àOn€February€29,€1998,€the€Defendant,€Heather€Denise€Curry,€was€indictedÏon€charges€of€attempted€theft€and€criminal€impersonation.€€On€April€6,€1998,€sheÏpleaded€guilty€to€attempted€theft,€and€as€part€of€her€negotiated€plea€agreement,Ïthe€charge€of€criminal€impersonation€was€ð ðnolle€prossed.ðð€€The€agreement€calledÏfor€the€trial€judge€to€determine€her€sentence,€and€the€Defendant€requestedÏjudicial€diversion.€€On€August€20,€1998,€the€trial€court€denied€her€request€andÏsentenced€her€to€two€yearsðð€confinement,€suspended,€with€four€years€onÏsupervised€probation.€€The€Defendant€now€appeals€her€sentence,€pursuant€toÏRule€3€of€the€Tennessee€Rules€of€Appellate€Procedure.€€The€sole€issue€for€ourÏconsideration€on€appeal€is€whether€the€trial€court€erred€by€denying€theÏDefendantððs€request€for€judicial€diversion.€€We€affirm€the€judgment€of€the€trialÏcourt.ÌÌà ` àAt€the€sentencing€hearing,€the€Defendant€testified€that€on€November€3,Ï1997,€she€and€her€then„boyfriend,€Clarence€Dickson,€went€to€Walker€ChevroletÏin€Franklin,€Tennessee€to€purchase€a€vehicle.€€At€the€time,€the€Defendant€was€aÏtwenty„year„old€college€student,€and€Dickson€was€thirty„three€years€old.€€SheÏstated€that€Dickson€told€her€that€although€his€credit€was€not€good€enough€for€himÏto€purchase€a€vehicle,€a€friend€of€his€had€offered€to€allow€him€to€use€her€credit€forÏthe€purchase.€€According€to€the€Defendant,€Dickson€told€her€that€his€friend,€BrandÏD.€Sanders,€had€sent€certain€personal€information€to€him,€including€a€copy€of€herÏdriverððs€license,€her€social€security€card,€and€a€copy€of€her€college€diploma,€forÏuse€in€purchasing€the€vehicle.€€The€Defendant€claimed€that€she€was€told€byÏDickson€that€Sanders€could€not€accompany€him€to€the€dealership€because€sheÐ ¶9V01 Ðwas€out€of€town€visiting€her€father,€who€was€ill€at€the€time.€€According€to€theÏDefendant,€she€understood€that€she€had€Sandersðð€permission€to€fill€out€and€signÏthe€credit€application€on€Sandersðð€behalf.€€€ÌÌà ` àThe€Defendant€testified€that€while€at€the€dealership,€she€told€the€salesmanÏthat€her€name€was€Brand€D.€Sanders€and€that€she€was€a€paralegal.€€She€alsoÏsupplied€other€false€information€from€the€packet€of€documents€given€to€her€byÏDickson.€€However,€she€did€provide€the€salesman€with€ñš ñthe€Defendantñš ññ› ñDicksonñ› ñððs€correct€phoneÏnumber€and€address€because€ð ð[h]e€was€supposed€to€be€responsible€for€theÏpayment€of€the€vehicle.ðð€€She€maintained€that€ñœ ñthe€Defendantñœ ññ ñDicksonñ ñ€used€his€real€name€duringÏthe€meeting.ÌÌà ` àAfter€the€salesman€filled€out€the€application€using€the€false€information,€theÏDefendant€signed€it€as€though€she€were€Brand€D.€Sanders.€€She€stated,€ð ðI€wasÏunder€the€pretense€that€the€information€was€correct,€that€Ms.€Sanderððs€[sic]Ïinformation€was€correct€and€that€I€was€not€doing€anything€wrong€because€of€theÏsimple€fact€it€was€correct€and€I€had€her€permission€to€use€the€credit.ðð€€However,Ïthe€Defendant€also€stated€that€during€the€application€process,€she€was€nervous.Ìà ` àÌà ` àAt€some€point€during€the€application€process,€the€Defendant€began€to€haveÏsecond€thoughts€because€of€Dicksonððs€ð ðdemeanor.ðð€€She€stated,€ð ðI€just€didnððt€feelÏlike€it€was€a€safe€situation€for€myself.ðð€€Therefore,€she€approached€the€salesmanÏand€asked€to€terminate€the€process.€€He€responded€that€he€would€do€so€after€heÏfinished€his€cigarette.€€Ð  :À00 Їà ` àShortly€thereafter,€the€police€arrived.€€The€Defendant€was€arrested€andÏtransported€to€the€police€department.€€The€Defendant€denied€ever€representingÏherself€as€Ms.€Sanders€to€police,€claiming€instead€that€she€did€not€tell€the€policeÏanything€until€she€reached€the€police€department.€€She€also€denied€telling€policeÏthat€she€did€not€have€her€wallet€or€purse€at€the€time€of€her€arrest.€€Dickson€laterÏposted€the€Defendantððs€bond.€€The€Defendant€claimed€not€to€have€had€anyÏpersonal€contact€with€Dickson€since€that€time,€with€the€exception€of€seeing€himÏonce€in€court.