àAfter€being€convicted€for€driving€under€the€influence,€second€offense,€theÏdefendant€was€sentenced€to€eleven€months,€twenty„nine€days,€with€forty„five€days€to€beÏserved€in€jail€and€the€balance€on€probation.€€The€defendant€was€also€prohibited€fromÏdriving€a€motor€vehicle€for€two€years€and€ordered€to€pay€a€six€hundred€dollar€($600)€fine.€ÏTen€months€later,€a€probation€violation€warrant€was€issued.€€Following€a€revocationÏhearing,€the€defendantððs€probation€was€revoked€and€he€was€ordered€to€serve€120€daysÏin€jail.€€He€now€appeals,€arguing€that€the€trial€court€abused€its€discretion€in€revoking€hisÏprobation.€€Finding€no€merit€to€the€defendantððs€claim,€we€affirm.ÌÌà ¨ àà àThe€evidence€at€the€revocation€hearing€established€that€Susan€CunninghamÏmet€with€the€defendant€while€he€was€serving€his€original€term€of€forty„five€days€in€jail.€€AtÏthat€time,€she€explained€to€him€that€he€must€attend€alcohol€treatment€in€order€to€complyÏwith€the€terms€of€his€probation.€€She€told€him€to€call€the€Safety€Center€when€he€wasÏreleased.€€She€also€gave€him€paperwork€for€a€licensed€provider€of€alcohol€treatment,€butÏtold€him€he€could€receive€treatment€elsewhere.€€She€noted€that€the€defendant€had€anÏð ðuncooperative€attitude.ððÌÌà ¨ àà àJeri€Holladay,€the€defendantððs€probation€officer,€unsuccessfully€tried€toÏcontact€the€defendant€when€he€was€released€from€jail€in€early€April€1997.€€She€did€notÏhear€from€him€until€late€April€when€he€called€her€to€ask€whether€he€could€forego€alcoholÏtreatment€or€paying€his€fine€because€he€had€epilepsy€and€could€not€work.€€Ms.€HolladayÏtold€the€defendant€to€send€her€medical€proof€of€his€disability.€€In€May,€the€defendantÏcalled€Ms.€Holladay€again,€and€again,€she€told€him€to€send€her€medical€proof€of€hisÐ †6&-0 Ðdisability.€€Ms.€Holladay€sent€the€defendant€a€ð ðfirst€alertðð€memorandum,€explaining€thatÏshe€had€yet€to€receive€medical€documentation€and€if€she€did€not,€she€would€initiateÏrevocation€proceedings€since€he€had€not€registered€for€alcohol€treatment.ÌÌà ¨ àà àIn€June,€Ms.€Holladay€received€a€doctorððs€letter€that€reflected€the€defendantÏcould€not€work€full„time€because€œñœñhe€ñœñsuffered›€from€epileptic€seizures.€€The€letter€did€notÏstate€that€the€defendantððs€medical€disability€prevented€him€from€attending€an€alcoholÏtreatment€program.€€Two€weeks€later,€the€defendant€called€Ms.€Cunningham€and€told€herÏthat€he€could€not€participate€in€an€alcohol€treatment€program€because€he€could€not€affordÏthe€cost.€€Ms.€Cunningham€instructed€him€to€register€anyway.€€Since€the€defendant€hadÏapparently€moved€out€of€town,€she€also€told€him€he€could€attend€a€treatment€programÏelsewhere,€but€if€he€did,€he€would€also€need€to€attend€ñ™ñœñ™ñseventy„twoñ™ñ›ñ™ñ€Alcoholic€AnonymousÏmeetings.€€Ms.€Holladay€sent€the€defendant€another€detailed€memorandum€stressing€theÏimportance€of€beginning€alcohol€treatment€and€stating€that€the€defendant€must€contactÏher€within€ten€days€or€face€revocation€proceedings.€€Seven€weeks€passed.€€In€August,ÏMs.€Holladay€received€another€doctorððs€letter€reflecting€that€the€defendantððs€medicalÏcondition€prevented€employment,€but€again€not€stating€that€his€medical€condition€wouldÏpreclude€or€interfere€with€alcohol€treatment.ÌÌà ¨ àà àInstead€of€contacting€Ms.€Holladay,€the€defendant€called€Ms.€CunninghamÏin€late€August.€€Ms.€Cunningham€told€the€defendant€he€had€not€given€a€reason€for€failingÏto€attend€alcohol€treatment€and€that€he€needed€to€either€register€with€the€Safety€CenterÏfor€no„cost€treatment€or€provide€a€doctorððs€letter€stating€his€medical€condition€preventedÏhim€from€attending€treatment.ÌÐ `6-0 Ðà ¨ àà àIn€September€and€October,€Ms.€Holladay€sent€the€defendant€two€moreÏmemoranda€reiterating€that€the€defendant€must€begin€treatment.€€The€defendant€did€notÐ L6ì,2 Ðrespond.€€In€November,€Ms.€Holladay€sent€a€final€memorandum€to€the€defendant,€givingÏhim€three€weeks€to€document€that€he€began€treatment€or€else€face€revocationÏproceedings.