Ðwas€sentenced€to€a€term€of€ten€years€to€be€served€in€the€Tennessee€Department€ofÏCorrection.€€The€trial€court€denied€the€defendantððs€subsequent€motion€for€a€new€trial.€€TheÏdefendant€now€appeals€and€contends€that€the€evidence€is€insufficient€to€support€hisÏconviction€and€that€his€sentence€is€excessive.€€After€a€review€of€the€record€and€applicableÏlaw,€we€find€no€merit€to€the€defendantððs€contentions€and€thus€affirm€the€judgment€of€theÏtrial€court.ÌÌà œ àà ô àThe€evidence€at€trial€indicated€that€on€February€8,€1996,€the€defendant€wasÏvisiting€the€victimððs€parents€in€their€home.€€At€approximately€5:45€p.m.,€the€victimððsÏparents€left€the€house€for€an€appointment€at€Accu„Tax.€€Before€leaving,€the€victimððsÏparents€asked€the€defendant€to€stay€with€the€victim€and€he€agreed.€While€at€Accu„Tax,Ïthe€victimððs€mother€received€a€phone€call€from€a€friend€who€indicated€that€the€victim€hadÏbeen€molested.€€The€victimððs€parents€rushed€home€to€find€the€victim€crying€andÏð ðhysterical.ðð€€The€defendant€was€sitting€on€the€couch€watching€television.€€The€policeÏarrived€shortly€thereafter€and€the€defendant€was€escorted€off€the€premises.€€ÌÌà œ àà ô àAccording€to€the€victim,€after€her€parents€left€the€house€she€and€theÏdefendant€started€playing€with€a€water€bottle.€€After€she€squirted€the€defendant€withÏwater,€he€playfully€chased€her€around€the€house.€€The€victim,€who€was€ten€years€old€atÏthe€time,€tried€to€hide€from€the€defendant.€€The€defendant€then€came€up€behind€theÏvictim,€held€her€arms,€covered€her€mouth,€and€said,€ð ðShhh,€be€quiet,€donððt€scream.ðð€€TheÏdefendant€slid€his€free€hand€down€the€inside€of€the€front€of€her€shirt€and€touched€andÏrubbed€her€breasts€and€nipples.€€The€victim€testified€that€the€touching€lasted€forÐ v7.1 Ðapproximately€fifteen€seconds€while€she€was€struggling€to€get€loose.€€After€freeing€herselfÐ l7 .3 Ðfrom€the€defendant,€the€victim€ran€to€the€bathroom€and€locked€the€door.€€The€defendantÏcame€to€the€door€and€told€the€victim€there€was€no€use€in€telling€anyone€what€hadÏhappened€because€her€father€would€not€believe€her.€€A€short€while€later,€the€victim€leftÏthe€bathroom,€went€into€her€motherððs€bedroom,€and€called€a€family€friend€who€in€turnÏcontacted€the€victimððs€mother.€€ÌÌà œ àà ô àThe€defendant€also€testified€at€trial.€€According€to€the€defendant,€afterÏplaying€with€a€water€bottle,€he€and€the€victim€sat€down€to€watch€television.€€They€couldÏnot€agree€on€which€television€show€to€watch.€€The€defendant€then€told€the€victim€to€goÏto€her€room€and€she€ð ðthrew€a€fit.ðð€€The€defendant€approached€the€victim€and€ð ðpointed€herÏtowards€.€.€.€her€bedroom.ðð€€The€defendant€claimed€he€touched€the€victimððs€sides€and€theÏvictim€fell€to€the€floor€causing€her€shirt€to€ð ðcome€up.ðð€€The€defendant€testified€that€whenÏhe€tried€to€pick€the€victim€œñoñœñoñoffñoñ›ñoññxñ€ofñxñ›€the€floor,€she€claimed€he€touched€her€breasts€and€ran€intoÏher€motherððs€bedroom.€€The€defendant€testified€that€he€did€not€intentionally€touch€theÏvictimððs€breasts.