Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourtpursuanttoCourtofCriminalAppealsRule20. OnMarch12,1997,Appellantfiledhisprosepetitionforwritofhabeascorpusor,inthealternative,postconvictionreliefintheDavidsonCountyCriminalCourt.ThetrialcourtdismissedthepetitionwithoutahearingonMay15,1997.Bothinhispetitionandonappeal,Appellantallegesthefollowing:8 0 (1)Appellant'sguiltypleawasnotenteredknowinglyandvoluntarily;8 0 (2)Appellantreceivedineffectiveassistanceofcounsel;8 0 (3)AppellantagreedtoanillegalsentencenotpermittedbyTenn.CodeAnn.4035112,asthatsectiondoesnotallowadefendanttobesentencedtofiftyyearsincarcerationwith30percentreleaseeligibility;and8 0 (4)Thetrialcourtmisappliedcertainenhancementandmitigatingfactors. InTennessee,itiswellsettledlawthattheremedyofhabeascorpusislimitedbothinscopeandinrelief.Archerv.State,851S.W.2d157,164(Tenn.1993);Pottsv.State,833S.W.2d60,62(Tenn.1992).Incriminalcases,habeascorpusisavailableonlywherethejudgmentisvoidorthetermofimprisonmenthasexpired.Passarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994).Thehabeaspetitionerbearstheburdenofdemonstratingbyapreponderanceoftheevidencethatthejudgmentofconvictionisvoidorthathistermofconfinementhasexpired.Id.Ifthepetitionerestablishesbyapreponderanceoftheevidenceeitherthathisconvictionisvoidorthathistermofconfinementhasexpired,hecanobtainimmediaterelease.Warrenv.State,740S.W.2d427,428(Tenn.Crim.App.1986). Appellantscomplaintwouldatmostmakehisconvictionandsentencevoidable,notvoid.Furthermore,heneglectedtofilehispetitioninthemostconvenientcourttohisplaceofconfinementasrequiredbyTenn.CodeAnn.2921105. "   ׀SeeGouldinv.State,C.C.A.No.02C019605CR00145,ShelbyCounty(Tenn.Crim.App.,Jackson,February27,1997).Hence,thepetitionfailstoqualifyaswarrantingawritofhabeascorpus. Alternatively,werewetotreatthispetitionasoneforpostconvictionrelief,itisbarredbythestatuteoflimitations.PriortotheadoptionoftherecentPostConvictionProcedureAct,petitionslikethepresentonehadtobefiledwithinthreeyearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealwastaken.Tenn.CodeAnn.4030102(1995,Repl.).Accordingly,Appellant'sstatuteoflimitationsforthefilingofapetitionforpostconvictionreliefbegantorunonMay4,1993andexpiredthreeyearslateronMay4,1996.However,thenewPostConvictionProcedureAct,whichtookeffectonMay10,1995,subsequentlyshortenedthethreeyearstatuteoflimitationstooneyear.Tenn.CodeAnn.4030201etseq.(Supp.1996).WhenthenewActtookeffect,thepreviousthreeyearstatuteoflimitationshadnotexpiredforAppellant.Becausethethreeyearstatuteoflimitationshadnotexpired,Appellant'srighttopetitionforpostconvictionreliefsurvivedunderthenewAct.Accordingly,AppellanthadoneyearfromtheeffectivedateofthenewActMay10,1995inwhichtofileforpostconvictionrelief.AlbertHolstonv.State,C.C.A.No.02C019609CR00298,ShelbyCounty(Tenn.Crim.App.,Jackson.July28,1997).AppellantfiledhispetitiononMarch12,1997,approximatelytenmonthsaftertheexpirationoftheoneyearperiod.WeconcludethatthetrialcourtproperlydismissedtheMarch12,1997petitionasbeingbarredbythestatuteoflimitations. WithrespecttoAppellant'sthirdandfourthallegations,weneedonlypointoutthatinapostconvictionorhabeascorpusproceeding,thisCourtdoesnotreviewasentence.Statev.Bryant,805S.W.2d762,763(Tenn.1991).
