Onappeal,theappellantdoesnotcontestthisdismissal.Rather,hechallengesaportionofthetrialcourt'sorderwhichstates:"AllofthesegroundsmustbepresentedinapetitionforpostconvictionreliefintheCriminalCourtforKnoxCounty.However,thethreeyearstatuteoflimitationsforpostconvictionreliefranonJanuary15,1996."Theappellantarguesthat,onthedatethetrialcourtentereditsfindings,April30,1996,thestatuteoflimitationsforthefilingofapetitionforpostconvictionreliefhadnotrun.HeassertsthatthenewPostConvictionProcedureActprovidesa"oneyearwindow"fromMay10,1995,tofileapetitionforpostconvictionrelief.Thus,the"window"forthefilingofhispetitionremainedopenfortenmoredays.Relyinguponthestatementoflawfromthetrialcourt,theappellantarguesthathe"filedanoticeofappealtothisCourtonthedayheshouldhavefiledhispetitionforpostconvictionreliefinKnoxCounty."AcknowledgingthattheoneyearstatuteoflimitationsunderthenewActexpiredonMay9,1996,henowrequeststhatwepermithimtolatefilehispetitionforpostconvictionreliefpursuanttothesupremecourt'srulinginNortonv.Everhart,895S.W.2d37(Tenn.1995)andRule36(a),Tenn.R.App.P.NeitherNorton,895S.W.2dat37,norTenn.R.App.P.36(a)grantsthiscourttheauthoritytoenlargethelimitationperiodforthefilingofapetitionforpostconvictionrelief.Accordingly,wedeclinetodoso. Therecordsupportsthetrialcourt'sconclusionthatthethreeyearstatuteoflimitationsapplicabletoapetitionforpostconvictionreliefintheinstantcasehadexpired.SeeTenn.CodeAnn.4030108(repealed1995).Asthetrialcourtfound,theapplicablelimitationperiodexpiredonJanuary15,1996.ThenewPostConvictionProcedureActbecameeffectiveMay10,1995,reducingthestatuteoflimitations Ԁ Xperiodfrom Ԁ Xthree Ԁ Xyears Ԁ Xtooneyear.Tenn.CodeAnn.4030202(a)(1995Supp.).Section3ofTenn.Pub.Act207,whichisnotcodified,butisnotedintheCompiler'sNotes,Tenn.CodeAnn.4030201(1995Supp.),providesthat"anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastoneyearfromMay10,1995,tofileapetition...underthispart."Thus,thelimitationprovisionofthenewAct,ineffect,createsthreepotentialcategoriesofpetitioners,whosepetitionisfiledonorafterMay10,1995.(1)ThosepetitionerswhosethreeyearstatuteofϜlimitationsexpiredbeforeMay10,1995.ApetitionerinthiscategoryistimebarredfromthefilingofapetitionbecausetheapplicablethreeyearstatuteoflimitationshasextinguishedanyremedyavailableundertheAct.(2)Thosepetitionerswhosethreeyearperiodwas"cutshort"bytheenactmentofthenewϜoneyearstatuteoflimitations.Theeffectuponthepetitionerinthisgroupisthatthethreeyearlimitationsperiodwillbereducedtooneyearplustheperiodfromthedateofthepetitioner'sfinalconvictionandMay9,1995.Finally,(3),asinthiscasesubjudice,thosepetitionerswhosethreeyearlimitationperiodexpiredduringtheperiodbetweenMay10,1995,andMay9,1996.Apetitionerinthiscategorywould,ineffect,begrantedanenlargementofthethreeyearϜlimitationperiod,conceivablytoamaximumperiodofonedaylessthanfouryears.WerejectthisenlargementargumentholdingthatthenewActdoesnottollthestatuteoflimitationsforthebalanceoftheyearfollowingtheeffectivedateoftheAct.