€€In€December,€when€the€defendant€failed€to€comply,€she€filed€a€request€forÏprobation€violation€for€noncompliance€with€treatment,€and€a€probation€violation€warrantÏwas€issued.ÌÌà ¨ àà àIn€January,€the€defendant€called€Ms.€Cunningham€to€tell€her€he€was€againÏcontacting€his€doctor.€€Later€that€month,€he€scheduled€an€appointment€to€complete€hisÏregistration€and€paperwork€for€treatment.€€He€met€with€Ms.€Cunningham€the€day€prior€toÏthe€revocation€hearing,€and€during€that€meeting,€the€defendant€disclosed€he€was€aÏveteran.€€Based€on€this,€and€because€the€defendant€had€expressed€numerous€medicalÏand€financial€issues€and€was€concerned€about€where€he€would€live,€Ms.€CunninghamÏrecommended€he€seek€in„patient€treatment€at€the€VA€hospital€in€Nashville.€€TheÏdefendant€responded€ð ðthat€he€still€didnððt€understand€why€he€needed€to€do€this€and€that.ððÌÌà ¨ àà àAt€the€conclusion€of€the€revocation€hearing,€the€trial€court€stated€he€wasÏð ðtotally€unconvincedðð€that€the€defendantððs€ð ðalleged€illnessðð€and€ð ðalleged€financial€inabilityððÏprevented€him€from€attending€alcohol€treatment.€€The€trial€court€noted€he€routinely€waivesÏthe€cost€of€alcohol€treatment€and€would€have€done€so€in€the€defendantððs€case€if€he€wasÏfinancially€unable€to€attend€treatment.€€The€trial€court€accredited€the€testimony€of€Ms.ÏCunningham€and€Ms.€Holladay,€stating€that€they€ð ðwent€several€extra€milesðð€trying€to€getÏthe€defendant€to€comply€with€the€terms€of€his€probation.€€Based€on€this,€the€trial€courtÏrevoked€the€defendantððs€probation€and€ordered€him€to€successfully€complete€the€NewÏAvenues€alcohol€treatment€program€while€serving€a€120€day€sentence€in€jail.€€The€trialÏcourt€judge€also€stated€that€once€the€defendant€successfully€completed€the€New€AvenuesÏprogram,€he€would€then€entertain€a€motion€for€a€reduced,€modified,€or€suspendedÐ àHere,€the€defendant€appears€to€contend€that€Ms.€Holladay€testified€heÏcomplied€with€the€terms€of€his€probation,€but€this€contention€is€wholly€disputed€by€theÏrecord,€which€shows€that€Ms.€Holladay€did€everything€she€could€to€encourage€andÏaccommodate€the€defendant,€but€that€the€defendant€simply€avoided€treatment.€€He€alsoÏclaims€the€trial€court€abused€its€discretion€in€revoking€his€probation€because€the€ð ðproofÏwas€quite€evidentðð€he€ð ðwas€unable€to€financially€or€medically€complete€alcohol€treatment.ðð€ÏTo€the€contrary,€the€undisputed€proof€at€the€revocation€hearing€showed€that€theÏdefendant€was€repeatedly€told€he€could€attend€treatment€at€no€cost€and€that€theÏdefendant€never€provided€proof€that€his€medical€condition€prevented€him€from€attendingÐ L6ì,2 Ðtreatment.€€The€defendant€also€claims€that€once€he€became€aware€a€warrant€was€issuedÏagainst€him,€he€ð ðtook€all€necessary€measuresðð€to€comply€with€the€terms€of€his€probation.€ÏEven€if€that€was€true,€the€defendant€should€have€complied€with€the€terms€of€his€probationÏduring€the€nine€months€before€a€warrant€issued.ÌÌà ¨ àà àIn€a€related€argument,€the€defendant€attempts€to€compare€the€fees€requiredÏfor€alcohol€treatment€to€restitution,€arguing€that€his€failure€to€attend€alcohol€treatment€wasÏnot€willful€because€he€did€not€have€the€financial€ability€to€pay€the€necessary€fees.€€TheÏdefendant€even€contends€that€once€he€knew€he€could€obtain€alcohol€treatment€withoutÏcost€to€him,€ð ðhe€immediately€inquired€about€the€program€at€the€Veteranððs€AdministrationÏHospital€for€his€alcohol€treatment.ðð€€We€need€not€address€the€defendantððs€comparison€ofÏtreatment€fees€to€restitution€because€even€assuming€the€analogy€was€sound,€the€recordÏfails€to€support€the€defendantððs€claims.€€The€record€contains€no€evidence€that€theÏdefendant€was€financially€unable€to€pay€the€necessary€treatment€fees;€the€record€reflectsÏonly€that€the€defendant€told€Ms.€Cunningham€and€Ms.€Holladay€he€could€not€afford€theÏfees.€€As€early€as€June€1997,€the€defendant€was€specifically€instructed€how€he€couldÏattend€treatment€at€no€cost,€but€he€made€no€attempt€to€take€advantage€of€that€option.€ÏInstead,€he€stalled€for€six€months€and€made€a€last„ditch€effort€to€avoid€revocation€onlyÏafter€a€warrant€issued€against€him.ÌÌà
