Thepetitionerfirstargueshisguiltypleawasunknowingandinvoluntarybecausehedidnotunderstandwhat consecutivesentencingmeant.Hecontendsthatatrialcourtshouldberequiredtodefinetheterm consecutivetodefendantsbeforetheirpleascanbeconsideredknowingandvoluntary.  Itisundisputedthatduringtheguiltypleahearinginthiscase,thetrialcourtdidnotexplaintothepetitionerwhattheterm consecutivemeant.Nonetheless,thepetitionerrepresentedtothetrialcourtCCthatheCCunderstoodhewouldreceiveaconsecutivesentencepursuanttohispleabargainandthathewantedtovoluntarilyenterapleaofguilty.Atthepostconvictionevidentiaryhearing,however,thepetitioner 6&-0 testifiedthatdespitethefacthispleabargainspecifiedthreeconsecutiveelevenyearterms,hebelieved consecutivemeantthesameas concurrent.HealsotestifiedCChisCCattorneytoldhimthatwithathirtypercentreleaseeligibility,hewouldbereleased inaboutfour,fourandahalfyearsandtotheextentthatthiswasnottrue,hebelievedhisattorneythreatenedandcoercedhimintopleadingguilty.  CCSteveCCYoungandRossAldermanofthepublicdefendersofficeappointedtorepresentthepetitioneralsotestified.Accordingtotheirtestimony,theyexplainedCCtothepetitionertheCCnatureoftheCCsentenceCCandthatitwasathirtythreeyearsentence,andthepetitionerseemedtounderstandtheCCeffectiveCCsentencehewouldreceive.ThepostconvictioncourtspecificallyaccreditedYoungsandAldermanstestimony,finding thatthispetitionerclearlyunderstoodthatthesentencewas33years,thatthethree11yearsentenceswillrunconsecutiveandthathisattempttoconvincethecourtotherwiseofamisunderstandingisjustnotcredible.Theevidencedoesnotpreponderateagainstthisfinding.Tothecontrary,inasmuchasthepetitiontoenteraguiltypleaandthetranscriptoftheguiltypleahearingcorroborateYoungsandAldermanstestimony,asthepostconvictioncourtnoted,theevidenceintherecordsupportsthisfinding.Becausethepetitionerhasnotsuccessfullychallengedthisfinding,hisargumentmustfail.Cooper @)" v.State,849S.W.2d744,746(Tenn.1993)(courtsfindingsareconclusiveunless  +!$ evidencepreponderatesagainstthejudgment).  Thepetitionernextarguesthattheaggravatedsexualbatteryindictmentswereconstitutionallydefectivebecausetheyfailedtoallegescienter.HepointsoutthateventhoughT.C.A.3913504definesaggravatedsexualbatteryas unlawfulsexualcontactwithoutanyreferencetoaspecificmensrea,thestatutedefining sexual `6-0 contactprovidesthespecificmensreaof intentional,seeT.C.A.3913501(6). `  Basedonthis,thepetitionercontendsthatthe statutesettingoutthecrimeofaggravatedsexualCCbattery== plainlyCCrequiresthespecificmensreaof intentional.Assuch,thepetitionerdistinguishesthiscasefromCC>Hillv.>State?v.Hill?,CC954S.W.2d725(Tenn.  1997)(defendantchargedwithaggravatedrape,whichdoesnotexpresslyrequireaCC@specific@culpableCCmentalstate),andarguesthatbecausetheindictmentinthiscasedidnotspecificallyallegethespecificmensreaof intentional,itisinsufficientandhisunderlyingconvictionsmustbereversed.  Eachofthethreeindictmentschargingthepetitionerwithaggravatedsexualbatteryallegethatthepetitioner didengageinunlawfulsexualcontactwith[thevictim],achildlessthanthirteen(13)yearsofage,inviolationofTennesseeCodeAnnotatedGG3913504,andagainstthepeaceanddignityoftheStateofTennessee.ThislanguageisalmostidenticaltotheaggravatedsexualbatteryindictmentchallengedinRuffv.State,978S.W.2d95,9697(Tenn.1998).Inthatcase,thedefendantchallenged #@ anindictmentallegingthathe didunlawfullyengageinsexualcontactwith[A.K.],apersonlessthanthirteen(13)yearsofage,inviolationofTennesseeCodeAnnotated,Section3913504,allofwhichisagainstthepeaceanddignityoftheStateofTennessee.Id.at97.TheTennesseeSupremeCourtrecognizedthatwhilethe  +!$ aggravatedsexualbatterystatute,T.C.A.3913504,didnotexplicitlyincludearequisitementalstate,itdefinedthecrimeas unlawfulsexualcontact,atermdefinedbyanotherstatutorysection,T.C.A.3913501(6),whichCCAitselfAexplicitlyCCincludedthementalstateof intentional.Ruff,978S.W.2dat97.Evenso,theTennesseeSupreme 2@), Courtstated,8  LiketheaggravatedrapestatuteinHill,theaggravatedsexual `6-0 batterystatutein[this]casedoesnotexpresslyrequireaculpablemental P7-1 state.Rather,onemustascertaintherequisitementalstatebyreferringtothedefinitionsinTenn.CodeAnn.3913501,foundinthesamechapter. P7-1 ThesoledistinctioninHillisthefactthatadifferentprovisionsuppliedthe `  mentalstate.Thisdistinctionisnotpertinenthere.Therefore,wefindHill P  completelyanalogousandapplicabletothecaseundersubmission.)
