Thetrialcourtfoundthatappellant'soffensesoccurredfromMarch29,1993untilApril6,1993.AwarrantwasissuedonApril7,1993forfelonygamblingcharges.HeappearedbeforetheGeneralSessionsCourtonMay18,1993andwaivedapreliminaryhearing.OnDecember16,1993,thegrandjuryindictedhimforthreemisdemeanorgamblingoffenses.Heplednolocontenderetotheindictedoffenses. ThetrialcourtheldthatpursuanttoTenn.CodeAnn.402102,prosecutionformisdemeanorgamblingoffensesmustbecommencedwithinsixmonthsoftheoffenses.Prosecutionsmaybecommencedby:(1)returninganindictment,(2)findingapresentment,(3)issuingawarrant,(4)bindingovertheoffender,(5)filinganinformation,(6)appearinginpersonorthroughcounselingeneralsessionsormunicipalcourttocontinuethematter,or(7)appearingincourtforanypurposeinvolvingtheoffense.Thecourtfoundthatwithinsixmonthsoftheoffenses,awarrantwasissuedfortheappellant'sarrest,heappearedinsessionscourt,andhewasboundovertothegrandjury.Thecourt,therefore,heldthatprosecutionwastimelycommenced.
