ðBenjiðð€Mills,€hisÏgirlfriend,€Kelly€Hughes,€and€her€sister„in„law,€Lori€Hughes,€met€for€an€evening€ofÏsocializing€and€visiting€with€friends.€€Mills€and€his€girlfriend€were€both€seventeenÏyears€of€age€and€high€school€students;€€Lori€Hughes€was€twenty€years€old.€€AllÏthree€lived€in€or€around€Walnut,€Mississippi.€€After€visiting€friends€in€Mississippi,€theÏtrio€left€in€Millsðð€white€Blazer€to€visit€friends€in€adjoining€Hardeman€County,ÏTennessee.€€En€route€home,€they€stopped€at€Collins€One€Stop€in€Middleton,ÏTennessee.€€Lori€went€into€the€convenience€store€to€purchase€some€potato€chips.€ÏThe€group€then€started€back€towards€Walnut.ÌÌà àAfter€traveling€a€short€distance,€they€realized€that€the€remote€control€changerÏfor€the€CD€player€was€missing€and€Mills€pulled€to€the€side€of€the€road€to€look€for€theÏremote.€€Unable€to€locate€the€remote,€they€then€decided€to€return€to€theÏconvenience€store€to€see€if€it€had€fallen€out€of€the€Blazer.€€At€the€store,€Mills€lookedÏaround€the€parking€lot€for€the€remote,€while€Lori€went€inside€to€see€if€it€had€beenÏfound.€€ÌÌà àMeanwhile,€the€appellant,€accompanied€by€Franklin€Anderson,€arrived€at€theÏconvenience€store€in€the€appellantððs€green€pickup€truck.€€The€appellant€andÏAnderson€saw€a€few€of€their€friends€and€made€plans€to€follow€them€to€a€party€onÏð ðDry€Springs€Road,ðð€near€the€Girl€Scout€Camp.€€As€the€appellant€and€AndersonÏwalked€toward€the€truck,€Lori€Hughes€exited€the€store€and€approached€them.€€TheÏappellant€testified€that€Lori€was€staggering€and€appeared€to€be€intoxicated.€€SheÏasked€them€if€they€had€seen€a€remote.€€Anderson€and€the€appellant€responded€noÏand€continued€toward€the€appellantððs€truck.€€Lori€then€began€ð ðcussing€andÏswearing.ðð€€The€appellant€told€Lori€to€ð ðsober€upðð€and€to€ð ðgrow€up.ðð€€The€appellantÏand€Anderson€returned€to€the€truck€and€left€the€convenience€store€following€theirÏfriends€to€the€party.ÌÌà àLori€returned€to€the€Blazer€and€appeared€to€be€upset.€€She€instructed€Mills€toÏfollow€the€green€truck€driven€by€the€appellant.€€Mills€complied€with€Loriððs€requestÏand€began€pursuit€of€the€green€truck€at€a€high€rate€of€speed.€€Middleton€PoliceÏOfficer€Mike€Kennemore€observed€the€white€Blazer€and€attempted€to€catch€up€toÏthe€vehicle.€€Officer€Kennemore€testified€that€the€white€Blazer€ð ðpassed€a€couple€ofÏcars€in€no€passing€zonesðð€and€crossed€the€railroad€tracks€even€though€the€warningÏgates€were€lowered€for€an€oncoming€train.€€The€train€aborted€Officer€KennemoreððsÏpursuit,€however,€he€notified€the€Hardeman€County€Sheriffððs€Department€of€theÏsituation.ÌÌà àThe€appellant€heard€Officer€Kennemoreððs€report€on€his€police€scanner€andÏlooked€in€his€rear€view€mirror€in€time€to€see€the€Blazer€crossing€the€railroad€tracks.€ÏBoth€Anderson€and€the€appellant€observed€the€fast€approach€of€the€white€Blazer,Ïwhich€began€flashing€its€highbeams.€€Mills€pulled€alongside€the€appellantððs€vehicleÏand€applied€his€brakes.€€The€appellant€then€passed€the€Blazer.€€Mills€again€pulledÏalongside€the€appellantððs€vehicle.