Atthetimethepetitionwasfiled,theappellantwasaninmateinthecustodyoftheTennesseeDepartmentofCorrection.Inhispetition,theappellantchallengedthemannerinwhichtheDepartmentwascalculatinghissentence.Thetrialcourtdismissedtheappellant'spetition,findingthatthecourtlackedjurisdictiontograntthewritsincetheappellant'sconvictionisnotvoidnorhadhissentenceexpired.Onappeal,theappellantarguesthattheHickmanCountyCircuitCourt,upondeterminingthatitlackedsubjectmatterjurisdiction,shouldhavetransferredhispetition"toChanceryCourt,"ratherthandismissingit.ThepropermethodforchallengingtheDepartmentofCorrection'ssentencingcalculationsissetforthintheUniformAdministrativeProceduresAct.SeeTenn.CodeAnn.45101to324(1991and1995ϜSupp.).Tenn.CodeAnn.45224(a)(1991)providesthat [t]helegalvalidityorapplicabilityofastatute,ruleororderofanagencytospecifiedcircumstancesmaybedeterminedinasuitfordeclaratoryjudgmentinthechancerycourtofDavidsonCounty....𛀜Oursupremecourt,inarecent,analogouscase,heldthatacourt,lackingsubjectmatterjurisdictionoverthecasebeforeit,hasnoauthoritytotransferthecasetoanothercourt,absentspecificauthoritytodosograntedbystatute,rule,orconstitutionalprovision.Nortonv.Everhart,895S.W.2d317,319320(Tenn.1995). Inanyevent,theappellant'ssentenceexpiredonJune10,1996,atwhichtimehewasreleasedfromthecustodyoftheDepartmentofCorrection.Accordingly,thiscaseismoot.SeeMcIntyrev.Trauber,884S.W.2d134,137(Tenn.App.1994)([a]casewillgenerallybeconsideredmootifitnolongerservesasameanstoproviderelieftotheprevailingparty).Acasethatismootisnolongerjusticiable.Id. Casesmustbejusticiablenotonlywhentheyarefirstfiledbutmustalsoremainjusticiablethroughouttheentirecourseofthelitigation,includingtheappeal.Id.