ÌÌà œ àà ô àThe€defendant€now€contends€that€the€evidence€is€insufficient€to€sustain€hisÏconviction.€€Specifically,€the€defendant€argues€that€there€was€no€evidence€that€heÏintentionally€touched€the€victimððs€chest€for€purposes€of€sexual€arousal€or€gratification,€anÏessential€element€of€the€crime€of€aggravated€sexual€battery.€€òòSeeóó€T.C.A.€ðððð€39„13„501(6),Ð ð[ñoñœñoñt]heñoñ›ñoñ€victim€is€less€than€thirteen€(13)€yearsÏof€age.ðð€€T.C.A.€ðð€39„13„504(a).€€ð ðSexual€contactðð€is€defined€as€the€ð ðintentional€touchingÏof€the€victimððs€.€.€.€intimate€parts,€or€the€intentional€touching€of€the€clothing€covering€theÏimmediate€area€of€the€victimððs€.€.€.€intimate€parts,€if€that€intentional€touching€can€beÏreasonably€construed€as€being€for€the€purpose€of€sexual€arousal€or€gratification.ðð€€T.C.A.Ïðð€39„13„501(6).€€ÌÌà œ àà ô àThe€evidence€adduced€at€trial€established€that€the€defendant€held€theÏvictimððs€arms,€put€his€hand€over€her€mouth,€told€her€to€be€quiet,€slid€his€hand€under€herÏshirt,€and€rubbed€her€breasts€and€nipples.€€This€touching€continued€until€the€victim€wasÏable€to€free€herself€from€the€defendantððs€hold.€€The€victimððs€testimony€indicated€that€theÏtouching€was€purposeful€rather€than€accidental.€€This€Court€has€held€that€jurors€may€useÐ L6ì,2 Ðtheir€common€knowledge€and€experience€in€making€reasonable€inferences€from€theÏevidence.€€òòState€v.€ñoñœñoñMeeksñoñ›ñoñóó,€876€S.W.2d€121,€131€(Tenn.€Crim.€App.€1993).€€As€such,€theÐ , Ì Ðjury€could€have€drawn€on€common€knowledge€to€reasonably€infer€that€the€defendantÏrubbed€the€victimððs€breasts€for€the€purpose€of€sexual€arousal€or€gratification.€€òòSeeóó€òòid.óó€Ð Äd ÐCounty€(Tenn.€Crim.€App.€filed€November€20,€1997,€at€Jackson)€(holding€proof€that€theÏdefendant€forced€the€eleven„year„old€victim€onto€the€floor€and€fondled€her€breasts€on€topÏof€her€clothes€sufficient€to€support€a€conviction€for€aggravated€sexual€battery).ÌÌà œ àà ô àThe€defendant€further€claims€ñoñœñoñthatñoñ›ñoñ€based€on€his€level€of€intoxication,€heÏð Ðheld€her€arms€and€covered€her€mouth€while€rubbing€her€breasts.€€Although€the€defendantÏtestified€that€any€touching€that€occurred€was€merely€accidental,€it€was€within€the€provinceÏof€the€jury€to€accredit€or€discredit€such€testimony.€€òòSeeóó€òòCabbageóó,€571€S.W.2d€at€835.€€Ð ø ˜ ÐIn€light€of€its€verdict,€the€jury€obviously€found€that€the€defendant€acted€intentionally€ratherÏthan€accidentally,€and€we€will€not€disturb€the€juryððs€factual€finding€on€appeal.€€òòId.óó€Ð 0 ÐÌà œ àà ô àThe€defendant€next€contends€that€his€sentence€is€ñwñœñwññoñœñoñexcessive.ñtñ€€ñtññoñ›œ›ñoññsñ̛̛à d# à›à d# àñsñWhenñwñ›ñwñ€aÏdefendant€complains€of€his€or€her€sentence,€we€must€conduct€a€de€novo€review€with€aÏpresumption€of€correctness.€€T.C.A.€ðð€40„35„401(d).€€The€burden€of€showing€that€theÏsentence€is€improper€is€upon€the€appealing€party.€€T.C.A.€ðð€40„35„401(d)€SentencingÏCommission€Comments.€€This€presumption,€however,€ð ðis€conditioned€upon€the€affirmativeÏshowing€in€the€record€that€the€trial€court€considered€the€sentencing€principles€and€allÏrelevant€facts€and€circumstances.