€€The€appellant€and€Anderson€testified€that,€at€thisÏtime,€Lori€was€pointing€a€gun€out€of€the€passenger€side€window€at€them.× ƒ+ ××  ×€€TheÏBlazer€passed€the€appellantððs€truck€and€pulled€in€between€the€appellantððs€truck€andÏthe€vehicle€driven€by€the€appellantððs€friends.€€The€Blazer€followed€the€lead€vehicleÏonto€Girl€Scout€Road,€however,€the€appellant€did€not€turn€and€headed€towardÏBolivar.€€The€appellant€pulled€off€the€road€and€called€the€Sheriffððs€Department€onÏhis€cellular€phone€to€report€the€Blazer€and€the€female€pointing€the€gun€at€them.× ƒ, ××  ×€ÏMeanwhile,€the€Blazer€pulled€alongside€the€driverððs€side€of€the€appellantððs€truck.€ÏAfter€both€vehicles€came€to€a€stop,€the€testimony€of€the€witnesses€are€at€a€materialÏvariance€as€to€the€sequence€and€circumstances€of€the€events€that€followed.ÌÌà àNonetheless,€it€is€undisputed€that€Mills€and€Anderson€became€involved€in€anÏargument€resulting€in€Mills€hitting€Anderson€in€the€mouth€with€a€Bud€Light€beerÍbottle.× ƒ- ××  ×€€The€appellant,€meanwhile,€armed€with€his€.44€Magnum€revolver,€got€out€ofÏhis€vehicle.€€Lori,€who€was€standing€near€Mills,€began€to€slap€the€appellant€in€anÏattempt€to€knock€the€weapon€out€of€the€appellantððs€hands.€€The€appellant€pushedÏLori€out€of€the€way€and,€in€an€effort€to€aid€Anderson,€hit€Mills€over€the€head€with€theÏbutt€of€the€gun.€€Anderson€then€heard€a€gunshot,€looked€toward€the€rear€of€theÏvehicle,€and€saw€the€appellant€pointing€his€gun€in€the€air.× ƒ. ××  ×€€The€gun€dischargedÏagain,€at€which€point,€the€appellant€testified€that€he€realized€that€the€weapon€wasÏnot€functioning€properly.€€He€ð ðreleased€Lori€Hughes€from€having€her€pinned€upÏagainst€the€truck€.€.€.,€pointed€the€gun€straight€down€at€the€ground€.€.€.,€and€.€.€.€pulledÏthe€hammer€back€again€.€.€.ðð€€and,€in€the€same€motion,€released€the€hammer.€€TheÏhammer€struck€the€firing€pin,€firing€a€bullet€into€the€pavement€about€three€inches€inÏfront€of€the€appellantððs€left€foot,€scattering€pieces€of€pavement€into€the€appellantððsÏface.€€Unknown€to€the€appellant,€the€ricocheting€bullet€struck€Lori€Hughes€in€theÏhead.€€The€appellant€got€into€his€truck€and€told€Anderson€that€the€weapon€wasÏfiring€without€him€touching€the€trigger.€€The€appellant€then€left€the€scene€of€theÏincident.ÌÌà àMeanwhile,€Mills€climbed€back€into€the€Blazer€with€Kelly.€€The€two€wereÍunable€to€see€Lori€and€Mills€began€to€look€for€her.€€She€was€found€lying€on€theÏground,€partially€underneath€the€Blazer.€€A€significant€amount€of€blood€was€comingÏfrom€her€head.€€Mills€and€Kelly€then€placed€Lori€in€the€Blazer.€€En€route€to€theÏhospital,€Mills€was€stopped€by€police€officers.€€Lori€was€then€transferred€to€anÏambulance.€€She€died€sometime€later€from€a€gunshot€wound€to€the€head.€€Dr.ÏWendy€Gunther,€a€forensic€pathologist,€conducted€an€autopsy€and€determined€thatÏthe€victim€was€shot€at€a€distance€of€over€three€feet.€€Dr.€Gunther€confirmed€that€theÏvictimððs€blood€alcohol€level,€at€the€time€of€her€death,€was€.09€percent.