First,thepetitionerarguesthatthetrialcourtsordershouldbereversedandthiscaseremandedforexpunctionbecausethetrialcourthadnodiscretiontodenyhispetitions.Thepetitionercorrectlyarguesthatexpunctionofrecordspursuanttoaproperpetitionisnotamatterofdiscretion.Statev.Liddle,929S.W.2d415(Tenn.Crim.App. "v 1996);seeT.C.A.4032101(a).Theorderonreview,however,reflectsthatthetrial $B courtdidnotdenythepetitionerspetitionasamatterofdiscretion.Rather,thetrialcourtdeniedthepetitionerspetitionsbecausetherecordsrelatingtothechargestowhichthepetitionerreferredcouldnotbefound.Iftherecordscannotbefound,theycannotbeexpunged.ThepetitionernotesinhisappellatebriefthathereferredtothefileshewantedexpungedbythenumbershefoundonanFBI rapsheetfoundinhisprisonfile.Apparently,thesenumbersdonotcorrelatewiththenumberingsystemusedbyDavidsonCounty.Ifthepetitionerwantsthepublicrecordsrelatingtocertainchargesexpunged,thenheshouldrefileapetitionlistingthecasenumbersusedbytheclerkofthecriminalcourtandanyotherinformationthatwillhelptheclerklocatethefileshewishestobeexpunged. 6:-2   Asacorollarymatter,thepetitionernotesinhisappellatebriefthatthefullrecordwasnottransmittedtothisCourt.Specifically,thepetitionercomplainsthatfourofthefivepetitionshefileddonotappearintherecordonappeal.Becauseofthis,thepetitionerrequeststhattheclerksofficebeorderedtosubmittheentireappellaterecordtothisCourtsothatwemayproperlyconsiderallissuespresented.Giventhenatureofthetrialcourtsorder,thisisnotnecessary.Evenifallfivepetitionswereincludedinthe< appellate< record; onappeal; ,thepetitionerisnotentitledtoexpunctionofdocumentsthatcannotbelocatedbecausetheinformationthepetitionersuppliedwasinsufficienttolocatethedocumentstowhichhereferred.Thus,evenassumingthe: appellate: recordisinfactincomplete,itdoesnotprecludeourfullandmeaningfulreviewofthiscase.