ðð€€òòState€v.€ñoñœñoñAshbyñoñ›ñoñóó,€823€S.W.2d€166,€169€(Tenn.€1991).Ð ð ÐÌà œ àà ô àThe€Sentencing€Reform€Act€of€1989,€codified€at€T.C.A.€ðð€40„35„210,Ïprovides€that€the€minimum€sentence€within€the€range€is€the€presumptive€sentence.€€IfÏthere€are€enhancing€and€mitigating€factors,€the€court€must€start€at€the€minimum€sentenceÏwithin€the€range€and€enhance€the€sentence€as€appropriate€for€the€enhancement€factorsÏand€then€reduce€the€sentence€within€the€range€as€appropriate€for€the€mitigating€factors.€ÏIf€there€are€no€mitigating€factors,€the€court€may€set€the€sentence€above€the€minimum€inÏthat€range€but€still€within€the€range.€€The€weight€to€be€given€each€factor€is€left€to€theÏdiscretion€of€the€trial€judge.€€òòState€v.€ñoñœñoñSheltonñoñ›ñoñóó,€854€S.W.2d€116,€123€(Tenn.€Crim.€App.Ð /¼%* Ð1992).ÌÌà œ àà ô àThe€defendant€concedes€that€the€trial€court€appropriately€appliedÏenhancement€factor€(1),€that€the€defendant€has€a€previous€history€of€criminal€convictionsÐ L6ì,2 Ðand€criminal€behavior,€and€enhancement€factor€(6),€that€the€personal€injuries€inflictedÏupon€the€victim€were€particularly€great.€€T.C.A.€ðð€40„35„114(1),€(6).€€However,€theÏdefendant€challenges€the€trial€courtððs€consideration€of€three€citations€of€contempt€thatÏwere€filed€at€the€time€the€defendant€was€sentenced.€€The€trial€court€stated€ñoñœñoñthatñoñ›ñoñ€althoughÏthere€was€no€proof€in€the€record€regarding€the€disposition€of€the€citations,€the€citationsÏdid€indicate€ð ða€failure€to€follow€some€orders€arising€from€[other]€convictions.€€EvidentlyÏthat€doesnððt€weigh€very€heavily€in€my€estimation,€but€it€is€present.ðð€€As€there€was€noÏevidence€in€the€record€regarding€the€facts€surrounding€the€citations€or€the€disposition€ofÏthe€citations,€it€was€improper€for€the€trial€court€to€consider€the€citations€as€anÏenhancement€factor.€€However,€the€trial€court€placed€little€emphasis€on€this€factor.€ò òÐ Œ, ÐÌó óà œ àà ô àThe€defendant€also€contends€that€the€trial€court€failed€to€consider€ñoñœñoñseveralñoñ›œ›ñoñÐ 0Ð Ðmitigating€factors.€€The€defendant€first€argues€that€the€trial€court€should€have€consideredÏas€a€mitigating€factor€the€fact€that€he€acted€under€strong€provocation.€€T.C.A.€ðð40„35„¼113(2).€€The€defendant€argues€that€his€level€of€intoxication€in€conjunction€with€ð ðtheÏhorseplay€between€him€and€the€victim€followed€by€their€argument€over€the€TV€shouldÏhave€been€considered€as€strong€provocationðð€by€the€trial€court.€€According€to€theÏdefendant,€ð ð[ñoñœñoña]lcoholñoñ›ñoñ€is€known€to€bring€out€the€worst€in€people,€and€it€is€hard€to€imagineÏsomeone€not€reacting€under€strong€provocation€when€he€is€drunk,€soaking€wet€and€beingÏargued€with€and€yelled€at€by€a€child€of€this€age.ðð€€However,€the€defendant€cites€noÏauthority€to€support€his€contentions.€€In€addition,€the€record€does€not€contain€anyÏevidence€of€strong€provocation€that€would€justify€mitigation€of€the€defendantððs€sentence.€ÏAs€such,€this€contention€is€without€merit.ÌÌà ÐT.C.A.€ðð€ñoñœñoñ40„35„113(11).