Atthetimetheappellantpledguiltytoseconddegreemurder,thePostConvictionProcedureActprovidedthatapetitionerundersentenceofacourtofTennesseehadthreeyearsfromthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakentofileapetitionforpostconvictionrelief.SeeT.C.A.4030102(repealed1995).EffectiveMay10,1995,thestatuteoflimitationwasreducedtooneyear.SeeT.C.A.4030202(a).Considerationofapetitionfiledaftersuchtimewasbarredunlessthepetitionercouldshowthatoneofthethreeenumeratedexceptionsapplied.SeeT.C.A.4030202(b)(1995).Subsequently,onMay13,1996,thePostConvictionProcedureActwasamendedtoreflectthatnocourtshallhavejurisdictiontoconsiderapetitionfiledaftertheoneyearstatuteoflimitationunlessoneofthethreeenumeratedexceptionsapplied.SeeT.C.A.4030202(b).  Whileonthefaceoftherecorditappearsthattheappellantfailedtofilehispetitionforpostconvictionreliefwithintheoneyearstatuteoflimitation,thestatedidnotmakethisargumentinthetrialcourt.Instead,thestateraisesthisissueforthefirsttimeonappeal.TheappellantwasnotgivenanopportunitytoshowthatoneormoreoftheenumeratedexceptionssetforthinT.C.A.4030202(b)wouldbeapplicable,nordoestherecordreflectthatthetrialcourtconsideredtheissueofjurisdiction.Consequently,therearenofindingsforthisCourttoreview.  Accordingly,basedontheappellantspleadings,thestatesmotion,andtherecordinthiscase,weconcludethatthestatesmotiontoaffirmthejudgmentshouldbedenied.Instead,wefindthatthemattershouldberemandedtothetrialcourtforfurtherproceedings,specifically,todeterminewhetherthetrialcourthadjurisdictiontoconsidertheappellantspetitionforpostconvictionreliefonthemerits.  ITIS,THEREFORE,ORDEREDthattheabovestyledcauseisremandedtothetrialcourtforfurtherproceedingsconsistentwiththisorder.
