Thelengthyhistoryofthiscasewasfullysummarizedinpreviousappealstothiscourt.SeeDavidsonv.State,No.03C019512CC00405,1997WL   167215,at*1(Tenn.Crim.App.atKnoxville,April10,1997);Davidsonv.Mills,No.  03C019110CR00338,1992WL141807,at*1(Tenn.Crim.App.atKnoxville),perm.toappealdenied,(Tenn.1992);Davidsonv.State,No.20,1989WL9628,at !` *1(Tenn.Crim.App.atKnoxville,January20,1989).Briefly,onMay2,1985,thepetitionerwasconvictedintheMeigsCountyCriminalCourtof2ndDegreeBurglary. %  Thejuryfurtherfoundthatthepetitionerwasanhabitualcriminal,astatusmandatinganenhancedsentenceoflifeimprisonment.Thiscourtaffirmedtheconvictionandsentenceondirectappeal.SeeStatev.Davidson,No.13,1987WL  +!$ 14282(Tenn.Crim.App.atKnoxville,July21,1987).ThepetitionersubsequentlyfiledtwopetitionsforpostconvictionreliefintheMeigsCountyCriminalCourtandtwopetitionsforhabeascorpusrelief,oneintheMorganCountyCriminalCourtandoneintheRoaneCountyCriminalCourt.Thiscourtgrantedrelief,inpart,pursuanttothepetitionersfirstpetitionforpostconvictionrelief.Davidson,No.20,1989WL 4 +. 9628,at*3.Thepetitionswereotherwisedenied.Davidson,No.03C019512CC `6-0 00405,1997WL167215;Davidson,No.03C019110CR00338,1992WL141807. @8.2     :04   OnOctober31,1996,thepetitionerfiledanotherpetitionforawritofhabeascorpusintheMorganCountyCircuitCourt.Thepetitionerarguedthathisjudgmentwasvoidinthatitdidnotreflectthetrialcourtsapprovalofthejurysverdictfindinghimguiltyof2ndDegreeBurglary.Thepetitioneralsoallegedthatthe  transcriptofproceedingsinthetrialcourtdoesnotindicatethatthetrialcourtorallyannouncedthepetitionerssentence.    Notwithstandingthestyleofthepetition,proceedingswereconductedbytheMorganCountyCriminalCourt,theHonorableE.EugeneEblen,Judge,presiding.ThetrialcourtissuedanorderdismissingthepetitiononNovember4,1996.Thetrialcourtruledthattheissuesallegedinthepetitionwerepreviouslylitigatedandthejudgmentisfaciallyvalid.    OnJanuary31,1997,thepetitionerfiledamotiontoamendhisoriginalpetition. X9XXX9XXXX9         1     Thepetitionerallegedthathewasnotpresentduring anysentencing #@ portionofhistrialandarguedthattheMeigsCountyCriminalCourtdidnothavepersonaljurisdictiontoproceedwithhistrialinhisabsence.Additionally,onFebruary7,1997,thepetitionerfiledamotionto [v]oidtheMorganCountyCriminalCourtsorderofdismissalor,inthealternative,grantthepetitioneradelayedappeal.Inthismotion,thepetitionerarguedthat,becausehefiledhispetitionforawritofhabeascorpuswiththeMorganCountyCircuitCourt,thecriminalcourtdidnothavejurisdictiontoruleonhispetition.Healso .%( contendedthatJudgeEblenhadpreviouslyrecusedhimselffromthepetitionerscase.    OnMarch10,1997,theMorganCountyCriminalCourtsetasideitsorderofdismissalandtransferredthecasetotheMorganCountyCircuitCourt.OnAugust20,1997,upontheStatesmotion,theMorganCountyCircuitCourtdismissedthepetitionwithout X8.2 conductingahearing.    Onappeal,thepetitionercontendsthatthetrialcourterredbydismissinghispetitionforawritofhabeascorpuswithoutahearing.Thepetitionerreliessolelyuponhisargumentthattheconvictingcourtdidnothavepersonaljurisdictioninhiscase,becausehewasnotpresentwhenthesentencewasimposed.Insupportofhisargument,thepetitionercitesTenn.R.Crim.P.43.Rule43(a)providesthat thedefendantshallbepresent8ateverystageofthetrialincluding8thereturnoftheverdict,andattheimpositionofsentence.Furthermore,thepetitionerallegesthathisinvoluntaryabsenceduringtheimpositionofhissentenceviolated afundamentalconstitutionalright.Therefore,accordingtothepetitioner,hehasnotwaivedthisissuenordoestheprincipleofresjudicatabarthesuit. WethejuryfindtheDefendant,WayneK.Davidson,isanHabitualCriminal.   8 8 (# (#THECOURT:Ifthatistheverdictofeachandeveryoneofyou,pleaseraiseyourrighthands.   8 8 (# (#Sosaythemall.   8 8 (# (#Allright,Mr.Davidson,thejuryhasdeterminedthatyouareanHabitualCriminal.Therefore,youwillhavetobetakenintocustodyatthistime.