ÌÌà àA€subsequent€examination€of€the€appellantððs€weapon€revealed€that€theÏtrigger€guard€on€the€gun€was€bent.€€The€bent€trigger€guard,€which€was€pressing€onÏthe€trigger,€caused€the€trigger€to€be€engaged€so€that€if€the€hammer€was€cocked€andÏthen€released,€the€weapon€would€fire€instantly.ÌÌà àBased€upon€this€evidence,€the€jury€found€the€appellant€guilty€of€recklessÏhomicide,€assault,€and€carrying€a€weapon€with€the€intent€to€go€armed.ÌÌÌà@ àò òI.€€€Sufficiency€of€the€Evidenceó óÌÌà àThe€appellant€contends€that€the€proof€is€insufficient€to€establish€the€òòmens€reaóóÏof€the€offense€of€reckless€homicide,€i.e.,€that€he€acted€recklessly.€€Specifically,€theÍappellant€argues€that€ð ðthe€risk€that€the€bullet€would€strike€and€kill€Lori€[Hughes]€wasÏnot€substantial€and€unjustifiable.ðð€€Additionally,€he€maintains€€that€ð ðfailing€toÏperceive€the€risk€that€the€bullet€might€strike€and€kill€Lori€[Hughes]€does€notÏconstitute€a€gross€deviation€from€the€standard€of€care€that€an€ordinary€personÏwould€exercise€under€all€of€the€circumstances€as€viewed€from€the€òòaccusedÏpersonððs€standpointóó.ðð€(emphasis€in€original).€€For€the€reasons€discussed€herein,€weÏdisagree.ÌÌà àA€jury€conviction€removes€the€presumption€of€innocence€with€which€aÏdefendant€is€initially€cloaked€and€replaces€it€with€one€of€guilt,€so€that€on€appeal€aÏconvicted€defendant€has€the€burden€of€demonstrating€that€the€evidence€isÏinsufficient.€€òòState€v.€Tuggleóó,€639€S.W.2d€913,€914€(Tenn.€1982).€€In€determining€theÏsufficiency€of€the€evidence,€this€court€does€not€reweigh€or€reevaluate€the€evidence.€ÏòòState€v.€Cabbageóó,€571€S.W.2d€832,€835€(Tenn.€1978).€€Also,€it€is€the€responsibilityÏof€the€jury€to€resolve€any€conflicts€in€the€evidence€and€to€weigh€the€credibility€of€theÏwitnesses.€€òòIdóó.€at€836.€€On€appeal€the€State€is€entitled€to€the€strongest€legitimateÏview€of€the€evidence€and€all€reasonable€or€legitimate€inferences€which€may€beÏdrawn€therefrom.€€òòState€v.€Harrisóó,€839€S.W.2d€54,€75€(Tenn.€1992).€€It€is€theÏappellate€courtððs€duty€to€affirm€the€conviction€if€the€evidence,€viewed€under€theseÏstandards,€was€sufficient€for€any€rational€trier€of€fact€to€have€found€the€essentialÏelements€of€the€offenses€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443€U.S.Ï307,€317,€99€S.Ct.€2781,€2789€(1979);€òòState€v.€Cazesóó,€875€S.W.2d€253,€259€(Tenn.Í1994);€Tenn.€R.€App.€P.€13(e).ÌÌà àReckless€homicide€is€defined€as€a€ð ðreckless€killing€of€another.ðð€€Tenn.€CodeÏAnn.€ðð€39„13„215€(1996€Supp.).€€ÌÓÓà8 àð ðRecklessðð€refers€to€a€person€who€acts€recklessly€with€respect€toÏcircumstances€surrounding€the€conduct€or€the€result€of€the€conductÏwhen€the€person€is€aware€of€but€consciously€disregards€a€substantialÏand€unjustifiable€risk€that€the€circumstances€exist€or€the€result€willÏoccur.€€The€risk€must€be€of€such€a€nature€and€degree€that€its€disregardÏconstitutes€a€gross€deviation€from€the€standard€of€care€that€anÏordinary€person€would€exercise€under€all€the€circumstances€asÏviewed€from€the€accused€personððs€standpoint.