OPINION       Theappellant,HubertJ.Robbins,aninmateatBrushyMountainStatePrison,appealstheMorganCountyCircuitCourtssummarydismissalofhisprosepetitionforwritofhabeascorpus.Thetrialcourtgrantedthestatesmotionstodismissthepetitionwithouttheappointmentofcounseloranevidentiaryhearing.Uponreview,weaffirmthejudgmentofthetrialcourt.  OnFebruary19,1985,whilerepresentedbytwoappointedcounsel,defendantenteredpleasofguiltytofirstdegreefelonymurder,assaultwithintenttocommitfirstdegreemurderwithseriousbodilyinjury,armedrobbery,andconcealingstolenproperty.Hewassentencedtoservethreelifesentencesandonefiveyearsentence.Twoofthelifesentencesweretobeservedconcurrenttooneanotherandwereconsecutivetothethirdlifesentence.Thefiveyearsentencealsowasconcurrent.Noappealwastaken.Soonthereafterappellantfiledapetitionforpostconvictionrelief.InNovember1986thiscourtaffirmedthetrialcourtsdenialofthepostconvictionpetition.SeeHubertJ.Robbinsv.State,SevierCounty,No.74(Tenn.Crim.   App.,November13,1986). State,891S.W.2d619,626(Tenn.Crim.App.),per.app.denied(Tenn.1994).In h  criminalcases,thisremedyisavailableonlyif(1)theoriginaljudgmentofconvictionisvoidor(2)thesentencehasexpired.Passarella,891S.W.2dat626.Ifthepetition (x  failstoestablishoneofthesegroundsforrelief,thetrialcourtmaydismisstheactionwithoutanevidentiaryhearing.Id.at628.Inthiscasethejudgmentsofconvictionare 8  notvoidontheirfacesandhavenotexpired.  Thegroundsforreliefassertedherearecognizable,ifatall,inapostconvictionaction,notanactionforhabeascorpus.Suchapetitionwouldhavetobefiledinthecountywherethejudgmentofconvictionwasentered.Tenn.CodeAnn.4030204(a).JudgmentinthiscasewasrenderedinSevierCounty,andthispetitionwasfiledinMorganCounty.Accordingly,thetrialcourtdidnoterrbyfailingtotreattheapplicationasoneforpostconvictionrelief.  Furthermore,thestatuteoflimitationsforfilingapetitionforpostconvictionreliefhasexpired.Tenn.CodeAnn.4030202(a).Defendantpledguiltyin1985.HehadthreeyearsfromJuly1,1986tofileapetitionforpostconvictionrelief.Tenn.CodeAnn.4030102(repealed1995).HedidnotfilethepresentpetitionuntilMay1998.Hispetitionistimebarred.  Finally,becauseappellanthaspreviouslyfiledapetitionforpostconvictionrelief,hisclaimshavebeenpreviouslydeterminedorwaived.Tenn.CodeAnn.4030206(g)and(h).HemakesnoallegationthatwouldentitlehimtoreopenhisoriginalpetitionunderTenn.CodeAnn.4030217.Heisnotentitledtorelief.
