àAt€the€evidentiary€hearing,€the€petitioner€testified€that€his€trial€attorneyÏrepresented€him€in€a€separate€murder€case€as€well€as€in€the€present€drug€case.€€HeÏsaid€that€he€had€two€ten„minute€meetings€with€his€attorney€about€his€drug€charges.€€TheÏpetitioner€said€that€he€told€his€attorney€that€the€drugs€found€in€his€house€were€his€butÏthat€he€knew€nothing€of€the€controlled€buy€ñçñœñçñinvolvingñçñ›ñçññçññçñ€Ortago€Thomas,€and€he€was€willingÏto€go€to€trial€to€ñçñœñçñcontestñçñ›ñçññçññçñ€those€charges.€€He€said€that€he€told€his€attorney€that€ThomasÏaccepted€guilt€for€the€crime€and€that€the€attorney€should€talk€to€Thomas.€€He€said€thatÏhis€attorney€never€asked€him€about€any€witnesses,€never€investigated€the€case,€andÏnever€discussed€any€possible€defenses€to€the€drug€charges.€€ÌÌà ¸ àThe€petitioner€testified€that€the€case€was€set€for€trial€on€March€7,€1995.€ÏHe€said€that€he€had€spent€less€ñçñœñçñthañçñ›œñçñnñçñ›ñçññçññçññçññçñ€thirty€minutes€with€his€attorney€preparing€for€trialÏthat€day€and€that€they€only€discussed€his€pleading€guilty.€€He€stated€that€he€told€hisÏattorney€that€he€did€not€want€to€plead€ñçñœñçñguiltyñçñ›ñçññçññçñ€but€ñçñœñçñthat€hisñçñ›ñçññçññçñ€attorney€told€him€that€he€had€noÏchoice.€€He€stated€that€at€the€plea€hearing,€his€attorney€told€him€that€he€had€not€spokenÏwith€either€Thomas€or€Thomasððs€attorney.€ñçñœñçñ€Heñçñ›ñçññçññçñ€said€that€he€pled€guilty€to€the€conspiracyÏcharge€because€his€attorney€told€him€that€if€he€did€not€plead€guilty,€ñçñœñçñheñçñ›ñçññçññçñ€would€get€a€longÏsentence,€possibly€a€life€sentence.€€He€said€his€attorney€did€not€go€over€the€guilty€pleaÏform€with€him,€but€he€acknowledged€reading€it€before€he€signed€it.€€He€said€that€hisÏattorney€instructed€him€that€the€trial€court€was€going€to€talk€to€him€and€that€he€was€ñçñœñçñtoñçñ›ñçññçññçñÏsay€ð Ññçñounces€of€cocaine,€a€wrapper€for€a€kilogram€of€cocaine,€a€ñçñœñçñ.357ñçñ›ñçññçññçñ€magnum€handgun€andÏvarious€drug€paraphernalia€at€the€time€of€his€arrest,€but€he€denied€possessing€ñçñœñçñthirteenñçñ›ñçññçññçñÏthousand€dollars.€€He€said€that€Thomas€wrote€him€a€letter€admitting€that€the€drugs€wereÏThomasððs.€€He€said€that€before€his€guilty€plea€hearing,€Thomas€told€him€that€he€wouldÏnot€testify€against€him.€€He€said€that€he€remembered€the€trial€court€reading€to€him€at€hisÏplea€hearing,€but€he€did€not€remember€what€the€court€said.ÌÌà ¸ àOrtago€Thomas€testified€that€he€and€Carlos€Woods€engaged€in€a€drugÏtransaction€with€TBI€agents€and€that€he€and€Woods€were€arrested.€€He€said€that€theÏagents€told€him€that€if€he€ñçñœñçñimplicatedñçñ›ñçññçññçñ€the€petitioner,€he€would€get€less€time.€€He€said€heÏgave€the€agents€false€information€about€the€petitioner.€€Thomas€said€that€he€told€hisÏattorney€that€the€petitioner€was€not€guilty€and€that€he€wanted€to€tell€the€truth,€but€hisÏattorney€said€not€to€worry€about€it€because€he€was€getting€a€reduced€sentence.€€He€saidÏhe€was€not€able€to€contact€the€petitionerððs€attorney.€€He€said€that€the€drugs€sold€to€theÏTBI€agents€were€his,€that€the€petitioner€had€nothing€to€do€with€the€offense,€and€that€heÏwould€not€have€testified€against€the€petitioner.€€He€said€that€although€he€and€theÏpetitioner€lived€in€the€same€compound€at€Turney€Center,€they€had€not€discussed€thisÏcase€since€before€the€petitionerððs€trial€when€he€told€the€petitioner€that€he€would€notÏtestify€against€him.ÌÌà ¸ àThe€petitionerððs€trial€attorney€testified€that€after€the€preliminary€hearing,Ïthe€petitioner€and€his€family€told€him€that€the€drugs€belonged€to€Ortago€Thomas.€€HeÏsaid€that€as€a€part€of€discovery,€he€received€three€tapes€that€were€devastating€to€theÏpetitionerððs€case.€€He€said€that€he€and€the€petitioner€listened€to€the€tapes€together€andÏdiscussed€the€case,€and€he€advised€the€petitioner€that€he€did€not€think€that€they€shouldÏgo€to€trial.€€He€said€that€one€reason€ñçñœñçñheñçñ›ñçññçññçñ€ñçñœñçñthoughtñçñ›ñçññçññçññçñœ›ñçññçññçñ€the€plea€offer€was€beneficial€to€theÏpetitioner€ñçñœñçñwasñçñ›ñçññçññçñ€that€the€state€offered€to€dismiss€several€other€pending€drug€and€weaponÏcharges€against€the€petitioner.Ð