ÌÓÓÌ€€Tenn.€Code€Ann.€ðð€39„11„106€(a)(31)€(1996€Supp.).€€ÌÌà àThe€òòriskóó€of€which€the€accused€is€aware€must€be€òòsubstantialóó€in€order€for€theÏrecklessness€judgment€to€be€made.€€The€risk€must€also€be€òòunjustifiableóó.€€TheÏawareness€of€the€risk€is€measured€from€the€actorððs€point€of€view.€€The€questionÏremains€as€to€what€standard€is€used€in€determining€how€substantial€and€howÏunjustifiable€the€risk€must€be€in€order€to€warrant€a€finding€of€culpability.€€These€areÏquestions€to€which€theòò€juryóó€must€evaluate€the€actorððs€conduct€and€determineÏwhether€it€should€be€condemned.€€Thus,€the€jury€must€answer€two€questions:€(1)€toÏwhat€extent€was€the€actor€aware€of€the€risk,€of€factors€relating€to€its€substantiality,Ïand€of€factors€relating€to€its€unjustifiableness;€and€(2)€whether€the€actorððs€consciousÏdisregard€of€the€risk€justifies€condemnation.€€òòSeeóó€€Comment,€òòModel€Penal€Codeóó€ððÍ2.02€(1985).€€ÌÌÌà àThe€proof€at€trial€revealed€that€the€appellant€fired€his€weapon€into€the€air€inÏan€attempt€to€scare€Mills€and€Lori.€€He€admitted€that€after€the€second€shot€heÏrealized€that€the€gun€was€not€functioning€properly€because€it€was€firing€withoutÏpulling€the€trigger.€€With€full€knowledge€that€Lori€Hughes€and€Mills€were€withinÏclose€proximity,€the€appellant€aimed€the€weapon€at€the€ground€and,€again,€fired€theÏweapon.€€The€bullet€ricocheted€off€the€pavement€striking€Lori€Hughes€in€the€head.€ÏThe€evidence€also€revealed€that€the€appellant€had€twelve€years€service€in€theÏUnited€States€Marine€Corps€and€was€experienced€and€knowledgeable€regardingÏthe€operation€of€various€types€of€weapons.€€These€factors€are€sufficient€for€aÏrational€trier€of€fact€to€conclude€that€the€appellant€was€aware€that€the€firing€of€aÏmalfunctioning€weapon€in€close€proximity€of€other€individuals€during€a€volatileÏconfrontation€was€likely€to€cause€injury€to€those€individuals.€€Since€the€discharge€ofÏa€firearm€is€likely€to€result€in€injury,€the€risk€created€is€substantial.€€Moreover,€weÏfind€the€appellantððs€subsequent€action€unjustifiable€in€light€of€the€surroundingÏcircumstances.€€Thus,€the€appellantððs€actions€constituted€a€gross€deviation€from€theÏstandard€of€care€required€of€a€reasonable€person€with€the€appellantððs€experienceÏwith€firearms€and€in€the€same€circumstances.€€A€rational€juror€could€reasonablyÏconclude€that€the€appellantððs€actions€were€not€accidental;€but€constituted€recklessÏconduct.€€Viewing€the€evidence€in€the€light€most€favorable€to€the€State,€we€cannotÍconclude€otherwise.€€This€issue€is€without€merit.ÌÌà@ àò òII.€€Sentencingó óÌÌà àIn€his€final€issue,€the€appellant€contends€that€the€trial€court€erred€by€denyingÏtotal€probation.€€Although€the€State€concedes€that€the€trial€court€erroneouslyÏimposed€a€Community€Corrections€sentence,€the€State€argues€that€the€appellant€isÏnot€entitled€to€full€probation.ÌÌÌà à€€At€the€sentencing€hearing,€the€State€presented€the€testimony€of€PamÏHightower,€the€victimððs€mother.€€Ms.