TheDefendantwasconvictedoftherapeofhisfifteenyearoldstepdaughter.Attrial,thevictimtestifiedagainsttheDefendantandsetforthfactssufficienttosustainaconviction.Inaddition,theDefendanthadconfessedtothecrimeinataperecordedstatementwhichwasintroducedasevidenceagainsthim.Ondirectappeal,theonlyissueraisedwaswhetherthetrialcourterredinoverrulingtheDefendant'smotiontosuppresshisconfession.ThiscourtaffirmedtherulingofthetrialcourtandupheldtheDefendant'sconviction. )   ׀NoapplicationforpermissiontoappealwasfiledwiththeTennesseeSupremeCourt.TheDefendantthensoughtpostconvictionrelief,arguingthathisconstitutionalrighttocounselwasviolatedbyineffectiveassistanceofcounsel. ThetrialcourtrejectedtheDefendant'spostconvictionpetition,findingthat:(1)Trialcounsel'sfailuretocrossexaminethevictimregardingrelativelyinsignificantinconsistenciesbetweenhertrialtestimonyandherpriorstatementswasareasonableandjustifiedtacticaldecisionwhichresultedinnoprejudice;(2)thattrialcounsel'sdecisionnottoobjecttocertainallegedlyleadingquestionswastheresultofatacticaldecisionandthattheDefendantwasnotprejudicedinthisregard;(3)thattheDefendantfailedtoestablishthattrialcounselfailedtoproperlyinvestigatethecase,failedtoputoncharacterwitnessesorfailedtoadequatelyconsultwiththeDefendantorthatanyprejudiceresultedtotheDefendantfromanysuchactions;(4)thattrialcounselpreservedforappealthesentencingissuesbyincorporatingsameintothemotionforanewtrialbutthatappellatecounsel'sdecisionnottopursuetheissueswasatacticaldecisionandthattheDefendantwasnotprejudicedinanywaybythefailuretoraisethesentencingissuesonappeal;and(5)thattheDefendantneverhadanopportunitytoseekreviewofhiscasebytheTennesseeSupremeCourt. TosecurepostconvictionreliefinTennessee,thedefendantmustproveanabridgmentofaFederalorStateconstitutionalright.Tenn.CodeAnn.4030105(repealed1995). +   ׀Toprevailonanineffectiveassistanceofcounselclaim,thedefendantmustshowthattheadversarialprocessfailedtoproduceareliableresult.Cooperv.State,849S.W.2d744,747(Tenn.1993)(citingStricklandv.Washington,466U.S.668(1984));Butlerv.State,789S.W.2d898,899(Tenn.1990)(citingStricklandv.Washington,466U.S.668(1984)). Provingfailureoftheadversarialprocessbecauseofineffectiveassistanceofcounselrequiresthedefendanttosatisfy,byapreponderanceoftheevidence,bothprongsofatwoprongedtest.SeeButler,789S.W.2dat899.First,thedefendantmustprovethatcounsel'sperformancefailedtomeetthethresholdofcompetencedemandedofattorneysincriminalcases.Butler,789S.W.2dat899.Second,thedefendantmustproveactualprejudiceresultingfromthedeficientperformance.Cooper,849S.W.2dat747(citingStrickland,466U.S.at687). Scrutinyofcounsel'sperformanceshouldbehighlydeferential.Strickland,466U.S.at689.Thecourtshouldjudgecounselatthetimeoftheallegederrorinlightofallfactsandcircumstances.Strickland,466U.S.at690;seeCooper,849S.W.2dat746.Tosatisfythisprong,thedefendantmustshowthatcounsel'sperformancedoesnotmeettheSixthAmendmentstandardofobjectivereasonableness.Strickland,466U.S.at687;Cooper,849S.W.2dat747.Objectivereasonablenessdemandsthatcounsel'sperformancefallwithinthewiderangeofprofessionalcompetency.Strickland,466U.S.at688,690;seeCooper,849S.W.2dat746.Informedtacticaldecisionsmadebytrialcounsel,suchasadecisionnottocallthedefendanttotestify,arenottobesecondguessed.Hellardv.State,629S.W.2d4,9(Tenn.1982).  Thedefendantmustproveprejudicethatresultsinanunfairorunreliableproceeding.Lockhartv.Fretwell,113S.Ct.838,84344(1993);Strickland,466U.S.at687.Tosatisfythisprong,thedefendantmustshowareasonableprobabilitythat,butforcounsel'sunreasonableerror,thefactfinderwouldhavehadreasonabledoubtregardingdefendant'sguilt.Strickland,466U.S.at695.Thisreasonableprobabilitymustbe"sufficienttoundermineconfidenceintheoutcome."Harrisv.State,875S.W.2d662,665(Tenn.1994). TheresolutionofthefactualissuesraisedbytheDefendantwasdeterminedbythetrialcourtafterahearinginwhichtheDefendant'swife,whowasthemotherofthevictim,theDefendant,andtheDefendant'strialcounseltestified.Thetrialjudgeweighedthetestimonyofthesewitnesses,examinedtherecordofhisconviction,andfoundthattheDefendanthadfailedtocarrytheburdenofprooftosupporthisclaims,whichtheDefendantmustdotoprevail.Statev.Kerley,820S.W.2d753(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1991).Thiscourtisboundbythefindingsofthetrialjudgeonthefactualdeterminationsunlesstheevidencepreponderatesagainstthefindings.Rhodenv.State,816S.W.2d56(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1991).Weconcludethattheevidencesupportsthefindingsofthetrialjudge. InPinkstonv.State,668S.W.2d676(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1984),thisCourtsaidthat"unilateralterminationofadirectappealfollowingfirsttierreviewentitlesaprospectiveappellanttoreliefintheformofadelayedappeal."Id.at677.Theappropriateprocedureforobtainingpostconvictionreliefofthissortisforthetrialcourttoholdahearingandmakerelevantfindingsoffactconcerningthepetitioner'sallegationsofdeprivationofsecondtierreview.Id.Oncethetrialcourtfindsafactualbasisforreliefbutdeniesreliefforlackofjurisdiction,thepetitionerisabletoappealthatjudgmenttotheCourtofCriminalAppealswhichistheonlyCourtthatcanvacateandreinstateitsownjudgments.Id. Inthecasesubjudice,thetrialcourtfoundthattheDefendant'sattorneydidnotadvisehimofhisrighttoappealfromtheCourtofCriminalAppealstotheTennesseeSupremeCourt.Thus,thetrialcourtfoundafactualbasisforreliefbutdismissedthepetitionforlackofjurisdictiontovacateandreinstatetheCourtofCriminalAppeals'judgment.Accordingly,theproofisunrefutedintherecordthattheDefendantwasdeniedtheopportunityofreviewbytheTennesseeSupremeCourtthroughnofaultofhisown.TheStatedoesnotopposethereliefsoughtbytheDefendant.We,therefore,vacateourjudgmentinStatev.ErnestLoydRay,No.02C019108CC00166,DyerCounty(Tenn.Crim.App.,Jackson,filedAug.26,1992),andreinstateitasofthedateofthefilingofthisopinion. AsthisCourtsaidinPinkston,ourgrantofreliefunderthesecircumstancesinnowaysuggestsatruereversalofthetrialcourt'sjudgmentbutis"simplyanapplicationofappropriateauthorityandjurisdiction."Id.at678.WeappreciateJudgeRiley'sclearanddefinitivehandlingoftheissue.
