First,Iagreewiththegroundsuponwhichthecourthasreversedandremandedthiscase.Thetrialjudge'sstatementindicateseitheradissatisfactionwiththejury'sverdictoramisunderstandingofhisauthoritytoactasthirteenthjuror.Anappellatecourtmustgrantanewtrialunderbothcircumstances.Heltonv.State,547S.W.2d564,566(Tenn.1977);Statev.AndrewLeeMoats,No.03C019302CR00038(Tenn.Crim.App.,Knoxville,May2,1994),perm.toappealgranted,(Tenn.1994).  Secondly,becausethiscasewillberetriedandbecauseofourobligationtothelitigantsandtheadministrationofjustice,Inoteotheregregiouserrorsinthisrecord.  Theevidenceofpremeditationanddeliberationinthisrecordisentirelycircumstantial,consistingmainlyofproofrelativetodefendant'saffairandplanneddivorce.Inorderforcircumstantialevidencealonetosufficientlyestablisharequisiteelement,thefactsandcircumstancesmustbesuchthatthe"jurycoulddrawnootherreasonableinferencesavetheguiltofthedefendantbeyondareasonabledoubt."Statev.Crawford,470S.W.2d610,613(Tenn.1971).  Thestate'stheoryisthatdefendantmurderedherhusbandtoassureshewouldgetcustodyofherchildrenortocollecthislifeinsuranceproceeds.Theseinferencesarenotsustainedbytheproof.  Bothdefendantandherhusbandwerededicatedtothechildren.Nothingintherecordsuggeststhatdefendanthadanyreasontofearthatshewouldbedeniedcustody.Further,neitherdefendantnorherloverhadfinancialconcerns.Defendanthadagoodjobwithprospectsofbetteremploymentaftershefinishedcollege.  Moreimportantly,thestate'sexpertdetailedthemethodsbywhichthisguncouldhavefired.Inadditiontothemethodwhichwouldindicateadeliberated,premeditatedmurder(cockthehammer,pullthetrigger),itisequallylikelythattheguncouldhavefiredbytheexactmethoddefendantclaimed(hammerisback,fingerontrigger,victimreachesandpullsguntowardhim).  WhileIdonotgosofarastoconcludethattheevidencewasinsufficienttoestablishpremeditationanddeliberation,I,nonetheless,urgethestatetoconsiderthescantnatureoftheevidenceontheseessentialelementsonretrial.SeeStatev.West,844S.W.2d144,147(Tenn.1992);Statev.Brown,836S.W.2d530,543(Tenn.1992).  Ashersecondissuedefendantallegesseveralincidentsofprosecutorialmisconduct.Thecourtdeterminedthattheissuewaspretermitted.Idonotagree.WhileIdonotfinditnecessarytodeterminewhethertheseincidentswouldrequireareversal,Ibelievethatweareobligedtoaddresstheissue,particularlyinlightoftheseriousness.  Threeofthespecificerrorsallegedconcerntheprosecution'sfailuretoproduceevidence,includingdefendant'sstatementpursuanttoRule16,TennesseeRulesofCriminalProcedure,witnessWandaFitch'sstatementpursuanttoRule26.2,TennesseeRulesofCriminalProcedure,andexculpatoryinformationpursuanttoBradyv.Maryland,373U.S.83(1963).Thefourthaddressestheprosecutor'sclosingargumentwhichsuggestedthatdefendanthadconspiredwithherlovertomurderherhusbanddespitetheabsenceoffactstosupportthatconclusion.  Thethreediscoveryviolationswereserious.Defendantwasentitledtoallofher"writtenandrecordedstatements"and"thesubstanceofanyoralstatementwhichthestateintendedtoofferinevidence."Tenn.R.Crim.P.16.Thestate'sclaimthatdiscoverywasnotrequiredsincethestatementswerenotapartofthe"officialreport"iswithoutmerit.Likewise,theclaimthatthestatementswerenotdiscoverablebecausetheywerenotinresponsetointerrogationisincorrect.Defendantshouldhavebeengiventhesestatementspriortotrial.  Likewise,thestatementsofwitnessWandaFitchshouldhavebeenproduced,atleastafterhertestimony.Tenn.R.Crim.P.26.2(a).Thestate'sclaimthattheydidnothaveorwerenotawareofhavingthestatementsdoesnotexcusethemandatoryobligationimposedbyRule26.2.Likewise,thefactthatdefendantmayhaveaccesstoawitnesswhohasprovidedexculpatoryinformationdoesnotnecessarilynegatetheobligatoryBradydisclosure.  Astodefendant'sprosecutorialmisconductclaim,weemphasizeagainforthebenefitofthebarthatitisunethicalforcounseltomakeargumentsthathavenobasisinfact.D.R.7102(a)(5),Tenn.Sup.Ct.R.8.Thecourtshoulddisallowsuchconductonthepartofcounsel,evenabsentobjection.SeeStatev.Sutton,562S.W.2d820,82326(Tenn.1978).  Theotherissuesraisedbydefendantdonotmeritconsiderationgiventhedispositionofthisappeal.ForthereasonsIhavegivenIconcurinthereversalofthisconvictionandtheremandforanewtrialwhich,ateitherparty'soption,maybebeforeadifferentjudge.Tenn.R..Crim.P.33(f).     ____________________________________     PennyJ.White,Judge