€Hightower€expressed€the€emotional€painÏcaused€by€the€death€of€her€daughter.€€No€further€witnesses€were€presented.€€TheÏpre„sentence€report€revealed€that€the€appellant€is€a€single€thirty„year€old€highÏschool€graduate€with€a€six€year€old€son.€€In€June€1996,€the€appellant€received€anÏhonorable€discharge€after€twelve€years€service€in€the€United€States€Marine€Corps.€ÏSince€his€discharge,€the€appellant€has€been€employed€as€both€a€laborer€and€anÏelectrician.€€Other€than€several€traffic€violations,€the€appellant€has€no€prior€criminalÏrecord.€€Both€sides€rested€and€the€sentencing€determination€was€submitted€to€theÏtrial€court€based€upon€the€evidence€contained€in€the€pre„sentence€report€and€Ms.ÏHightowerððs€testimony.ÌÌà àThe€trial€court€imposed€concurrent€sentences€of€two€years€for€the€convictionÏfor€reckless€homicide,€six€months€for€the€conviction€for€assault,€and€ten€days€for€theÏconviction€for€unlawful€carrying€of€a€weapon.€€The€court€further€ordered€theÏappellant€to€serve€seventy„five€days€of€his€effective€sentence€in€the€county€jail,€withÏthe€remainder€of€the€sentence€to€be€served€in€the€Community€Corrections€Program.ÌÌà àWhen€a€defendant€challenges€the€manner€of€service€of€his€sentence,€thisÏcourt€must€conduct€a€òòde€novoóó€review€with€the€presumption€that€the€determinationÏmade€by€the€trial€court€is€correct.€€Tenn.€Code€Ann.€ðð€40„35„401(d)(1990).€€ThisÏpresumption€only€applies,€however,€if€the€record€shows€that€the€trial€court€properlyÏconsidered€relevant€sentencing€principles.€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169Ï(Tenn.€1991).€€In€this€case,€the€record€is€entirely€void€of€any€findings€of€fact€whichÏreflect€any€consideration€of€the€relevant€sentencing€principles,€thus,€theÏpresumption€fails.€€In€this€regard,€we€emphasize€that€the€trial€court€is€obliged€toÏmake€its€findings€on€the€record€in€order€to€assist€an€appellate€court€in€conducting€itsÏòòde€novoóó€review.€€Tenn.€Code€Ann.€ðð€40„35„209;€€Tenn.€Code€Ann.€ðð€40„35„210(f).€ÏThe€fact€that€this€courtððs€review€of€the€sentence€is€òòde€novoóó€does€not€relieve€the€trialÏcourt€of€its€duty.€€Nonetheless,€the€appellant€maintains€the€burden€of€showing€thatÏthe€sentence€imposed€by€the€trial€court€is€improper.€€Sentencing€CommissionÏComments,€Tenn.€Code€Ann.€ðð€40„35„401(d).€€ÌÌà àThe€trial€court€imposed€a€sentence€pursuant€to€the€Community€CorrectionsÍAct.€€A€defendant€convicted€of€a€crime€against€the€person,€as€provided€in€title€39,Ïchapter€13,€parts€1„5,€is€not€eligible€for€a€community€corrections€sentence.€€òòSeeóó€ÏTenn.€Code€Ann.€ðð€40„36„106(a)(2)€(1996€Supp.).€€€Reckless€homicide€is€codifiedÏat€Tenn.€Code€Ann.€ðð€39„13„215€and€is,€therefore,€a€crime€against€the€person.€ÏAdditionally,€the€appellant€is€ineligible€because€use€of€a€weapon€was€involved€inÏthe€commission€of€the€felony€offense.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„36„106(a)(4)Ï(1996€Supp.).