Ð24(b).€€However,€we€choose€to€address€Petitionerððs€issues€on€the€merits.€€The€StateÏdoes€not€argue€on€appeal€that€there€should€be€a€waiver€for€not€including€theÏtranscript€of€the€guilty€plea€hearing.€€The€State€did,€however,€move€to€make€it€anÏexhibit€at€the€post„conviction€hearing€and€Petitioner€made€no€objection€to€itsÏadmissibility.€€The€trial€court€nonetheless€refused€to€allow€it€at€that€time.€€Hence,€weÏwill€not€consider€Petitionerððs€issues€waived.€€We€find€that€the€transcript€from€theÏguilty€plea€hearing€should€be€made€an€exhibit€upon€remand€at€the€new€hearing€andÏit€should€be€made€part€of€the€record€on€appeal.Ìà ` àÌà ` àAs€to€his€first€issue,€Petitioner€claims€that€his€attorneys€wrongfully€advised€himÏthat€he€would€be€released€after€serving€seven€years€of€his€sentence.€€PetitionerððsÏmother€testified€at€the€hearing€that€the€attorneys€told€her€that€her€son€would€serveÏapproximately€seven€to€seven€and€one„half€years€on€a€guilty€plea€to€felony€murder.€Ð  :À00 ÐBoth€counsel€denied€this,€but€one€of€his€attorneys€testified€that€he€told€Petitioner€thatÏð ð20€years€would€probably€be€the€minimum€he€would€have€to€serve€before€he€wouldÏbe€eligible€for€parole.ðð€€This€attorney€also€said€he€knew€he€advised€Petitioner€that€heÏwould€have€to€serve€30€percent€ð ð[œo]f›€life,€which€was,€I€believe,€calculated€at€60€yearsÏat€the€time.€€So,€whatever€„„€that€would€be€20€years,€is€what€I€told€him.ðð€€ÌÌà ` àThis€Court,€in€òòWalton€v.€Stateóó,€966€S.W.2d€54,€55€(Tenn.€Crim.€App.€1997),Ð 0  Ðheld€that€erroneous€advice€regarding€parole€that€induces€a€defendant€to€forego€hisÏor€her€right€to€a€jury€trial€can€be€used€to€establish€a€claim€of€ineffective€assistanceÏof€counsel.€€If€Petitioner€can€establish€that€his€defense€counsel€did€in€factÏerroneously€advise€him€of€parole€eligibility,€then€he€can€satisfy€the€first€prongÏrequirement€under€òòœStrickland›óó.€€òòIdóó.€€Once€established,€the€burden€still€remains€onÐ ¸X ÐPetitioner€to€show€that€but€for€trial€counselððs€erroneous€advice€he€would€have€notÏpled€guilty.€€€òòIdóó.€€The€trial€court€found€the€following€in€its€Order€denying€PetitionerððsÐ È#h Ðpetition€for€post„conviction€relief:ÌÓÓà8 ` àà8¸ ` (#` (#à[The€attorneys€who€testified],€two€of€Petitionerððs€fourÏappointed€counsel€at€the€trial€level[,]€testified€as€to€eachÏand€every€allegation€raised€by€the€Petitioner€in€his€PetitionÏand€Amended€Petition,€and€which€Petitioner€raised€orallyÏfrom€the€witness€stand,€and€their€testimony,€accompaniedÏby€the€record€.€.€.€clearly€and€convincingly€rebut€theÏtestimony€of€the€Petitioner€and€his€mother€who€testified€onÏhis€behalf€that€trial€counsel€was€ineffective,€and€that€hisÏguilty€plea€was€therefore€unknowingly€and€involuntarilyÏmade.€€The€Petitioner€has€the€burden€of€provingÏallegations€of€fact€by€clear€and€convincing€evidence,ÏœT.C.A.›€40„30„210(f).€€The€clear€and€convincing€weight€ofÏthe€evidence€is€contrary€to€Petitionerððs€allegations.€ÏConsequently,€all€issues€raised€by€the€Petitioner€as€toÏineffective€assistance€of€counsel€are€without€merit.Ð ða€defendant€receiving€a€life€sentence€for€first€degree€murder€shall€occur€afterÏservice€of€sixty€percent€(60%)€of€sixty€(60)€years€less€sentence€credits€earned€andÏretained€by€the€defendant.ðð€€Tenn.€Code€Ann.€ðð€40„35„501€(œSupp›.€1991).€€Therefore,ÏPetitioner,€who€did€receive€a€life€sentence€for€first€degree€murder,€would€not€haveÏbeen€eligible€for€release€until€he€had€served€36€years,€less€any€sentence€credits.€ÏPetitionerððs€attorneys€testified€at€the€post„conviction€hearing€that€they€did€not€informÏPetitioner€that€he€could€be€released€after€seven€years,€but€at€least€one€instead€toldÏhim€he€would€be€eligible€for€parole€at€a€30€percent€eligibility€rate€or€after€20€years.€ÏSince€the€attorney€admitted€this€misinformation,€the€first€prong€of€the€òòœStrickland›óóÐ À!` Ðrequirements,€that€the€attorneysðð€performance€was€deficient,€has€been€met.€€ÏHowever,€Petitioner€must€establish€a€reasonable€probability€that,€but€for€the€errorsÏof€counsel,€he€would€not€have€entered€into€the€plea.€€òòSeeóó€òòœAdkins›óó,€911€S.W.2d€atÐ àSecondly,€Petitioner€also€alleges€that€his€trial€attorneys€failed€to€show€him€anyÏdiscovery€material€and€failed€to€include€him€in€defense€preparation.€€Petitionerððs€trialÏattorneys€testified€otherwise€at€the€post„conviction€hearing.€€One€attorney€testifiedÏthat€he€spent€a€total€of€29.5€hours€with€Defendant€either€in€jail€or€in€court.€€HeÏtestified€that€he€went€to€see€Petitioner€at€the€jail€at€least€eight€times€and€spoke€to€himÏon€the€phone€at€least€five€times.€€Both€counsel€testified€that€they€filed€and€argued€43„Ð  :À00 Ð45€motions€pertaining€to€Petitionerððs€case.€€One€attorney€testified€that€he€did€notÏrecall€giving€Petitioner€a€copy€of€his€file,€but€that€the€discovery€was€always€availableÏto€him€and€that€he€always€took€the€file€with€him€when€he€met€with€Petitioner.€€HeÏfurther€said€that€he€did€not€remember€Petitioner€ever€requesting€a€copy€of€the€file.€ÏBoth€attorneys€testified€that€Petitioner€actively€participated€in€preparation€of€hisÏdefense.€€We€find€this€issue€to€be€without€merit.ÌÌà `
