€with€sellingÏ27.7€grams€of€marijuana€to€an€undercover€agent€on€June€25,€1993.€€Count€2Ïcharged€the€Defendant€with€selling€33.2€grams€of€marijuana€to€an€undercoverÏagent€on€July€1,€1993.€€Count€3€charged€the€Defendant€with€selling€in€excess€of€œÏ.5›€grams€of€cocaine€to€an€undercover€agent€on€August€18,€1993.€€ÌÌà àOn€March€28,€1995,€the€Defendant€entered€pleas€of€guilty€as€charged€inÏeach€count€of€the€indictment.€€Sentencing€was€left€to€the€discretion€of€the€trialÏcourt.€€A€presentence€report€was€filed€and€a€sentencing€hearing€was€conducted.€ÏThe€trial€judge€sentenced€the€Defendant€to€concurrent€terms€of€one€year€each€forÏthe€Class€E€felonies€and€to€a€concurrent€sentence€of€eight€years€for€the€Class€BÏfelony,€all€to€be€served€as€a€Range€I€standard€offender.€€The€trial€judge€orderedÏthat€one€year€be€served€in€confinement,€with€the€balance€œon›€supervisedÏprobation.€€It€is€from€the€sentences€ordered€by€the€trial€court€that€the€DefendantÏappeals,€arguing€that€he€should€be€granted€full€probation€or€communityÏcorrections€without€any€period€of€confinement.ÌÌà àOur€review€requires€an€analysis€of€(1)€the€evidence,€if€any,€received€atÏthe€trial€and€sentencing€hearing;€(2)€the€presentence€report;€(3)€the€principles€ofÏsentencing€and€the€arguments€of€counsel€relative€to€sentencing€alternatives;€(4)Ïthe€nature€and€characteristics€of€the€offense;€(5)€any€mitigating€or€enhancingÏfactors;€(6)€any€statements€made€by€the€defendant€in€his€own€behalf;€and€(7)Ïthe€defendant's€potential€for€rehabilitation€or€treatment.€€Tenn.€Code€Ann.€ðððð€40„35„102,€„103€and€„210;€òòState€v.€Smithóó,€735€S.W.2d€859,€863€(Tenn.€Crim.€App.Ï1987)€.€Ìœà àIf€our€review€reflects€that€the€trial€court€followed€the€statutory€sentencingÏprocedure,€imposed€a€lawful€sentence€after€having€given€due€consideration€andÏproper€weight€to€the€factors€and€principals€set€out€under€the€sentencing€law,Ïand€that€the€trial€court's€findings€of€fact€are€adequately€supported€by€the€record,Ïthen€we€may€not€modify€the€sentence€even€if€we€would€have€preferred€aÏdifferent€result.€€òòState€v.€Fletcheróó,€805€S.W.2d€785,€789€(Tenn.€Crim.€App.€1991).ÌÌ›à àThe€presentence€report€reflects€that€the€Defendant€was€twenty„six€yearsÏold€and€successfully€completed€the€eleventh€grade.€€He€attended€high€schoolÏthrough€the€twelfth€œgrade,›€but€did€not€receive€a€diploma.€€He€had€œtwice€taken›€theÏGED€examination€but€failed€to€successfully€complete€it.€€He€was€unmarried€butÏlived€with€his€girlfriend,€with€whom€he€had€a€three„year„old€son.€€He€apparentlyÍhad€been€regularly€employed€as€a€heavy€equipment€operator.€€He€wasÏconvicted€of€misdemeanor€theft€in€1994€for€which€he€received€an€eleven€monthÏand€twenty„nine€day€suspended€sentence€and€was€ordered€to€pay€restitution.€ÏHe€was€also€convicted€of€assault€in€1994€and€received€an€eleven€month€andÏtwenty„nine€day€sentence€with€all€time€suspended€except€for€four€days.ÌÌà àAt€the€time€of€the€sentencing€hearing,€the€Defendant€was€unemployed,Ïalthough€his€girlfriend€stated€that€she€and€their€son€were€totally€dependent€uponÏthe€Defendant€for€support.€€œOn›€cross€examination,€the€Defendant€explained€thatÏhis€theft€conviction€grew€out€of€a€situation€in€which€he€took€a€camcorder€fromÏsomeone€because€that€person€owed€him€money€for€some€marijuana.ÌÌà àIn€sentencing€the€Defendant,€the€trial€judge€stated€that€he€had€consideredÏfull€œprobation,›€but€found€it€inappropriate€because€of€the€circumstances€of€theÏœoffense,›€œnoting›€that€there€were€three€separate€œoffenses›€and€that€full€probationÏwould€ð ðdeprecateðð€the€seriousness€of€the€offense.€€The€trial€court€also€noted€theÏneed€for€deterrence.€€The€trial€judge€then€ordered€the€sentencing€alternative€ofÏcontinuous€confinement€in€conjunction€with€the€term€of€probation.€€Tenn.€CodeÏAnn.€ðð€40„35„104(c)(4).ÌÌà àTennessee€Code€Annotated€section€40„35„103€sets€out€certainÏsentencing€considerations€which€are€guidelines€for€determining€whether€or€not€aÏDefendant€should€be€incarcerated.€€These€include€the€need€ð ðto€avoidÏdepreciating€the€seriousness€of€the€offenseðð€and€the€determination€thatÏð ðconfinement€is€particularly€suited€to€provide€an€effective€deterrence€to€othersÏlikely€to€commit€similar€offenses.ðð€€Tenn.€Code€Ann.€ðð€40„35„103(1)(B).ÌÌà àBecause€the€Defendant€herein€was€convicted€of€a€Class€B€felony,€heÏdoes€not€enjoy€the€presumption€that€he€is€a€favorable€candidate€for€alternativeÏsentencing€options.€€Furthermore,€the€burden€of€establishing€suitability€forÏprobation€rests€with€the€Defendant.€€Tenn.€Code€Ann.€ðð€40„35„303(b).€€ÌÌà àIncluded€in€the€Defendantððs€statement€for€the€presentence€report€is€theÏfollowing:€ð ðI€was€contacted€by€the€undercover€agent€and€asked€to€supply€himÏwith€the€drugs.€€I€have€known€the€undercover€agent€all€of€my€life€and€òòI€thought€IÏwasóó€òòdoing€a€favor€for€himóó.ðð€€At€the€sentencing€hearing,€the€Defendant€testified:Ïð ðIððd€known€òòthe€guy€that€done€this€to€meóó€all€my€life.€€He€just€called€and€he€„„€heÏcalled€me€the€day€that€I€got€out€of€jail.ðð€€(emphasis€added)€€We€believe€theseÏstatements€œindicate›€something€less€œthan€the€Defendant€accepting€fullÏresponsibility›€for€œhis€criminal›€conduct.ÌÌà àAs€previously€set€forth,€the€trial€œjudgeððs›€œsentence€is›€clothed€with€aÏpresumption€of€correctness.€€We€have€performed€the€required€òòdeóó€òònovoóó€review€ofÏthe€record.€€We€are€unable€to€conclude€that€the€trial€judge€erred€or€abused€hisÏdiscretion€when€he€did€not€grant€the€Defendant€full€probation€or€allow€hisÏsentence€to€be€served€in€community€corrections€without€any€period€ofÏconfinement.ÌÌà