ñoñ›ñoñ€€ñwñœñwññuñIn€support€of€this,€he€arguesñuññuñ›The›€defendant›€bases›€this›€asseñuññvñrtion›€on›€the›€ñvññoñœñoññvñfactsñvññoñ›ñoññwñ›ñwñ€that€he€was€intoxicated,€he€wasÏarguing€with€the€victim,€he€was€soaking€wet,€and€this€incident€lasted€only€seconds.€ÏHowever,€the€testimony€indicated€that€the€defendant€came€up€behind€the€victim,€held€herÏarms,€covered€her€mouth,€told€her€to€ð ðbe€quiet,ðð€fondled€her€for€approximately€fifteenÏseconds,€and€then€told€her€that€there€was€no€use€in€telling€anyone€about€the€incidentÏbecause€ñoñœñoñshe€would€not€beñoñ›ñoñ€ñoñœñoñbelieved.ñoñ›ñoñ€€These€facts€are€inconsistent€with€the€defendantððsÏargument€that€he€did€not€have€a€sustained€intent€to€violate€the€law.€€As€such,€we€find€noÏmerit€to€this€contention.ÌÌà œ àà ô àThe€defendant€further€contends€that€the€trial€court€should€have€applied€hisÏremorse€as€a€mitigating€factor.€€T.C.A.€ðð€40„35„113(13).€€However,€a€sentencing€court€isÏnot€required€to€consider€the€defendantððs€remorse€as€a€mitigation€factor.€€Therefore,€failureÏto€apply€such€a€mitigator€to€reduce€the€defendantððs€sentence€cannot€be€considered€anÏerror.€€As€such,€this€contention€is€also€without€merit.ÌÌà œ àà ô àThe€possible€range€of€punishment€for€this€offense€is€eight€to€twelve€years.€ÏIn€light€of€the€foregoing€applicable€enhancement€factors€and€lack€of€applicable€mitigatingÏfactors,€it€was€entirely€proper€for€the€trial€court€to€sentence€the€defendant€to€a€term€of€tenÏyears€as€a€Range€I€standard€offender.ÌÌà œ àà ô àThe€defendant€next€contends€that€the€trial€court€erred€in€not€placing€him€inÏa€community€corrections€program€rather€than€incarceration.€€To€be€eligible€forÏconsideration€of€a€sentence€in€a€community€corrections€program,€an€offender€must€meetÏthe€requirements€of€T.C.A.€ðð€40„36„106.€€In€this€case,€the€defendant€was€convicted€ofÏaggravated€sexual€battery,€which€is€a€felony€offense€involving€a€crime€against€a€personÏas€provided€in€title€39,€chapter€13,€parts€1„5.€€As€such,€the€defendant€is€ineligible€forÐ L6ì,2 Ðcommunity€corrections€sentencing€under€subsection€(a).€€òòSeeóó€T.C.A.€ðð€40„36„106(a)(2).€Ð `  ÐÌœñyñÌñyñ›à œ àà ô àThe€defendant€contends€that€he€is€eligible€for€community€correctionsÏsentencing€under€the€special€needs€provision€of€the€sentencing€statute.€€T.C.A.€ðð€40„36„¼106(c).€€However,€ð ð[b]efore€an€offender€may€be€sentenced€pursuant€to€subsection€(c),€theÏoffender€must€be€found€eligible€for€probation.ðð€€òòState€v.€Grigsbyóó,€957€S.W.2d€541,€546Ð \ü  Ð(Tenn.€Crim.€App.€1997)(òòcitingóó€òòState€v.€Statenóó,€787€S.W.2d€934,€936€(Tenn.€Crim.€App.Ð (È  Ð1989)).€€The€defendant€was€convicted€of€T.C.A.€ðð€39„13„504,€aggravated€sexual€battery,Ïand€is€therefore€statutorily€ineligible€for€probation.€€òòSeeóó€T.C.A.€ðð€40„35„303(a).€€As€such,Ð À` Ðthe€defendant€is€also€ineligible€for€community€corrections€sentencing€under€subsectionÏ(c).€€In€light€of€the€foregoing,€the€trial€court€properly€ordered€the€defendant€to€serve€hisÏsentence€of€ten€years€in€the€Tennessee€Department€of€Correction.ÌÌà