ÌÌà ` àDetective€Becky€Johnson€of€the€Franklin€Police€Department€testified€thatÏshe€was€called€to€Walker€Chevrolet€on€the€night€of€the€offense.€€She€stated€thatÏwhen€she€arrived,€she€approached€the€Defendant,€who€told€her€that€her€nameÏwas€ð ðBrandy€Sanders.ðð€€Johnson€stated€that€when€she€asked€the€Defendant€forÏidentification,€the€Defendant€responded€that€she€had€none,€claiming€that€herÏpurse€and€wallet€were€at€home.€€ÌÌà ` àJohnson€also€reported€that€when€she€asked€Dickson€his€name,€DicksonÏreplied€that€he€was€Joseph€Young€and€supplied€a€driverððs€license€with€that€name.€ÏHowever,€Johnson€ð ðtold€him€point€blank€that€he€was€not€the€person€in€the€pictureÏon€that€driverððs€license.ðð€€She€explained,€ð ð[I]t€was€very€obvious€that€he€was€notÏthat€person.ðð€€Johnson€testified€that€the€officers€soon€found€a€collection€of€creditÏand€business€cards€under€the€seat€of€Dicksonððs€car,€all€of€which€were€in€the€nameÏof€Clarence€Dickson.€€It€was€later€determined€that€Dickson€had€a€prior€criminalÏrecord.ÌÐ  :À00 Ðà ` àAccording€to€Johnson,€during€an€interview€at€the€police€departmentÏfollowing€the€Defendantððs€arrest,€the€Defendant€continued€to€claim€that€she€wasÏMs.€Sanders,€while€Dickson€continued€to€claim€he€was€Joseph€Young.€ÏEventually,€after€continued€questioning,€the€Defendant€admitted€her€real€nameÏto€police€and€explained€that€she€had€gone€to€Walker€Chevrolet€to€do€a€researchÏproject€for€school.€€Johnson€testified€that€when€asked€about€the€identity€ofÏDickson,€the€Defendant€stated€that€ð ðshe€didnððt€know€who€he€was.€€She€had€metÏhim,€he€told€her€his€name€was€Joe.€€He€had€bought€her€some€clothes,€they€hadÏgone€out€but€she€didnððt€know€what€his€name€was.ðð€€According€to€Johnson,€theÏDefendant€never€explained€to€police,€as€she€did€in€court,€that€she€was€usingÏinformation€provided€by€Ms.€Sanders€with€Sandersðð€permission€to€help€DicksonÏpurchase€a€vehicle.ÌÌà ` àDetective€Johnson€also€testified€that€she€received€a€call€from€an€employeeÏat€Walker€Chevrolet€on€the€day€following€the€Defendantððs€arrest.€€She€testifiedÏthat€the€employee€told€her€that€the€child€of€a€customer€had€discovered€theÏDefendantððs€purse€in€one€of€the€artificial€plants€at€the€dealership.€€Inside€theÏpurse€was€photo€identification€of€the€Defendant€with€her€real€name.€€ÌÌà ° à€€€€€€€€€à  àà ` àFinally,€Johnson€testified€that€she€saw€the€Defendant€and€Dickson€togetherÐ ø/˜&& Ðat€the€mall€approximately€two€weeks€prior€to€the€sentencing€hearing.€€She€statedÏthat€when€the€Defendant€noticed€her,€she€ð ðturned€her€head€very€quickly.ðð€€SheÏtestified€that€she€was€unsure€what€time€of€day€she€saw€the€pair,€but€whenÏpressed,€she€stated,€ð ðIf€I€were€going€to€have€to€guess€I€would€say€probablyÏbetween€10:45€and€1:30€in€the€afternoon.ðð€€In€response€to€this€testimony,€theÐ  :À00 ÐDefendant€again€took€the€stand€and€denied€accompanying€Dickson€to€the€mall.€ÏShe€produced€payroll€records€from€the€ð ðtemp€agencyðð€where€she€worked,Ïshowing€that€on€the€day€that€Johnson€claimed€to€have€seen€her€in€the€mall,€sheÏworked€from€8:00€a.m.€until€5:00€p.m.€ÌÌà ` àOn€appeal,€the€Defendant€argues€that€the€trial€court€erred€by€refusing€toÏgrant€her€judicial€diversion.€€In€her€brief,€she€states,€ÌÓÓà8 ` àIn€sum,€what€you€have€in€this€case€is€a€twenty„one€(21)€year€oldÏcollege€student€who€was€swept€off€her€feet€by€an€older,€experiencedÏð ðcon.ðð€€This€young€woman€comes€from€a€very€strict€familyÏbackground€and€is€the€classic€type€of€prey€for€a€ð ðconðð€such€asÏClarence€Dickson.€€Ms.€Curry€not€only€successfully€graduatedÏcollege€in€four€years,€but€did€so€well€she€was€accepted€to€graduateÏschool,€while€working€an€average€of€37€hours€a€week€and€beingÏresponsible€for€the€cost€of€her€education.€€Counsel€submits€that€thisÏis€exactly€the€kind€of€Defendant€who€should€be€sentenced€pursuantÏto€T.C.A.€ðð40„35„313.Ð ` ü!` ü!