€€€Notwithstanding€his€ineligibility€based€upon€these€two€reasons,€heÏwould,€nevertheless,€remain€eligible€for€placement€in€the€community€correctionsÏprogram,€if€the€proof€in€the€record€established€a€causal€connection€between€theÏcrimes€committed€and€a€history€of€chronic€alcohol€abuse,€drug€abuse€or€mentalÏhealth€problems.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„36„106(c).€€The€record€reflects€noÏsuch€proof.€€Accordingly,€the€appellant€is€not€eligible€for€a€sentence€pursuant€to€theÏCommunity€Corrections€Act;€therefore,€the€trial€courtððs€sentencing€determination€isÏimproper.ÌÌà àNonetheless,€we€do€find€the€appellant€to€be€a€suitable€candidate€forÏalternative€sentencing.€€The€appellant€is€a€first„time€offender€of€a€class€D€felony.€ÏòòSeeóó€€Tenn.€Code€Ann.€ðð€40„35„102(5),€„102(6)€(1996€Supp.).€€Additionally,€he€isÏstatutorily€eligible€for€probation.€€òòSeeóó€€Tenn.€Code€Ann.€ðð€40„35„303(a)€(1996ÏSupp.).€€The€appellantððs€eligibility€for€probation€is€not€conclusive;€the€appellantÏbears€the€burden€of€establishing€his€suitability€for€probation.€€òòSeeóó€€Tenn.€Code€Ann.Ïðð€40„35„303(b).€€To€meet€this€burden,€the€appellant€must€demonstrate€thatÍprobation€will€ð ðsubserve€the€ends€of€justice€and€the€best€interest€of€both€the€publicÏand€the€defendant.ðð€€òòState€v.€Binghamóó,€910€S.W.2d€448,€456€(Tenn.€Crim.€App.),Ïòòperm.€to€appeal€deniedóó,€(Tenn.€1995)€(citation€omitted).ÌÌà àWhile€not€controlling€on€the€issue€of€probation,€but€relevant€to€the€sentencingÏcourtððs€determination€are€the€following:ÌÓÓà8 à(1)€the€nature€and€circumstances€of€the€conduct€involved,€Tenn.€CodeÏAnn.€ðð€40„35„210(b)(4);ÌÌà8 à(2)€the€defendantððs€potential€or€lack€of€potential€for€rehabilitation,ÏTenn.€Code€Ann.€ðð€40„35„103(5);ÌÌà8 à(3)€whether€a€sentence€of€probation€will€unduly€depreciate€theÏseriousness€of€the€offense,€Tenn.€Code€Ann.€ðð€40„35„103(1)(B);€andÌÌà8 à(4)€whether€a€sentence€other€than€probation€would€provide€anÏeffective€deterrent€to€others€likely€to€commit€similar€crimes,€Tenn.ÏCode€Ann.€ðð€40„35„103(1)(B).ÌÌÓÓòòSeeóó€€òòBinghamóó,€910€S.W.2d€at€456.€€ÌÌà àAs€previously€indicated,€the€appellant€maintains€the€burden€of€establishingÏthat€the€sentence€imposed€by€the€trial€court€is€improper.€€In€this€regard,€we€find€thatÏthe€appellant€has€failed€in€carrying€this€burden.€€Although€the€facts€andÏcircumstances€of€the€offense€alone€are€insufficient€to€deny€an€alternative€sentence,Ïthey€may€be€sufficient€to€deny€a€grant€of€total€probation.€€òòSeeóó€€òòBinghamóó,€910ÏS.W.2d€at€456.€€After€òòde€novoóó€review€of€the€above€principles€and€circumstances€ofÏthe€case,€we€find€that€the€75€day€period€of€confinement€ordered€by€the€trial€court€isÍboth€justified€and€appropriate.ÌÌà àAccordingly,€the€appellantððs€sentences€are€affirmed,€subject€to€the€followingÏsentencing€modification:€€following€the€appellantððs€confinement€in€the€county€jail€forÏa€period€of€75€days,€he€is€to€be€released€upon€supervised€probation€for€the€balanceÏof€his€two€year€sentence.€€€The€appellantððs€judgment€of€conviction€for€the€offense€ofÏreckless€homicide€is€affirmed.ÌÌÌÓÓÌÌÌÌÌÌÌÌÌÌÌÌà
