First,wenotethattherecordreflectsthatthepetitionerscounselessentiallyagreedtoadismissalofthepetitionwithoutprejudiceandraisednoconcerntothetrialcourtthatrelatestotheissuesnowpresented.Moreover,thepetitionersbrief,whichincludesonlyonehalfpageofargument,assertsnofact,Ϝclaimsnoprejudice,andcitesnolawinsupportoftheboldassertionsthepetitionernowmakes. ThePostConvictionProcedureActdoesnotauthorizethefilingofapostconvictionpetitionwhileadirectappealoftheconvictionispendingintheTennesseecourts.SeeJonesv.State,No.02C019103CR00038,ShelbyCo.(Tenn.Crim.App.Dec.11,1991),app.denied(Tenn.Dec.30,1991).Nothingisallegedorarguedthatwouldjustifyanexceptioninthiscase. Wealsodisagreewiththepetitionersassertionthatthetimelinessofhispetitionforpostconvictionreliefisa technicaldefectunderT.C.A.4030115(b)whichstates:  8  Thecourtshalllooktothesubstanceratherthantheformofthepetitionandnopetitionshallbedismissedfortechnicaldefects,incompletenessorlackofclarityuntilafterthepetitionerhashadreasonableopportunity,withaidofcounseltofileamendments.  ӀThissectionprotectsaprosepetitionerfromsummarydismissalofanincompetentlydraftedpetitionwhenthepetitionerhasnothadtheopportunitytoamendthepetitionwiththeaidofcounsel.Itdoesnotprotectapetitionerfromsummarydismissalofanuntimelyfiledpetition.SeeFredrickv.State,906S.W.2d927,930(Tenn.Crim.App.1993).Inanyevent,thepetitionerwasrepresentedbycounselatthehearingonthestatesmotiontodismissandcounseldidnotcontendthathelackedareasonableopportunitytoamendthepetition.Rather,heacknowledgedthatthepetitionwasfiledprematurely.
