Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt.@  @  I.FactualBackground  Theevidenceatthesentencinghearingrevealedthattheappellantwasatwentyyearoldsingleparentofatwoyearoldchild.Althoughshehasnoconvictionsasanadult,shewasadjudicatedunrulyasajuvenileandplacedonprobation.Withinthreemonthsofthisadjudication,theappellantwasfoundtobeinviolationofherprobationandwassenttoJohnsonGirlsGroupHome.Additionally,theappellanthasalengthyhistoryofinvolvementwithcontrolledsubstances.TheappellantbegansmokingmarijuanaandusingcocaineattheageoffifteenwhenshebecameinvolvedwithJohnRussell,thefatherofherchild. &   ׀Atagesixteen,theappellantenteredasubstanceabuseprogram.Whileintreatment,sheremainedsober.However,oncereleased,sherefusedtoattendthemeetingsrecommendedasapartofherrehabilitationandwithinmonths,returnedtoherformerhabitsinvolvingmarijuanaandcocaineabuse.Theappellantadmittedthat,sinceherarrestontheinstantcharges,shehassmokedmarijuanaapproximately"sixorseventimes,"althoughshedeniesusingcocaine.Moreover,byherownadmission,theappellanthasahistoryofassociatingwiththoseinvolvedintheunlawfuluseanddeliveryofcontrolledsubstances.ThisisevidencedbyherrelationshipwithJohnRussell,hertwocodefendantsinthiscase, '   ׀andKevinChaney,hermostrecentboyfriend. (   ׀TherecordindicatesthatChaneyhasahistoryofbothmarijuanaandcocaineinvolvementandhasbeenconvictedintheCircuitCourtofBlountCounty.Theappellantmaintainedthatshenolongerintendstoassociatewiththiscrowd. Theappellanttestifiedthat,sinceNovember21,1994,shehasbeenemployedfulltimewithSewFinewheresheearnsfivedollarsanhour.Shealsostatedthatsheisinvolvedinvarioussubstanceabuseprograms.Specifically,sheclaimedthatsheattendstheREBOSprogramthreedaysaweek,AlcoholicsAnonymoustwodaysaweek,andmeetingsattheUniversityofTennesseeHospitalonedayaweek. Indenyingtotalprobation,thetrialcourtsimplystated,"Youwouldbeanexcellentcandidateforimmediateprobationwereitnotforthefactthatyoupersistedinusingacontrolledsubstanceevenafteryouwerearrestedandchargedwithviolatingthelawinvolvingcontrolledsubstances.Andthatcan'tbeapproved,thatkindofbehavior."Thetrialcourt,pursuanttothepleaagreement,sentencedtheappellanttotwoyearsasarangeIoffenderofaclassDfelony.Regardingthemannerofservice,thecourtorderedthattheappellantservefifteendaysofperiodicconfinementwiththeremainderofthesentenceonsupervisedprobation. )   @  II.DenialofProbation  Theappellantcontendsthatthetrialcourterredbynotimposingasentenceoftotalprobation.Whenachallengeismadetothemannerofserviceofasentence,itisthedutyofthiscourttoconductadenovoreviewwithapresumptionthatthedeterminationmadebythetrialcourtiscorrect.Tenn.CodeAnn.4035401(d)(1990).Thispresumptiononlyapplies,however,iftherecorddemonstratesthatthetrialcourtproperlyconsideredrelevantsentencingprinciples.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Thetrialcourtdeniedtotalprobationbecauseoftheappellant'scontinueduseofmarijuanaafterherarrest.Thetrialjudge'sfindingsareinsufficienttoestablishthatheconsideredallrelevantsentencingprinciples.Therefore,weareunabletoaffordthepresumptionofcorrectnesstothecourt'sdetermination.  Adefendantispresumedtobeafavorablecandidateforalternativesentencingifthreeconditionsaremet.First,thedefendantmustbeanespeciallymitigatedorstandardoffender.Tenn.CodeAnn.4035102(6)(1994Supp.).Second,thedefendantmustbeconvictedofaclassC,D,orEfelony.Id.Finally,thedefendantmustnotfallwithintheparametersofTenn.CodeAnn.4035102(5)(1994Supp.).Thismeansthatthedefendantcannothaveacriminalhistoryevincingeither"cleardisregardforthelawsandmoralsofsociety"or"failureofpasteffortsatrehabilitation."Id.Theappellant,afirsttimeoffender,wasconvictedofaclassDfelony.Thus,thepresumptionapplies.Moreover,anappellantiseligibleforprobationifthesentenceimposediseightyearsorlessandisnotstatutorilyprohibited.Tenn.CodeAnn.4035303(a)(1994Supp.).BecausetheappellantwassentencedtoatermoftwoyearsandbecauseshewasnotconvictedofacrimeenumeratedinTenn.CodeAnn.4035303(a),theappellantisstatutorilyeligiblefortotalprobation. Theappellant'sargumentthat"thereis[a]presumptioninfavorofprobation"ismisplaced.Whiletheappellantisentitledtothestatutorypresumptionofalternativesentencing,theappellanthastheburdenofestablishinghersuitabilityfortotalprobation.Tenn.CodeAnn.4035303(b)(1994Supp.);Statev.Bingham,910S.W.2d448,455(Tenn.Crim.App.1995)(emphasisadded).Tomeetthisburden,theappellantmustdemonstratethatprobationwill"subservetheendsofjusticeandthebestinterestofboththepublicandthedefendant."Bingham,910S.W.2dat456. Thefollowingfactorsshallbeaccordedweightwhendecidingthedefendant'ssuitabilityforprobation:(1)"thenatureand[circumstances]ofthecriminalconductinvolved,"Tenn.CodeAnn.4035210(b)(4)(1990);(2)thedefendant'spotentialorlackofpotentialforrehabilitation,includingtheriskthatduringtheperiodofprobationthedefendantwillcommitanothercrime,Tenn.CodeAnn.4035103(5)(1990);(3)whetherasentenceoffullprobationwouldundulydepreciatetheseriousnessoftheoffense,Tenn.CodeAnn.4035103(1)(B)(1990);and(4)whetherasentenceotherthanfullprobationwouldprovideaneffectivedeterrenttootherslikelytocommitsimilarcrimes,Tenn.CodeAnn.4035103(1)(B)(1990).SeeBingham,910S.W.2dat456. Upondenovoreview,weconcludethat,theappellanthasfailedtoestablishhersuitabilityfortotalprobation.Consideringtheevidencepresentedatthesentencinghearing,weconcludethatpreviouseffortstorehabilitatetheappellanthavefailed.Thisfindingaloneissufficienttodenytotalprobation.SeeStatev.JeffreyDanaYork,No.01C019412CC00410(Tenn.Crim.App.atNashville,June28,1995).Giventhefailureofpasteffortsatrehabilitation,theappellant'scontinueddruguse,andherassociationwithknowndrugusers,theappellant'ssuitabilityfortotalprobationisquestionable.However,althoughnotsuitedfortotalprobation,theappellantremainsafavorablecandidateforsomeformofalternativesentencing.Thetrialcourtimposedatwoyearsentenceofsplitconfinementrequiringthattheappellantonlyservefifteendaysonweekendsinthecountyjail.Underthefactspresented,thissentenceismostlenient.Weconcludethattheappellantwouldbenefitfromsuchsentence.Accordingly,thejudgmentofthetrialcourtisaffirmed.     ____________________________________     DavidG.Hayes,JudgeCONCUR:_______________________________WilliamM.Barker,Judge_______________________________JerryL.Smith,Judge
